President Aquino continues with his penchant for appointing personal family friends in his government, no matter how old they are, and how inexperienced they are.

Aquino has chosen a businessman and family friend inexperienced in diplomacy as the new Philippine ambassador to China at a time when major problems, such as the series of territorial spats in the contested Spratlys in the South China Sea, are straining the country’s bilateral ties with Beijing.

The nomination of Domingo Lee, a personal friend of the Aquinos, immediately triggered criticisms from top Philippine diplomats, expressing doubts on Lee’s ability to handle such sensitive issues given his lack of experience in foreign relations.

A copy of Lee’s appointment papers signed by the President in late May that was forwarded to the Commission on Appointments and the Department of Foreign Affairs was seen by the Tribune on Friday..... MORE

Citing ambiguous provisions in the Family Code, Senate President Pro Tempore Jinggoy Estrada has sought a specific definition for the phrase “psychological incapacity” which he said has been loosely used in declaring nullity of marriage.

Estrada filed Senate Bill 781, amending Article 36 of the Family Code. It aims to define certain indications of psychological incapacity as a ground for declaration of nullity of marriage or civil annulment such as violent behavior, drug addiction and infidelity.

Abandonment, protracted and constant refusal to cohabit or to have sexual intercourse with the other spouse should also be a ground for annulment.

Laziness, extreme low intelligence or immaturity are also defined as a case for psychological incapacity..... MORE

Acting Ombudsman Orlando Casimiro, in an 18-page order, recommended that a Supplemental Petition for Forfeiture be filed before the Sandiganbayan against Ligot, his wife Erlinda Yambao-Ligot, daughter Riza, and sons Paulo and Miguel, along with Edgardo Yambao and Gilda Alfonso-Velasquez.

The case stemmed from the complaint filed by the Office of the Ombudsman’s Field Investigation Office (OMB-FIO) which revealed that the retired general has acquired other assets/properties in the form of bank deposits and investment accounts, which were not included in the previous case filed against him and his family before the anti-graft court..... Sen. Manny Villar chided the Insurance Commission (IC) for its failure to embark on a public information campaign about the mandatory insurance coverage for overseas Filipino workers, many of whom do not understand the benefits accruing from it.

Villar, who has his own Sagip-OFW program to help distressed workers, noted that big business is being made out of the mandatory insurance coverage for OFWs yet a majority of those leaving the country are unaware of the benefits inherent in their insurance policy.

“The Insurance Commission appears to be sleeping on the job when it comes to informing the OFW sector about the mandatory insurance for overseas workers. Parents who allow children to beg, engage in prostitution will be punished, says solon

Parents or guardians who allow their children to be used in solicitation or prostitution will soon be charged criminally.

Under House Bill 4555 authored principally by Manila Rep. Carlo Lopez, the penalty of one month to six months imprisonment shall be imposed on the parents, adopter, guardians or persons exercising special or substitute parental authority over children under parental custody found to be begging or engaging in prostitution.

The bill, to be known as the “Parental Sanction Law for Child Begging and Prostitution,” provides the penalty of six months to six years jail term to the parents, adopters or guardians who coerce, intimidate, or force their children to beg or engage in prostitution.

The bill provides further that the penalty shall be one degree higher if the victim is under 12 years of age..... MORE

Speed demons, drunk drivers and motorists using a mobile phone while driving are due for a crackdown.

In an advisory, the Department of Justice (DoJ) warned motorists against reckless driving following the recent spate of vehicular accidents that killed known personalities.

Justice Secretary Leila de Lima yesterday reminded motorists that reckless driving, including over-speeding, drunk driving and distracted driving such as driving while talking on mobile phone, are punishable acts under Republic Act 4136, otherwise known as the Land Transportation and Traffic Code.

“There are many road accidents and we have so-called killer highways so we find it necessary to remind the public that reckless driving is a violation that has corresponding penalty under the law,” said De Lima in issuing her third DoJ advisory..... MORE

PBR: An ‘anti-people’ power scheme

Our latest episode on the Electric Power Industry Reform Act (Epira) on my Destiny Cable Global News Network show entitled, “The curse of Epira,” had as guests, power consumer advocate Butch Junia and Freedom from Debt Coalition (FDC) former vice chairman Wilson Fortaleza, who jointly declared the “jury in,” finding the 10-year-old power law a supreme failure for being grossly inimical to the people and the nation’s economic welfare. Fortaleza put it thus: Epira gave “First World power rates for our Third World country.”

