Small-scale miners in Pantukan ask, why blame us?

Small-scale miners grapple with the impact of landslides and the government’s demolition order.
By JOHN RIZLE SALIGUMBA
Davao Today
PANTUKAN, Compostela Valley, Philippines — Armed with a “no habitation policy” order, local authorities demolished mining shanties here, six days after landslides struck and killed at least 36 people on January 5. It came as a new calamity to the small-scale miners and abanteros, who depend on the crude gold mining as their sole source of living.

“We are always blamed,” complained Jun, an 18-year old abantero at 700 (referring to 700 Tunnel Diat). Small-scale miners protested why they are being portrayed as willing victims of the tragedy. Government officials reportedly said that because small-scale miners refuse to heed a government order to vacate the gold-and-copper-rush site, they chose to be at risk.

“Aside from the unusually heavy rains, small-scale mining is one of the major triggers of landslides in the Philippines,” said Mines and Geosciences Bureau (MGB) Acting-Director Leo Jasareno.

The landslide crashed down on nine houses and several ball mills along the road, totally damaging them before slowly creeping down toward the 700 Tunnel Diat where it hit the guard house and several bunkhouses owned by long time medium-scale mining firm HEXAT Mining Corporation. The landslide hit 15 gold processing plants and the adjacent portion of Diat Dos (Purok 1 and 2) where houses and more than three retail stores were located.

Ely Sanchez, chairman of the Diat Small-Scale Mining Association (DSSMA), told Davao Today he and Purok Chairman Paciano Banuelos hold a list of residents of Puroks 1 and 2 in Diat Dos. “We have 18 on our list. But the actual casualties may be above 100,” he said.

Because of the tragedy, all mining activities were stopped, putting the livelihood of more than 800 people in both Diat Uno and Diat Dos in uncertainty. On January 11, during the demolition, some residents begged the demolition team to start with empty houses. About 180 to 200 houses were affected by the demolition according to the Municipal Risk Reduction Management Council. Aside from sitios Diat Uno and Diat Dos, the MGB identified other areas in Barangay Napnapan which were high-risk or landslide-prone. These were Sitios (sub-villages) Binaaba and Saro; Puroks Lit-ag, Boringot, Lantawan, Saro, Pulang Lupa, Puring Sayaw, Sapa, Tipga, Niliputan; and Barangay Proper’s Puroks 7, Caimito, 2 and 5.

A hard day’s work in the mines

The landslide — or “bardown” in mining jargon — was believed to have originated from a “leaking” or fissure (a continuous, deep and huge crack in the ground) in the mountaintop of Diat Uno.
A bardown goes with the territory, said the miners interviewed by Davao Today.

An abantero, like any other worker under dangerous conditions, risks life and limb because of the lack of tillable farmlands. A “worker of fortune,” a abantero is always on alert for news of tunnels that are “hit” or those that have high chances of gold ore deposits..... MORE

For three days now I’ve been mostly glued to my TV, it’s possibly an entire nation just as riveted out there. The hearings are not only televised, but covered live on radio and played on buses and jeepneys, on FM/AM bands of cell phones, and streamed live on the Internet.

I’ve been getting texts and texts galore, praising the Senate President’s handling of the Corona impeachment trials, and save for a few critical ones, I’ve got to say, in showbiz parlance, bongga ang kapatid ko.

Juan Ponce-Enrile’s been doing so well, mentally and physically, talagang pinaghandaan niya ito, I must say. Concerned about my health, he paid me a visit shortly after Christmas and gave me solid advice on how to keep fit, what vitamins to take, what natural remedies to avail of, like malunggay juice and extra virgin coconut oil. “Don’t keep on sleeping,” he added. “Too much sleep can shrink our brain. Sleep only the hours you need. Keep regular hours, too. Huwag pa-iba-iba ang oras ng tulog.”.... MORE

By Angie M. Rosales and Benjamin B. Pulta 01/20/2012

Prosecutors may be showing “evidence” but they have not established or proved anything.

The defense in the impeachment trial of the head magistrate reiterated its apprehension that the allegations against Chief Justice Renato Corona in connection with the alleged non-filing of his statement of assets, liabilities and networth (SALn) is being expanded to insinuate other charges without any basis.

At one point during the proceedings, Senator-judge Francis “Chiz” Escudero asked the House prosecution panel whether the charge in the impeachment should be limited to the question of whether or not Corona filed his SALn..... MORE

Lagman yields post to Suarez, takes dig at GMA

By Charlie V. Manalo 01/20/2012

After weeks of a tug-o-war over the House minority leadership, Albay Rep. Edcel Lagman finally conceded in favor of Quezon Rep. Danilo Suarez. But not without taking a final dig at his “former” colleague.

