$400-M Northrail contract not immune from suit — SC
By Benjamin B. Pulta 03/04/2012The Supreme Court (SC) has turned down a petition by the Chinese contractor of the controversial $421-million Northrail project with the high tribunal, saying the firm is not immune from suit.
In a decision, the court en banc through Associate Justice Lourdes Sereno denied the petition filed by the China National Machinery and Equipment Corp. (CNMEG) and said the latter “is not entitled to immunity from suit.”
The ruling also said the contract agreement it signed with the Philippine government is not an executive agreement and remanded the case to the Makati Regional Trial Court Branch 145 for further proceedings..... MORE