Instead of lowering electricity prices, Epira catapulted them to become Asia’s highest; it failed to add additional power production capacity to obviate shortage fears; and it “sold off” 70 percent of government’s generation assets to private companies without reducing the $18-billion National Power Corp. (Napocor) debt that privatization was supposed to pay off.

These Napocor debts, now under the ambit of the Power Sector Assets and Liabilities Management (Psalm) Corp., still stand at $18 billion today. Psalm’s recent claim that it will pay off $1.5 billion, which doesn’t meaningfully reduce the debt at all, only proves that Epira is one monumental scam!

Notwithstanding this Epira curse, the Lower House is now even into amending said law to extend some of its unjust provisions. As we wrote recently, the “lifeline” rate subsidy that would have expired this June — a subsidy supposedly to help poor power users using less than 100 kWh per month but taken from paying power customers — has been intended by the chairman of the House energy committee, Rep. Dina Abad, and seconded by Ben Evardone and Rufus Rodriguez, to be extended for another 10 years.

Meanwhile, the Senate energy committee wants to reclassify the lifeline rate beneficiaries to even lower the 99 kWh-threshold as its chairman, Lopez-related Sen. Serge Osmeña, said if the set-up is unchanged, “We’ll be driving out investors… It doesn’t make sense that half of all residential customers are being subsidized.”

On one hand, congressmen want to milk the paying consumers to pay for their charity while senators want to lower the cut-off to charge more of the poor for the benefit of “investors.” They’re all obviously missing the point.

Why subsidize the poor from paying customers’ pockets? Why not from the profits of Manila Electric Co. (Meralco) and private power generators that have been raking it in all this time?

Early this week, newspapers reported Meralco CEO Manuel Pangilinan’s media briefing where he reported his company’s first-half results for earnings: “In terms of the financial position of the company, it is definitely ahead of last year. So, we also expect the full-year performance for this year to be ahead of 2010.”

Get this: Meralco earned a whopping P12 billion in 2010 only on a 3-percent volume growth over 2009’s P6.5 billion and 2008’s P2.8 billion, almost all on the basis of the Energy Regulatory Commission (ERC)-approved rate increases under the PBR (Performance Based Rate) scheme of 15.8 percent and its four-year PROSPECTIVE capital expenditure base, which are over the old RoRB (Return-on-Rate-Base) of 12 percent on ACTUAL capital expenditure.

As a result, Meralco has (since 2008) increased yearly profits by an average of 100 percent even as the market has not grown over 3 percent per year. The country’s electricity consumers are at a threshold if the PBR isn’t scrapped. The next 10 years will be an era of unprecedented PBR electricity price gouging on top of the past decade of predatory pricing form Epira.

The windfall, nay windstorm, profit of Meralco has taken out so much cash from the people’s pockets.
Awash with cash from the exploitation and abuse of the present Meralco franchise area, Pangilinan is all set to expand his company’s ground, saying, “We are looking at those adjacent to the existing franchise area of Meralco,” taking in Batangas, Quezon, Pampanga and Tarlac to sow as much price terror as what’s being done in Metro Manila and adjacent cities.

All these are on top of the two other electrifying developments I have written about recently. First is the Renewable Energy Act that will start enforcing “renewable energy” FITs (fit-in tariffs) to attract “investors” into the renewable energy field, including wind, tidal, solar and mini-hydro (BUT excluding geothermal), wherein such FITs are priced at P19 per kWh or three times higher than the regular generation cost we have today. This is, of course, courtesy of local and international media as well as environmental NGOs that badgered and lobbied Congress, which we will end up paying for.

Then there’s the off-grid SPUG (Small Power Utilities Group) of Napocor that is seeking to add P0.25 per kWh to our bills for its members’ missionary power service losses on top of the regular P0.045 per kWh. These additional charges are dizzying and should send us into a fit of rage now lest they smuggle all these through.