In a statement, Lagman said he is tendering his resignation to pave the way for Suarez’s ascension as House Minority Leader even as he claims the Quezon lawmaker still does not have the support of the absolute majority of minority members.

Lagman further described Suarez as former President Gloria Arroyo’s anointed one, adding that his relation with some minority members “who are closely allied with and beholden to Arroyo has become grossly untenable.”.... MORE

Farmers demand Aquino: Free land distribution of Hacienda Luisita now

By Charlie V. Manalo 01/20/2012

Anakpawis Rep. Rafael Mariano yesterday said farmers will commemorate the 25th anniversary of the gruesome Mendiola Massacre in a protest action near Malacaang today, Friday, to remind President Aquino that his familys refusal to distribute Hacienda Luisita led to the bloody massacre of 13 farmers on Jan. 22, 1987.

Mariano will join today a protest of farmers to demand the immediate and free distribution of Hacienda Luisita and the passage of House Bill 374 or the Genuine Agrarian Reform Bill (GARB) that will overturn all pro-landlord legislations that benefited the Cojuangco-Aquinos and other landlord families in vast landholdings in the country.

Throughout and even beyond his term, President Aquino will be haunted by his familys accountability in the Mendiola and Hacienda Luista massacres and the moral need to distribute Hacienda Luisita lands..... MORE

CPP scores planned increase in US military presence in Asia-Pacific Region

By Mario J. Mallari 01/20/2012

The Communist Party of the Philippines (CPP) yesterday scored the planned increase in United States military presence in the Asia Pacific region, particularly within Philippine territories, as meant to maintain permanent stationing of US troops and “interventionist” plans in the region.

In a statement, the CPP denounced the announcement made by Malacacañg on Tuesday, after President Aquino’s meeting with US Senators John McCain, Joseph Lieberman, Sheldon Whitehouse and Kelly Ayotte, about the conduct of more military exercised between the Armed Forces of the Philippines (AFP) and US troops.

“The US imperialists are having a heydey in their interventionism in the Philippines under the pliant puppet Aquino regime. Under Aquino, the US government has been conducting more and more ‘military exercises’ in the Philippines, specifically along the coast of Palawan that faces the South China Sea,” the CPP said..... Responding to the four rounds of oil price hikes this year, labor center Kilusang Mayo Uno yesterday called for a nationwide protest action against oil overpricing in the coming weeks.

One of the reasons the prosecutors seem unprepared to prove their charges against the Chief Justice as spelled out in the eight Articles of Impeachment is that the members of the House — at least those congressmen, 188 of them, were, apart from being bribed with the early release of their pork barrel and additional pork, reportedly were told not to worry about signing the complaint, even without reading the Articles of Impeachment because the congressmen were told that with all the humiliation that will be faced prior to the Senate trial, the CJ, like the resigned Ombudsman Merceditas Gutierrez, will be forced to resign and that there would be no trial.

Unfortunately for both Noynoy and the House prosecutors, the CJ decided to face the music and has already said that he has reached the point of no return and is willing to undergo trial.

But because the CJ has opted not to resign, the prosecutors are now unprepared to prove their case..... MORE

New York City’s war on freedom could be adding a new weapon to its arsenal, especially if NYPD Commissioner Ray Kelly has his say.

The head of the New York Police Department is working with the Pentagon to secure body scanners to be used throughout the Big Apple.

If Kelly gets his wish, the city will be receiving a whole slew of Terahertz Imagining Detection scanners, a high-tech radiation detector that measures the energy that is emitted from a persons’ body. As CBS News reports, “It measures the energy radiating from a body up to 16 feet away, and can detect anything blocking it, like a gun.”.... MORE

\"It’s more fun in the Philippines!” It was supposed to become a big bang. It was meant to be a slam. But sad to say, it immediately caused bad jokes, laughter and ridicule even.

The word “fun” was instantly converted into pun. What was envisioned to stand for joy and delight underwent fast conversion into gloom and tedium. This is not to mention the fact that the supposedly new local tourism sales pitch is nothing more than a poor copy of something the like said of another country in another time. What a pity! And it is precisely intended to sell the Philippines to foreigners over the world. The more cogent questions thus rose so far:

Is it really fun to see a country where fatal criminality regularly happens not only in the streets but also in homes? How could fun be identified with frequent murders and regular robberies, with summary executions accompanied with gross mutilations?.... MORE

What a difference a good and independent impeachment presiding judge and an equally good majority leader makes.

