Mothers of the disappeared call for people’s manhunt vs Palparan

MANILA – The mothers of the two missing University of the Philippines (UP) students called on the public to participate in the people’s manhunt against retired Gen. Jovito Palparan Jr.

Palparan, then commander of the 7th Infantry Division of the Philippine Army, was implicated in the abduction of Karen Empeño and Sherlyn Cadapan on June 26, 2006 in Hagonoy, Bulacan. On Monday, the Bulacan Regional Trial Court Branch 14 issued a warrant of arrest against Palparan and three other military men. This came days after the Department of Justice (DOJ) issued a resolution finding probable cause in charges of kidnapping filed by the mothers of the victims.

Palparan and one of his men, Master Sergeant Rizal Hilario, remain at large. Two of the accused, Col. Felipe Anotado and Staff Sergeant Edgar Osorio have surrendered to the authorities.

“We call on the Filipino people to help us prosecute Palparan for the crimes he did to our children and to other victims of enforced disappearances,” Mrs. Concepcion Empeño, mother of Karen, said in a press conference this morning.
Mrs. Erlinda Cadapan, mother of Sherlyn, issued the same appeal. “To all our compatriots, to all citizens, we now know who the human rights violators are. We ask your help, if civilian arrest is not possible, please report to the authorities the whereabouts of Palparan,” Mrs. Cadapan said.
Four days after the DOJ resolution, Palparan tried leaving the country for Singapore but was prevented by immigration officials.

Also speaking at the press conference, Mrs. Edita Burgos, mother of another missing activist Jonas Burgos and chairwoman of Desaparecidos, hailed the person who called the attention of immigration officials to prevent Palparan from leaving.

“This is a good example of how we could win, if only we help one another. Let us get involved. Let us help. We have to do what is right…,” Mrs. Burgos, also convener of End Impunity Alliance, said. “If we do nothing, we side with evil. We will sin by omission. We cannot do this alone. We need more help and prayers.”

Mrs. Burgos said if only those who witnessed the abduction of his son on April 28, 2007 interfered, Jonas would not have been disappeared. “Now is your chance to help. If you see this face, or if you have any information about this person, please call 4342837 or text me at 09177476131 and tell us where we can find Palparan,” Mrs. Burgos said.....MORE

In Libya, death and disappearance still stalk the land

People are vanishing in broad daylight in Libya, as the country’s new rulers continue to settle accounts with their opponents. Widespread insecurity means the families of the kidnapped can do no more than hope that their loved ones are still alive.

Libya’s conflict is over, and the man who stood in the way of Western-style democracy is dead. Yet atrocities against Muammar Gaddafi’s loyalists continue. The images emerging from Libya are disturbing.

Against this distressing background, Russia is demanding a probe into civilian casualties in Libya caused by NATO bombings..... MORE

Manning trial a prelude to Assange’s extradition to US?

Manning trial a prelude to Assange’s extradition to US?

Military officials have introduced evidence into the pre-trial hearing against alleged WikiLeaks contributor Bradley Manning with the whistleblower site’s mastermind Julian Assange.

While a tie between the two would allow the prosecution to pursue Private First Class Manning’s alleged suspected involvement in sending Assange top-secret military files, it could finally give the US a reason to extradite the WikiLeaks’s runner to the States.

American authorities have long attempted to tackle Assange for his role in WikiLeaks, a website that the US government insists has aided the enemy by publishing files that would otherwise be left for only a few Army intelligence personnel to see.... MORE

Law enforcement can already beat protesters with batons, spray subversive chemicals into their eyeballs, shoot rubber bullets at a speed of around 100 yards-per-second and blast deafening sound bursts.

Why, then, shouldn’t they be stop a person from breathing?

CIA won’t disclose involvement in OWS crackdowns

With demonstrators suspecting governmental assistance in the crackdowns clobbering Occupy Wall Street encampments, the CIA is trying to distance itself from divulging any incriminating evidence regarding their role in the raids.

The Partnership for Civil Justice (PCJF), a Washington DC-based civil rights group, filed a Freedom of Information Act request last month to see what role, if any, the CIA has had in the brutal raids of OWS encampments that have left thousands jailed and droves of demonstrators beaten, in some instances ending up in intensive care. Now after reviewing the request to publically release any information, the Agency is scoffing at the PCJF, who in turn is calling this “a classic case of CIA-double speak” used to hide its involvement..... Before we lambast P-Noy and other key officials responsible for government’s seeming unpreparedness and lack of coordination bordering on nonchalance before, during and after the worst flooding which visited Mindanao and parts of the Visayas some days back, we would like to call on all people of goodwill to lend a helping hand for the fast and immediate relief of thousands of our countrymen in Cagayan de Oro, Iligan, Dumaguete and other areas devastated by Typhoon “Sendong.” We cannot overemphasize the fact that we need all hands on deck in these critical times.