But among all these power issues, the foremost danger to Filipinos today is undoubtedly the PBR, which Junia derisively calls the “Pahirap sa Bayan Rate.” This needs to be appealed to the Supreme Court soon as it is simply an ERC-approved measure that violates the spirit of several earlier high court rulings.

One obstacle is the huge filing fee that would run into millions if consumers were to bring this to the courts, a judicial anomaly that has hounded public interest advocates ever since the Hilario Davide era. We are glad, however, that lawyer Homobono Adaza has agreed to take up the issue and find ways to challenge the powers-that-be despite the obstacles. We will soon be issuing a call for support from the public to help Bono win this crusade for all of us.

Divorce will come, perhaps not within this congressional term, but it will have to come, even if a lawmaker, Rep. Rudy Fariñas, said a divorce law is impossible in this country because a constitutional amendment is needed to make divorce legal.

His reason? The Constitution says marriage is inviolate. He adds that if a divorce measure is passed, he will challenge this law before the high court.

Quite frankly, if he does so, he may lose the case, because admit it or not, despite that constitutional proviso of marriage being inviolate, there exists in this country a de facto divorce, both in the Catholic Church and in the State, through the expediency of annulment.

It stands to reason that if marriage is inviolate, then there can be no annulment, since the effects of annulment on the children would be the same, with the marriage and the family broken up..... MORE

MAE SOT — The last thing Tee Pa Doh remembers before losing his foot is a bright flash. With his leg mangled and bleeding, he knew his best hope was a long journey through the jungle to the Thai border.

Today he counts himself lucky to be alive. But in the conflict zone of eastern Myanmar that he calls home, littered with landmines and with danger lurking at every step, his story is nothing out of the ordinary.

“My foot was blown off but I didn’t fall. I stood there, holding my injured leg,” said the 52-year-old village headman from Karen State, the scene of one of the world’s longest-running civil wars.

Three polls out Monday, the last that can be legally published in Peru before the vote, showed no clear winner in the debate.

It is good that Bureau of Corrections (BuCor) Director Ernesto Diokno decided to relinquish his post before the critics poured all those misguided and unfair criticisms against him and the administration. Valuing his honor more than anything his highly coveted post could possibly offer (and there are lots if we are to believe the scuttlebutt) he decided to just say goodbye even as he was reportedly on the way to breaking up the syndicates which have made the New Bilibid Prisons (NBP) and its satellite units their “base of operations” and institute much needed reforms system wide.

Actually, some BuCor old timers believe Diokno’s being brutally frank and, yes, being loyal to a fault, did him in. He could have very well escaped public wrath had he scalped his subordinates first which under the rules was well within bounds. He could have pointed his fingers at people. After all, as everybody knows, being BuCor chief he really had no direct day-to-day supervision over prison camps within system such as the NBP and the other units, i.e., the Iwahig, Davao, Leyte and Zamboanga colonies all of which are supervised by individual superintendents. Instead, he took his lumps, went on leave to avoid suspicion of influencing the Department of Justice (DoJ) investigation into the Leviste caper, and then, to prove he was not clinging to the job, tendered his resignation to spare President Aquino of unnecessary criticisms. With that, delicadeza in public service gained currency yet again. The resigned BuCor chief would rather suffer unjustified vilification than take advantage of his closeness and friendship with the President in order to cling on to power..... MORE

Buying the Precinct Count Optical Scan (PCOS) units used in the country’s first-ever nationwide automated balloting last year would be a much cheaper option than scouting for and acquiring new technology and machines for the 2013 elections, Commission on Elections (Comelec) chairman Sixto Brillantes has told the Senate last Tuesday.

Brillantes told the Senate committee on local government hearing that the government “can definitely save much” if it exercises the option to purchase the PCOS machines it had leased from Smartmatic-Total Information Management Corp. (Smartmatic-TIM), the technology and equipment provider tapped by the poll body to automate the May 2010 national and local elections.

Speaking to newsmen, DoJ Undersecretary Francisco Baraan said privatization would not necessarily address the problems of congestion, special treatment of high-profile prisoners, drug trafficking and gambling.