Presiding judge Senate President Juan Ponce Enrile is fast proving to the nation that indeed, an impeachment court can be as solemn, orderly and dignified as a Supreme Court hearing, with him as a judge in control of the trial.

The difference is clearly seen when compared to the then presiding justice of the impeachment trial of then sitting President Erap Estrada, then Chief Justice Hilario Davide, who allowed the House prosecutors full control of the trial, to the point of not even continuing with the trial after the private prosecutors walked out of the impeachment court, when he, as then presiding justice, could have easily commanded the House prosecutors to continue with the trial under pain of contempt and even disbarment. But it was also just as clear he wouldn’t have done it, since he was not an impartial justice, and worse, was clearly involved in the elite coup d’etat against the Estrada government..... MORE

Syria and Iran are the current focus points. As per the western media, thousands have perished in Syria, killed by Bashir Assad. All of the dead being civilians and rebels. But some reliable sources state that the rebels are not true rebels, but are planted and supported by subversive establishments of the West that have vested interests in this area. Fisherfolk group calls for ratification of int’l labor pact

MANILA — The Philippine government should do its best to protect the rights of the country’s 300,000 fishing industry workers.

This was the statement made by the Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya) last week to President Benigno Aquino III as Pamalakaya chairman Fernando attended an international conference titled Empowerment Through Information: Training Program on International and Regional Developments of Relevance to Small-Scale Fisheries and Fishing Communities in Asia” Bangkok, Thailand from January 9-14, 2012.

Hicap said the Philippine government has yet to sign the Work in Fishing convention of the International Labor Organization, which aims to protect the rights of fishing industry workers all the world.

The training program was sponsored by the International Collective in Support of Fishworkers (ICSF) based in Chennai, India. Hicap was invited to speak on issues dealing with protection of small-scale fisherfolk and on the conditions of Filipino fish workers aboard commercial fishing vessels in the country. The conference aimed to be avenue for knowledge-exchange between fisherfolk organizations, the fishery NGOs and social movements and how they can utilize existing international instruments to effectively fight threats to fishing rights and livelihood and assert fishery rights as human rights.

According to Hicap, the ILO’s Work in Fishing Convention can be used by organizations espousing rights of fisherfolk and fishing industry workers to oppose oppressive measures carried out by operators and owners of commercial fishing vessels.

The convention was adopted by government, worker and employer delegatesduring the ILO International Labour Conference in 2007. It came into effect after it was ratified by 10 (including eight coastal nations) of the ILO’s 180 member States..... MORE

GMA faces new plunder rap over PCSO funds misuse

By Angie M. Rosales 01/18/2012

The Senate blue ribbon committee sought yesterday the filing of plunder charges against former President Gloria Arroyo and former Phi-lippine Charity Sweepstakes Office (PCSO) general manager Rosario Uriarte over the misuse of PCSO funds.

The detained former president and Uriarte were found by the Senate body to have committed plunder, technical malversation of funds among many other charges in handling the agency’s confidential and intelligence funds (CIFs) in hundreds of millions of pesos during her incumbency.

Contained in a 124-page blue ribbon committee report submitted by its chairman, Sen. Teofisto Guingona III, two other officials were also recommended to be charged with graft..... MORE

All Filipino workers who will be evacuated from conflict-stricken countries will now be interviewed upon arrival in the country, Vice President Jejomar Binay said after the discovery of many underaged workers being sent abroad.

Binay, also a presidential adviser on overseas Filipino workers concerns and chairman of the Inter-Agency Council Against Trafficking (IACAT), proposed this measure, saying this would help the IACAT build a database of repatriated Filipinos and offloaded international-bound passengers and determine the manner of deployment.

“It would also help establish a possible pattern of deployment being done by illegal recruiters and trafficking syndicates, minimize re-victimization of Filipino irregular OFWs, minimize repatriation costs,” Binay said..... MORE

Noynoy really should stop trying to influence the senators, as well as his devotees to convict Chief Justice Renato Corona, because what he is doing goes against the constitutional grain of the executive branch’s non-interference in a case which is the business of the legislative branch.

If in an ordinary court case — whether with political undertones or otherwise — a president is always cautioned not to comment on this, pro or anti, mainly due to the fact that any presidential comment can be taken to influence the court, all the more that in an impeachment case, especially when Noynoy has not hidden his hatred for the CJ even before he ascended to the presidency.

Obama sued over indefinite detention and torture of Americans act

In the past, journalist Chris Hedges has worked for NPR, The New York Times and the Christian Science Monitor. In his latest endeavor, however, he is teaming up with an unlikely pair: a couple of attorneys that will help him take on the president.