Any help, especially of the most basic things such as food, water, clothes, medicines, blankets, body bags and the like would be more than appreciated. The devastation is such that the local governments cannot simply cope with the situation. So, before things get even worse or out of hand there should be a concerted effort to stabilize matters fast..... MORE

It took three days and more than 1,000 lost lives discovered before President Aquino was able to make it to the areas ravaged by tropical storm “Sendong” and it looks like he is also taking his sweet time before actually signing a proclamation declaring a state of national calamity to ensure the swift delivery of government aid and reconstruction effort.

Although Aquino has announced that he will declare a state of national calamity in areas in the Visayas and Mindanao, it appeared that he did so as a mere reaction to the devastation and the human agony that he witnessed upon setting foot in Cagayan de Oro City, one of the areas that saw the wrath of Sendong.

A Christmas column

AN OUTSIDERS VIEW
Ken Fuller
12/20/2011
Regular readers who assume that my silence on the subject of Christmas stems from belief — or, more precisely, the lack of it — are not entirely wrong. But there is another reason: since I first visited the Philippines in late 1989, I have rarely been able to suppress a smile (or, should the mood take me, a grimace) at the wildly inappropriate practice of Christmas songs and carols, many of which have a snowy theme, being played in shopping malls in a tropical climate. This is, of course, an example of US commercial imperialism, just as the practice of Christianity itself arises from Spanish colonialism.

Has Christmas ever been celebrated without Christianity? Yes — although it didn’t go by that name. In pagan times, Northern European peoples celebrated a mid-winter festival. In some places, this was associated with the god Odin (in Anglo-Saxon this is “Woden,” from which “Wednesday” is derived). But gods were not — and are not — a necessary component of such a festival, because one often needs cheering up during a bleak northern winter, and a festival is as good a way as any of accomplishing this..... The times are bad and the future is dark. The country is stagnant and millions of Filipinos are suffering from hunger and uncertainty. The local and national problems are not only multiplying but also worsening. The quest for justice and peace remains elusive and the imperative of socio-economic development is far from being seriously attended, much less realistically pursued. The Philippines nevertheless continuous to have one singular blessing: The Filipinos who keep the faith, live with hope, believe in love — especially so during Christmas.

This is the primary reason, notwithstanding all arguments to the contrary, the Philippines is rather known for having the longest Christmas Season in the world. This is also why the Filipinos — creative and ingenious as they are — successfully combine their own native Christian heritage with many elements of imported Christmas symbols and practices..... Decomposing bodies pile up; casualties hit 823

12/20/2011
As the body count rose to 823 late yesterday, authorities expect that the casualties from flash floods that devastated two port cities in Mindanao spawned by Typhoon Sendong will continue to pile up in the coming days as officials said more are missing than reported since entire families were believed swept to sea as they slept in coastal slums.

Towns in Cagayan de Oro and Iligan cities which were worst hit by the devastation prepared mass burials for decomposing bodies with authorities saying unclaimed cadavers piling up in mortuaries were posing health risks and had to be buried.

Several television footage showed decomposing bodies lined up in different centers where the dead were delivered for identification, underlining the serious tragedy that some of the survivors compared to the recent tsunami that hit parts of northern Japan last March. Luisita seeks SC recall ruling, SDO validity, high just compensation

By Benjamin B. Pulta 12/20/2011

First the Cojuangco-Aquinos of Hacienda Luisita said they would no longer seek a motion for reconsideration from the Supreme Court ruling that generally favored the hacienda farmers, but with the focus on the impeachment trial of SC Chief Justice Renato Corona and the vow of President Aquino to lobby with the senators to convict the CJ in an impeachment trial, the Cojuangco clan is pushing not only a recall of the SC ruling but for the court to declare the stock distribution option (SDO) valid, and also called for a higher just compensation for the clan.

Lawyers representing the Cojuangco-Aquino family-owned Hacienda Lusita Inc. (HLI) has asked the SC to reconsider its decision last Nov. 22 placing the centuries-old sugar estate under the government’s agrarian reform program.

In a 45-page motion to clarify and reconsider, HLI sought among other things, to have the reckoning point in determining the valuation of the hacienda moved to a later

date, 2006, from the original SC decision which said that the just compensation shall be based on the value of the property in November 1989 when the stock distribution option (SDO) was approved. The high court in its decision this year had struck down the SDO..... MORE

“Our gathering this morning is an opportunity to further assess the strengths and weaknesses of the present criminal justice system, and to come up with new and timely initiatives concerning the delivery of justice… Your decisions and the steps you take have implications integral to our democracy.”