Looks like the Balay Group of Mar Roxas is slowly getting Noynoy to get rid of the Cory original yellows, while getting Noy to replace them with partymates and allies identified with the Balay Group — as part of the ongoing distribution of spoils and political accommodations.

The latest original Cory Yellow tendered his resignation as the Transport and Communications Chief Ping de Jesus, who is said to have resigned for “personal reasons.”

The first original yellow to go was Alberto Romulo, followed by Bureau of Corrections chief Ernesto Diokno, who was caught up in a jail scandal over the unauthorized furlough of former Batangas Gov. Tony Leviste. Noynoy, in accepting Diokno’s resignation, hinted broadly at giving him another post in government.

Certain officials of the Bureau of Customs (BoC) X-ray inspection office are desperately trying to peddle the yarn that the expensive motorcycles (including the $80,000- beauty of a Harley Davidson supposedly belonging to Hollywood scriptwriter Skip Woods that was reported stolen in the USA some four years ago) and luxury cars seized by the National Bureau of Investigation during a raid last month on the property of a suspected big-time car smuggler in Cagayan de Oro City were actually “chop-chop” and brought into the country inside balikbayan boxes.

By chop-chop, this means the vehicles were disassembled or cut up into pieces, figuratively speaking, at their point of origin and then smuggled into the Philippines.

And the significance of the chop-chop motorcycles being sent over in balikbayan boxes? Unlike other ordinary cargoes which must pass through the scrutiny of the BoC’s X-ray machines, they don’t. These things, usually containing used clothes and ordinary household items sent by OFWs to their families back home, are classified as non-toxic, coursed through the Informal Entry Division and immediately released to the claimants without too much fuss and bother..... First, I am certain that no one from among the members of my class, PMA 1968, are actively involved in business, much less in any type of illegal mining activities in the said area. They are all happily retired with the exception of a few who continue to serve in government. Should there be anyone among my mistahs who is involved in any illegal activity, I would not hesitate to have them arrested or brought before the bar of justice to answer for their illegal acts..... Five officials of the New Bilibid Prisons (NBP) in Muntinlupa City have been recommended for preventive suspension by the Department of Justice (DoJ) fact-finding committee in connection with the escape of former Batangas Gov. Antonio Leviste.

In a 36-page report Justice Secretary Leila de Lima ordered investigations for administrative actions on former Chief Supt. Armando Miranda, Chief Supt. Ramon Reyes, former chief of the Minimum Security Compound Dante Cruz, current Minimum Security Compound chief Roberto Rabo and prison guard Fortunato Justo.

The Manila International Airport Authority (MIAA) is experiencing a “brain drain” phenomenon after a number of ramp controllers (RCs) resigned for high paying jobs abroad.

Airport general manager Jose Angel Honrado said eight airport ramp controllers resigned last week, leaving the country’s premier airport with only 31 ramp controllers.

A ramp controller is a highly skilled and technical position who is in charge of directing aircraft movement after landing into the parking bays and vice versa. Noynoy used the opportunity of accepting the resignation of the now resigned Bureau of Corrections (BuCor) Director Ernesto Diokno, in a bid to erase the public perception of his penchant for protecting his buddies, Liberal Party mates and allies by retaining them in their posts, no matter the allegations leveled against them.

He stressed this, saying that public interest should always prevail over friendship, in announcing that he had accepted Diokno’s resignation.

From yesterday’s hearings at the Senate on the postponement of the elections in the Autonomous Region in Muslim Mindanao, it was pretty clear that all Noynoy and his officials want is to cancel the ARMM polls, kick out the elected incumbents and replace them with Noynoy’s appointees who may even run for the polls when synchronized, and may keep their OIC seats longer than August 2013.

The Noynoy officials, such as Jesse Robredo, Teresita Deles and Rolando Llamas, to name a few, who were present at the ARMM hearing, were all invoking reforms in the ARMM as their justification for the “postponement” of the polls and the synchronization of elections.