US President Barack Obama is the target of a suit filed by Pulitzer Prize-winner Hedges, and the reasoning seems more than obvious to him. The decision to take the commander-in-chief to court comes as a response to President Obama’s December 31 signing of the National Defense Authorization Act, or NDAA, a legislation that allows the US military to detain American citizens indefinitely at off-site torture prisons like Guantanamo Bay..... Reading many Filipino commentaries on economic matters, one gets the impression that their authors consider the various elements of the status quo to be unalterable features of the economic environment, just as typhoons and thunder are features of the natural environment, or, alternatively, that they must have been decreed by a source as authoritative as that which handed Moses the stone tablets on Mount Sinai. And this, as we will see, is not far from the truth.

If there is one clear distinction between the prevailing economic creed and the Decalogue, it is that the latter was written by and for Israelites. The god Yahweh was a national god, initially one of several. The Decalogue was, therefore, addressed to Israelites (initially known as Hebrews) — although not all of them. Consider the following.

“But the seventh day is the sabbath of the Lord thy God: In it thou shalt not do any work, thou, nor thy son, nor thy daughter, thy manservant, nor thy maidservant, nor thy cattle, nor any stranger that is within thy gates.”.... MORE

A supposed World Bank memorandum criticizing the misuse of a $21 million loan for the Judicial Reform Support Project (JRSP) released way back in 2003 but singling out Chief Justice Renato Corona is proving to be another hoax that was fabricated as part of an elaborate Palace-led campaign to oust the Supreme Court head as an officer of the World Bank denied sending an e-mail containing the memo sent to newspapers yesterday before the opening of the impeachment trial at the Senate court.

Prior to the distribution of the e-mail the House prosecutors revealed the existence of the memorandum on Sunday while Sen. Franklin Drilon in a separate press statement said he had filed a resolution since Jan. 9 for a Senate investigation into the memorandum.

Local newspapers received e-mails containing the supposed memorandum stating that the World Bank found “unsatisfactory” the progress of the JRSP and stating that since mid-2010 when Corona was appointed to his post, the progress of the project was supposedly rated “unsatisfactory.”.... MORE

Squabbling while the nation sinks

DIE HARD III
Herman Tiu Laurel
01/16/2012
A Nov. 10 to 23, 2011 survey by Pulse Asia reported last week by Jocelyn Montemayor found that 97 percent of Filipinos say “their lives were affected by worsening economic conditions.” The same survey reported that the number of people who “felt,” which I take to mean palpably sensed, the economic deterioration jumped from 16 percent in Oct. 2010 to 38 percent a year later, in what can be described as a dramatic doubling.

This makes me wonder how the same survey outfit can still find that BS Aquino III’s approval ratings are staying at a high 70-percent rate. This also makes me wonder if the people surveyed are disjointed in their brains of if the controlled mass media have really done a terrific job of obfuscating issues so as to stunt the public’s capacity for perception.

What is clear is that Filipinos are facing a deepening crisis and, contrary to many columnists’ sanguine projections, 2012 holds even grimmer prospects.

Last Wednesday, Jan. 11, InterAksyon.com reported that the Department of Energy (DoE) is “gear(ing) up for fuel rationing, transport subsidies” in case “tensions in the Middle East trigger a fuel shortage.” As we have been tracking the events there, we have consistently asked what the leadership of this country is doing in case a war affecting the Strait of Hormuz and, consequently, global oil supply triggers a worldwide shortage and price spike from $150 to $200/bbl.

The current Philippine oil stockpile ranges only from 30 to 60 days, and more frequently it is at the minimum. These are indeed ridiculous levels, considering that it takes about that long for shipments to arrive from the sources.

Curiously, an August 2011 newspaper report discussed the call (such as from our many columns) for government to stockpile oil requirements for as much as six months to one year. But, in that same report, a certain Jorge Montepeque, global director for pricing at Platts (a US oil trading company), was also interviewed. He said that such a proposal would only do harm as stockpiling would cause oil prices to rise.

Of course, that pronouncement from the said executive, no matter how inane it was, must have been taken as a diktat to government and political authorities to shut up on the matter as the economic managers who earlier raised the idea never did so again.

That advice was inane for the simple reason that the Philippines’ whole year demand won’t even cause a blip in the oil markets, where prices are manipulated by speculators on a daily basis — prices which we, in turn, are compelled to always accept at their highest levels since we buy only what can be delivered because of the short lead time, and never at a cheaper price than the last offer. So, in order to get us out of this quagmire, the next logical question is where to get the money for a stockpile that will last us a good six months to one year.