That’s how President Aquino defined the objective of the First National Criminal Justice Summit, a laudable initiative by the Department of Justice, which he addressed last Monday at the Manila Hotel. We missed being informed of the summit’s output because the media coverage focused on P-Noy’s frontal tirades against the Supreme Court and Chief Justice Renato Corona.

Nonetheless, the President raised a point highly relevant to today’s observance of Human Rights Day: the injustice inflicted by Ferdinand Marcos’ martial law regime upon his father, Ninoy Aquino, the opposition leader who was later assassinated and now regarded as a hero.

Ninoy and Jose W. Diokno, then both senators, were arrested and held for two years in isolated military detention. Whereas Diokno was freed without being charged with any offense, Ninoy was dragooned into trial and conviction by court martial on trumped-up murder and related common criminal charges.

P-Noy summed up that ignoble procedure thus: “The dictatorship exerted all efforts to skew justice and run roughshod over my father’s human rights.”

With that flashback, P-Noy emphasized that he had sworn “to do justice to every man” in executing the laws and “to make certain that what transpired during martial law does not happen again, and ensuring that anyone who so much as attempts to repeat the same offenses is held accountable.”

Fast-forward to the plight of 356 political prisoners all over the country, who have been on a week-long fast/hunger strike to press for their immediate release. They have been charged, like Ninoy, with trumped-up common criminal offenses. The reality is that they were arrested for holding political beliefs different from those approved by those in power..... Manipulating the system

TABLETS OF STONE

Not even a democratic system is impeccable either from the mechanics or dynamics itself of the same or from given human intransigence and imperfections operating within that system. The tragedy lies in that there is no escape except the destruction of the system itself and the demise of those who wheels the inherent cyclical pattern within.

Our so called democracy has always metamorphose into a “democrazy” especially when the sub-institutions within the democratic system clash and mash against each other necessarily or unnecessarily. And we, the ordinary people, become helpless observers from below while the observers from above are helping themselves in taking advantage of the distractions and diversions as they freely “mind their own businesses.”.... BS Aquino III is not president?

DIE HARD III
Herman Tiu Laurel
12/19/2011
Just as we said that Gloria Arroyo was not president when she was declared such in 2001 by Davide and again in 2004 by Congress (in an election where the Cojuangco-Aquino clan endorsed her wholeheartedly), so it is increasingly the case with the current Malacaang occupant.

When BS Aquino III became an accidental candidate in 2009 upon the death of his mother, Cory Aquino (an event played up to launch his campaign), the election that followed was soon hounded by suspicions on the PCOS (Precinct Count Optical Scan) machines of Smartmatic and the Commission on Election (Comelec)s removal of vital voting safeguards. Many became aware that the UV light ballot authentication, the digital signature of the Boards of Election Inspectors (BEI), and the voters receipt were all done away with. Even the highly irregular recall of 76,000 CF (Compact Flash) cards just a week before the polls raised a huge red flag.

Today, many of those suspected criminal acts are now confirmed, thanks to the findings of citizens election watchdogs, CenPEG (Center for People Empowerment in Governance) and AES (Automated Election System) Watch, after year-long investigations.

The following conclusions, which I abridge below, have been borne out of the painstaking efforts of information technology (IT) academics and experts alike:

On May 10, 2010, (Comelec) made available to the public the election results by precinct, town/city, district, province, and nation (via the Web site) http://electionresults.comelec.gov.ph/. A few months later this Web site was taken down. We believe that it is governments duty to make election data from this Web site publicly and freely available, because it is THE STORY of how the Smartmatic-Comelec partnership carried out the computerization of our elections, and whether the computerization exercise was successful or not (As such) we have decided to publish our mirror of this Web site, so that the data are available even if they are not anymore available (That) Web site is: http://curry.ateneo.net/~ambo/ph2010/electionresults/...

A number of researchers have begun work on the data in this Web site (discovering) many serious errors like: 1) 371 precinct election results with 10 voters or less, when the actual number of voters is 400 to 1000 for each of those precincts, 2) 8,939 precincts with no data at all, indicating a possible failure of transmission of data from the precinct to Comelec, 3) of the 67,162 precinct election results which contain data, 25,530 precinct election results have missing data in one elective position, or two or three or more (Such) missing data in one or more elective positions is a clear indicator of the presence of serious bugs which SysTest Labs already pointed out in its certification report to Comelec, which bugs the Technical Evaluation Committee and Comelec conveniently chose to ignore.