Reforms to them, appears to be the magic word: The Constitution and the ARMM Organic Law can be breached, in the name of reforms. Noynoy can certainly kick out the incumbent elected officials and replace them in the name of reforms and all of these can be done because, as they claimed, Noynoy has “residual powers.”.... MORE

Car bombs and Molotov cocktails have been used by citizens who opt for vigilante justice in the Communist-ruled country, where the justice system has created mounting frustrations that could provoke more violence.

Experts say that despite the introduction of some reforms to address charges the system is unresponsive and lacks transparency, the public perception is that those changes are woefully inadequate, and rule of law is not guaranteed.

I wonder if Foreign Affairs Secretary Albert del Rosario and his deputies have found time to take a second look at the latest statement of US Ambassador to the Philippines Harry Thomas Jr. We gathered that during the turnover of the $434 million grant from the Washington based Millenium Challenge Corp.(MCC), the ever smiling US envoy who has been described by those who have met him as a simple, “guy-next-door” type was quoted as having reminded P-Noy to use the grant “transparently.” Whether he meant that as simply a gentle reminder or he knows more than what we folks already know about the ways of people in this administration or even of the previous ones remains unexplained at this point.

Suffice it to say that, in other times and other climes, such an undiplomatic issuance would have immediately merited a summons from the Foreign Ministry for the person involved not only to “explain and clarify” but to be sternly warned that a similar utterance will merit a harsher counter measure..... The Aquino-Cojuangcos always benefit, that is for sure, and despite Noynoy Aquino’s constant attacks against Gloria Arroyo and her administration, they certainly benefited a lot from her administration, as not only was the hacienda raw land sold to government for right of way road grossly overpriced — which sum was not even divvied up between management and the hacienda farmers, since the whole sum went to the Cojuangco-Aquino hacienda management — but also from that private interchange, paid for by the government, which means the people’s money..... With Catholic Malta voting in favor of legalizing divorce, only one single country is left that bans divorce: The Philippines.

But it looks like the House of Representatives will soon tackle the divorce bill filed by two legislators: Gabriela party-list Rep. Luzviminda Ilagan and Rep. Rufus Rodriquez.

This comes amid the still heated debates in the House on the Reproductive Health (RH) bill. Both bills — the RH bill and the divorce bill — will definitely be fought against by the Catholic bishops.

For the outsider, the Philippines is sometimes confusing.
For example, a few weeks ago Manny Pacquiao was paid a reported $20 million for chasing another man around a boxing ring for 36 minutes. No, no, that’s not what I have trouble comprehending (although, now I think about it…). The thing that really has me beat is what happened later.

On May 14, Pacquiao attended a “thanksgiving Mass” at Quiapo church. Here, Monsignor Clemente Ignacio told him to prepare for the forthcoming scrap in the House of Representatives over the Reproductive Health bill, which he would be expected to oppose. Congressman Pacquiao duly vowed compliance, saying the bill was “against God’s laws.”

For me, confusion reigns on several counts here. Firstly, I was under the impression that the Catholic Church’s opposition to contraception was, rather than “God’s law,” the result of a papal encyclical called Humanae Vitae issued as recently as 1968. It turns out, in fact, that many of the claims made for God have really been the responsibility of the Vatican. The doctrine of papal infallibility, for example, saw the light of day as recently as 1870, in Vatican I. It was the Council of Trent (1545-1563) that decided that the Bible and church tradition (e.g. dogmas concerning the virginity of Mary) were equally authoritative. But I digress….... MORE

Human sexuality is sacred, noble and sublime. In this regard, the three fundamental truths they know and hold on are the following: One, God created the human person to His own Image. Two: God created the human person as a man or a woman. Three: God created man and woman with the option to become husband and wife for the generation and upbringing of children as their blessings and treasure.

In fact, a great number of parents and teachers who are neither Christians nor Catholics relate with their children with care and concern in the matter of sex. They too tell the famous fable of “The flower and the Bee” to impart the purity and beauty of human sexuality. Only the malicious, the depraved and the amoral fool around with sex among themselves, with others, their own children included. This is repugnant and unconscionable as it is not even civilized..... The famous line that identifies with abuse of power oozed out from a letter sent to President Aquino by Globe Telecom-munications (Globe Telecoms) of the Ayala group requesting that it be granted highly prized third generation or 3G/Universal Mobile Telecommunications System (UMTS) frequencies that are used extensively among business process outsourcing (BPO) offices and for highly popular smart phones.