Ah, but only a few like us would say that money is the least of our problems since we already have that P1.7-trillion Special Deposit Account (SDA) kept in the Bangko Sentral ng Pilipinas (BSP) that yields four percent in interest earnings for banks when it can be used to earn multiples of that in our stockpiling of oil.

Then, we also have the surplus in our gross international reserves (GIR), which, in our discussion on how to properly release without appreciating the peso and harming the exchange rate that overseas Filipino workers (OFW) families rely on, finance forensics expert Hiro Vaswani of the Kilusan para sa Makabansang Ekonomiya (KME) suggested for the BSP to stop lending $25 billion to the US in buying its Treasury Bills, and instead to use that for our domestic needs — one of which is the country’s stockpiling of oil.

As our annual oil imports amount to around $14 billion, we have more than enough money to afford such a stockpile. Yet, while any sane person would never doubt the economic security and benefit we would get out of it, our economic managers remain inutile, all because they are useless slaves of Western financial interests.

Oil prices jumped to $101/bbl when Iran warned off a US aircraft carrier during a naval exercise of the Iranian Navy two weeks ago. For sure, we can expect more of such tensions in the Strait of Hormuz — through which 80 percent of oil for our country passes and a major part of which is legally considered under Iran’s jurisdiction.

The Iranian parliament is now considering legislation either to limit passage through that strait or to charge fees for it and to ban warships from passing, which are a response to US saber-rattling.

But even without these tensions, the global trend of oil prices is on the upswing due to the higher cost of extraction. As such, oil stockpiling is always a safe bet even on a purely commercial basis. Still, we need to underscore the economic stability that can be derived from having a large oil stockpile, especially since an oil shock that will lead to a complete economic standstill for an unprepared nation like the Philippines would be devastating.

Thus, one must realize how irresponsible and brainless this BS Aquino III government is today, creating imagined terror threats and picking fights left and right to create an atmosphere ripe for authoritarianism while real economic terror stalks the land.

The crisis the nation will face in 2012 will require all the people and political sectors to rally around the flag in order to survive. And as the growing internecine fighting is only going to doom the nation, a New Third Force that is neither Aquino nor Arroyo; neither Yellow nor Red; and neither Right nor Left must arise to offer the leadership that the present government cannot give as it winds down its self-destructive path.

No difference between student Aquino, teacher Arroyo – Bayan

No difference between student Aquino, teacher Arroyo – Bayan

By INA ALLECO R. SILVERIO
Bulatlat.com
The student is no different from the teacher.
This was the stand of the BagongAlyansangMakabayan (BAYAN) on the exchange of insults between Malacañang and the camp of former president and now under hospital-arrest Pampanga representative Gloria Macapagal-Arroyo.

Macapagal-Arroyo through her supporters, recently released a supposed study on the current state of the economy. In it, the former executive now charged with electoral fraud and corruption alleged that the Benigno Aquino administration has wrought damage to the economy through unintelligent mismanagement. The title of the paper was “It’s the Economy, Student!” referring to Aquino being Macapagal-Arroyo’s former student in a course on economics at the Ateneo University.

“Neither the President nor anyone else can truly expect to govern the next five years with nothing but a sorry mix of vilification, periodically recycled promises of action followed by lethargy, backed up by few if any results, and presumptuously encouraging gossip about one’s love life in which no one can possibly be interested. Given the electoral mandate that he enjoyed in 2010—the same size as mine in 2004, as predicted by every survey organization at that time—our people deserve more, and better, from him,”Arroyo wrote in her paper.

For Bayan, however, there’s no difference between the current president and his predecessor. Case in point, the group said, was how both administrations have done nothing to stop the incessant problem of excessive oil prices and continuing price hikes. Oil companies recently raised their pump prices by as much as P2.00 (US$0.05)per liter. World gasoline prices have already increased by around P1.75 (US$0.04) per liter while diesel prices rose by around P1.30 per liter in the international market.... MORE

Noynoy gov’t allots P17B for AFP in 17 months

By Mario J. Mallari 01/16/2012

The Aquino administration has allotted about P17 billion during its first 17 months in office for the modernization program of the Armed Forces of the Philippines (AFP), a huge leap compared to the P33.5 billion released to the military organization during the last 15 years.

The Department of National Defense (DND) said that President Aquino made a total of P16,852,000,000 available for the AFP modernization program from July 2010 to December 2011.

As a result, the DND said that the AFP modernization program got a huge leap, noting the P33.596 billion which was released to the military during the 15-year period of the AFP Modernization Program as provided by law.