(The researchers cannot) stand by while Comelec makes another serious mistake in re-using the Smartmatic technology. First, Smartmatic has to install a substantial number of bug fixes in their system before they can get it to work for our elections. Second, Smartmatic cannot do these bug fixes by its lonesome self, since it does not own the technology the copyright to the software is by Dominion Voting Systems of Canada, and Smartmatic is not allowed to make any changes in the source code, and must wait for Dominion to write the bug fixes in its own good time. Third, the PCOS hardware is not adequate to implement the security features required by RA 9369, like: 1) the requirement of digital signatures by the BEI and 2) the planned fingerprint/biometric reader to be installed on the PCOS.

Kudos to experts Dr. Pablo Manalastas, Dr. Felix Muga and Dr. Philip Truscott of the Ateneo de Manilas computer science and mathematics departments for trawling data originally posted on the Comelec Web site, which had been inexplicably taken down.

Out of all the major findings, the most significant centers on the missing data in 25,520 precincts, which indicates that there were at least two different canvassing programs in use during the 2010 elections, one that was used in the 41,632 precincts that had a complete set of data and another that was used in the 25,530 precincts that had missing sets of data.

So they ask: How come there was more than one program in play? The obvious answer is that the original program that was supposed to canvass votes and transmit the results from those 25,530 precincts was replaced by another program.

As a result, The only way of discovering the actual results would be to open the ballot boxes in those 25,530 precincts and count or feed them into pre-tested PCOS counting machines. The results can then be compared to the results reported by the substituted software In the set up by Smartmatic, the consolidating computers apparently had no hand-shaking protocols that would have allowed them to distinguish between legitimate and illegitimate sources (which means) the canvassing computers could have added to, subtracted from, or otherwise altered election results and then transmitted bogus returns.

The late IT expert Manuel Alcuaz had repeatedly stressed in the many forums he spoke, including my TV show, that the cheating in elections is not at the precinct level, where local and party officials are focused on, but at the municipal canvassing level, where the totals are very conveniently and easily manipulated with spurious inputs. Knowing this, he was thus incensed as the precinct level computerization was a big rip-off.

Since past Comelec officials (including its then legal chief) allegedly derived pecuniary benefits from Smartmatics PCOS machines, so are the present crop of Comelec commissioners and their supposed politician-clients perceptibly pushing for this patently fraudulent automated system for 2013 and 2016.
In the meantime, the political elite and its darling chief executive are creating political circuses left and right all to divert attention from the most crucial issues, including the question, Is PeNoy simply a Hocus-PCOSed president?

US will "absolutely" continue drone war on Iran

Even with the loss of not one, but two multi-million-dollar drones in recent weeks, the head of the US Defense Department says that America will “absolutely” continue stealth jets missions over Iran.

Despite these losses, the US Department of Defense is showing no signs of retreat, even if Tehran has insisted that they are well on their well to decoding the top-secret technologies under the hood of the recovered Sentinel. Speaking to Fox News this week, Defense Secretary Leon Panetta said that stealth missions into Iran will continue “absolutely,” despite ongoing opposition from overseas..... MORE

Secret documents reveal truth about American massacre in Iraq

Secret documents reveal truth about American massacre in Iraq

President Barack Obama may have declared the war in Iraq over, but unearthed documents thought to have been destroyed are bringing to light gruesome details from a skirmish that the military wishes hadn’t happened.

Scouring a junkyard outside of Baghdad, a reporter for The New York Times recently came across 400 pages of interrogations detailing the truth behind a massacre of dozens of Iraqi civilians that was carried out by American troops in 2005 in the town of Haditha. The documents, once under lock-and-key, were supposed to be destroyed. The reporter, however, came upon the remnants of the slightly-charred file as he picked through the debris in the dump.

According to the reporter, the junkyard attendant was using pages of the paper for kindling as he roasted a dinner of smoked carp in a trailer on the site..... MORE

Passion for teaching

Passion for teaching

By ANNE MARXZE D. UMIL

MANILA – John Clifford Sibayan, 19, is following the footsteps of his mother who is a teacher in a public school in Pampanga.

“There is nothing like teaching,” Clifford said during an interview. They do not only teach the students their lessons, for a public school teacher like Clifford’s mother, it’s more than giving education.

From his own experience during his practicum at Araullo High School in Manila, Clifford said, being a teacher in a public school is really tiring. But leaving the country for a better pay never crossed his mind.