To stress the weight of Globe Telecoms’ request, the letter was signed by no less than Jaime Augusto Zobel de Ayala, top man of the Ayala conglomerate and a major business ally of the Aquino clan with Globe Telecoms president Ernest Cu signing below him.

A ranking member of the House of Representatives yesterday refuted claims of President Aquino’s uncle, Jose “Peping” Cojuangco, Jr. who said that the P20 toll fee being collected by the Hacienda Luisita Inc. (HLI) on motorists passing through the Luisita Parkway Road linking the sugar estate to the Subic-Clark-Tarlac Expressway (SCTEx) is legal and being beyond the authority of the Toll Regulatory Board (TRB) as the road stands on private land.

Quoting TRB Executive Director Manuel Imperial, Deputy Speaker, Cavite Rep. Jesus Crispin “Boying” Remulla said the toll fee being collected by HLI is highly illegal if the firm owned and operated by the President’s family does not have a permit coming from the TRB.

“I had a meeting with TRB Executive Director Imperial and he categorically said that all toll fees collected on road use, be it private or public, should have a permit coming from them,” Remulla said. “All toll fee collection is regulated by the TRB.”.... MORE

Bayan Muna Rep. Teddy Casiño yesterday reiterated his objection to the additional P2 billion to be realigned to the Department of Social Welfare and Development’s (DSWD) conditional cash transfer (CCT) program, calling it a “waste of money that could otherwise be used to create more jobs and livelihood for the poor.”

In yesterday’s soft opening of an exhibit on social enterprises at the House, Casiño, who is both chairmen of the committee on small business and entrepreneurship development, said government was putting way too much money on “short term, populist gimmicks” like CCT rather than implementing long-term anti-poverty strategies.

“Government needs to refocus its anti-poverty strategy from short-term CCT to long-term job creation and livelihood development. It is a wonder, for example, why government has done so little to support social enterprises like the ones exhibited here when their impact on poverty is much much more fundamental than dole-outs like the CCT program,” Casiño said in his opening remarks..... Vice President Jejomar Binay yesterday convened the Presidential Task Force Against Illegal Recruitment (PFTAIR) at the Office of the Vice President (OVP) for its first official meeting.

During the meeting, the Vice President said he will be talking to Chief Justice Renato Corona to make sure that cases are filed against the recruiters of offloaded overseas Filipino workers (OFWs).

“The offloaded OFWs are sent back to their respective provinces, but we seldom see cases filed against their recruiters,” Binay said.

“We must always have ready evidence for the prosecution to present in court to ensure that these illegal recruiters are convicted,” he added, Binay also ordered the Philippine Overseas Employment Agency (POEA) to provide a list of expenditures based on the PTFAIR’s original two-year run as basis for the Task Force’s budget plan..... Cagayan Rep. Jack Enrile is pushing for measures to reform the National Food Authority (NFA), saying the agency cannot act both as a trader and a regulator at the same time and that these dual functions should be decoupled.

Enrile said allowing NFA to regulate its own purchases has obviously resulted in lapses in the past, which has resulted in billions of pesos in government funds being lost in alleged overpricing deals entered into by the agency.

He suggested that while NFA be allowed to continue to purchase food items, the regulatory function over these purchases should be immediately passed on to the Department of Agriculture (DA) to ensure that all deals undertaken by the NFA are done above board.

At the same time, the lawmaker called on the DA to require all its regional offices to conduct “honest to goodness, credible assessment” on the food requirement of the people in their respective areas..... MORE

An alleged leader of a notorious robbery syndicate said to be operating in Metro Manila and nearby provinces was killed after he exchanged gunfire with members of the Caloocan City police last Sunday afternoon.

Northern Police District director Chief Supt. Antonio Decano in a statement lauded the leadership of the city police chief Senior Supt. Jude Wilson Santos for the neutralization of the so-called Bansalan Group following the death of its alleged leader, Bandino Bansalan, 35, alias “Bossing,” of Bagong Silang, also in the city.