“I dream that one day the system of education in our country will change. And that dream still prevails.” (Photo by Anne Marxze D. Umil / bulatlat.com)
“It’s really a tiring job. My work does not end in school; I still bring my work with me at home,” he said. Preparing for his lesson plan and grades also take his time. He handled five sections with 45 to 50 students. He also dealt with the lack of classrooms, chairs and other facilities. “Because there is no proper ventilation, I bring two handkerchiefs with me because of the scorching heat.”

Clifford is a fourth year student, BSE Major in Filipino at Philippine Normal University in Manila. He may sound dismayed when he told me about his experience but when asked about his plans for the future, Clifford said, he will still continue with what he has started.

Clifford’s stories about his practicum seems endless. He related that a student stole his classmate’s cellphone; about teachers doing all kinds of sidelines just to earn an extra income because of the low salary. His experience is like scenes in a movie that come to a reality and for Clifford, it was heart breaking. “That is why I don’t go to my mother’s workplace because I don’t want to see the poor children.”.... Should We Allow NATO Free Rein to Attack and Kill People?

The airstrike that killed 24 Pakistani soldiers is just the latest in a series of mistakes that raise doubts about NATO’s credibility
By PRATAP CHATTERJEE
Commondreams.org

Why did NATO forces kill two dozen Pakistani soldiers at a border post in the Mohmand region, some 300 yards across the frontier from Afghanistan early on Saturday morning? The US military claims the attack was in response to hostile fire, and the Pakistanis are demanding proof of that.

There is a very simple explanation of what happened: the US military makes deadly mistakes all the time, and for all its technological wizardry and tremendous firepower, it has very little intelligence on the ground.

“There are many questions that need to be answered,” an editorial in the New York Times pronounced:
“Who first fired on the American-Afghan force? Pakistan’s army is far too cozy with the Taliban. Were fighters sheltering near the Pakistani outposts? What about Pakistan’s claim that the NATO strikes continued for two hours even after Pakistan alerted allied officials? What needs to be done differently going forward?”

In New York and Washington, this is standard fare. We can’t trust the Pakistanis, they are with the terrorists.

But can we trust NATO or the US military? There are numerous examples of firing on civilians, killing children and even deliberately targeting and assassinating individuals who turn out not to have been the people they were claimed to be. And that is in Afghanistan, a country where the US has easy access..... MORE

MANILA — “Is it a crime to offer one’s life for the welfare of others?”

This was the statement of Angelina “Angie” Ipong http://bulatlat.com/main/2011/02/20/philippines%E2%80%99s-oldest-woman-political-prisoner-released/ , former political prisoner, during a forum organized by the National Union of Peoples’ Lawyers (NUPL), Dec. 13.

Ipong was arrested on March 8, 2005 in Lumbayao village, Aloran town, Misamis Occidental, by combined elements of the Philippine National Police’s Criminal Investigation and Detection Group (CIDG) and the Southern Command of the Armed Forces of the Philippines (AFP). She was held incommunicado for 14 days and was subjected to sexual molestation and torture.

An advocate of the rights of peasants and indigenous peoples and a member of the Rural Missionaries of the Philippines, Ipong http://bulatlat.com/main/2011/03/21/angelina-ipong-talks-about-her-ordeal-as-political-prisoner/, like most political prisoners, was slapped with common crimes such as double murder, double frustrated murder, and arson.

“Political detainees who have already served long and completely unjust sentences, continue to languish in jails; even as we have a president who is the son of a political prisoner himself,” Edre Olalia, NUPL secretary general, said.

“After six years [in detention], all the charges against me were dismissed. There was no basis for prolonging my incarceration. That is a terrible injustice to me,” Ipong said.

Bayan Muna Rep. Neri Javier Colmenares condemned the continuing criminalization of political offenses.
“Is it fair that a revolutionary is treated as nobody different from the killers of Ramjen Revilla?” Colmenares said. Ramjen Revilla, who was killed allegedly by family members, is the son of a former senator.
“The issue of political prisoners is an issue involving each one of us. We should not be treated as criminals for the mere exercise of our Constitutional rights,” Colmenares said.

In the same vein, Ipong, now secretary general of Samahan ng Ex-Detainees Laban sa Detensyon at Aresto (Selda), said: “No one should be imprisoned for his/her political beliefs.”..... MORE

It took more than a year before the Aquino administration filed a case against former president Gloria Macapagal-Arroyo. This despite demands from various sectors to hold the former president to account for her numerous crimes against the Filipino people and the preponderance of evidence gathered by the different Congressional investigations. It took an attempt to go abroad by the former president before the current administration filed the case of electoral sabotage.

The Aquino government reasoned that it wants its case to be airtight, thus, the delays in the filing of cases.
