Workers Frustrated Over Lower House Decision to Take Early Break
The long-delayed substantial wage hike demanded by Filipino workers found no room this Christmas in the House of Representatives. Meanwhile, prices of food and transport continue to soar, and even the ILO reported that the Filipinos’ wages suffered one of the biggest cuts in Asia.

MANILA – “It looks like our legislators were very excited in having their Christmas vacation,” said Ferdinand Gaite, co-convener of the alliance Koalisyon ng Progresibong Manggagawa at Mamamayan or KPMM. His group went to the gates of the House of Representatives on Wednesday to push for the approval of House Bill 375 which seeks to legislate a P125 ($2.82) across-the-board wage increase nationwide.
Filed by Anakpawis Rep. Rafael Mariano last July 1, the bill was supposed to be scheduled for deliberations by the House Committee on Labor and Employment that day, but it did not push through because the congressional sessions adjourned earlier than scheduled.
There were supposed to be two more working days at least before the Congress was to have adjourned for Christmas, Gaite said as his group pressed on with their planned brief program before the House of Representatives.
With Gaite were workers from the public and private sectors. They were carrying big signboards bearing the group’s demand for a P125 ($2.82) wage hike, as well as big and small Christmas lanterns. The workers’ visit to the gates of the House of Representatives was supposed to be their way of “sending their message of hope” to lawmakers for the passage of the wage hike bill.
But the workers were forced to swallow yet another disappointment. Last Wednesday’s scheduled deliberations would have been the first since the bill was last tackled by the House Committee on Labor last September 2008.... MORE

MANILA – Is the Toll Regulatory Board (TRB) a Philippine government body or a tool of foreign contractors for “muscling its way into the pockets of ordinary taxpayers”? The TRB has incurred the wrath of Taxpayers’ Unity vs Toll Hike in SLEX (TUTOL-SLEX), an alliance of commuters, drivers, peoples’ organizations, businessmen, local government officials, neighborhood associations and other taxpayers. The board, they said, “hastily approved” this week the petition of the South Luzon Tollway Corporation (SLTC) for a 300% increase in toll rates.
Describing the said approval as “treachery”, and the TRB as “traitors to the interest of the public”, the group raised questions about the “lies” cited by the TRB as some of its bases for coming out with the approval. One of it was the supposed public hearings it had conducted.
“There was no public hearing,” Sammy Malunes, co-convenor of Tutol-SLEx, told Bulatlat.com during one of their protest actions. “We do not consider as genuine that so-called public hearing they conducted last Dec 10,” Malunes explained.
The TRB called for a public hearing in their head office last week, but, according to Tutol-SLEx, drivers’ and operators’ organization PISTON and other critics of the toll fee hikes, the public was not really invited because the TRB only announced it through a newspaper with minimal circulation.
The TRB published on December 8 in Manila Standard the SLTC’s proposed toll increases. Toll fees for class 1 vehicles will be raised to P77 ($1.74) from P22 ($0.50), Class 2 – P155 ($3.49) from P43 ($0.97) and Class 3 – P232 ($5.23) from P65 ($1.47). TRB spokesman Julius Corpus said in an interview that the published rates are not yet approved by the TRB pending the result of the public consultation..... MORE

Hong Kong Department of Justice lawyer Jat Sew-tong said the witnesses include Lim, who is facing administrative sanctions over the authorities’ failed rescue operation, local Radio RTHK reported.
Police snipers, doctors and Philippine medical examiners would also be part of the witness group, RTHK quoted the lawyer as saying.

Executive Secretary Paquito Ochoa Jr. issued a memorandum dated December 16 directing Justice Secretary Leila de Lima, Interior and Local Government Secretary Jesse Robredo, Philippines National Police (PNP) Chief Raul Bacalzo and National Bureau of Investigation (NBI) Director Magtanggol Gatdula to tap all available resources of their agencies to capture the real killers of the Vizcondes.

By Benjamin B. Pulta 12/18/2010A local court in Rizal province yesterday ordered the release of the so-called “Morong 43” who were arrested in February while allegedly holding a bomb-making seminar in Morong, also in Rizal.
At least six of the 43 detainees, however, will remain behind bars for pending cases for murder, rape and violation of the law on bouncing checks.
In a 12-page order, Morong, Rizal Regional Trial Court Branch 78 upheld the Department of Justice’s position that a majority of the arrested health workers could not be prosecuted for illegal possession of explosives in violation of Presidential Decree 1866 as amended by Republic Act 8294 and RA 9516 by virtue of the fruit of poisonous tree or the doctrine excluding evidence gathered through illegal searches.
“The court agrees with the prosecution that without the evidence which are fruits of the poisonous tree, the Department of Justice finds that the accused cannot be prosecuted successfully, as there remains no other evidence against them,” explained the order signed by Presiding Judge Gina Cenit-Escoto..... 12/18/2010The first solar testing facility of the Philippines opened yesterday at the First Philippine Industrial Park in Tanauan, Batangas.
The testing facility is a product of a Public-Private Partnership (PPP) between the Congressional Commission on Science Technology and Engineering (COMSTE) and First Philec Solar Corporation.
Senator Edgardo Angara, chairman of COMSTE, lauded the opening of the testing facility as significant proof that the government and industry collaboration works, and that continued PPP’s can spur the growth of innovation especially in the fields of Science and Technology (S&T).
The testing facility has 180 KW on-grid capacity, and is capable of testing photovoltaic (PV) modules for efficiency and resilience in field conditions, as opposed to being tested in laboratories in controlled environments.

By Mario J. Mallari 12/18/2010Government security forces stumbled upon a ranking leader of the communist New People’s Army (NPA), who was the subject of a number of warrants of arrest for murder charges, during checkpoint operations in Agusan del Sur province yesterday.
Arrested was Pedro Codaste, who is facing double murder and double frustrated murder charges before the Malaybalay City Regional Trial Court (RTC) Branch 8.
Codaste was arrested during checkpoint operations conducted by elements of the Army’s 4th Infantry Division (ID), Police Regional Office-10 and PRO-13 along Barangay Fili in Bayugan town around 11 a.m.
During subsequent investigation and background checking, authorities established that Codaste was the same person as Ka Gonyong, the front secretary of the NPA’s North-Central Mindanao Party Committee.
Also arrested were Codaste’s civilian contacts identified as Eliezar Asaraga, Norberto Espina Jr. and Hector Camelote, and Codaste’s NPA comrade, Eddie Alegre..... MORE

There are several ways to view the contents of a WikiLeaks cable stating that China saw Gloria as a good leader with the United States conforming with the observation through one of its top officials in the region, but it only showed that foreign diplomats look at the country with a jaundiced view.
The view was shared between Hu Zhengyue, former director general for Asian Affairs of the Chinese Ministry of Foreign Affairs, and US Deputy Assistant Secretary of State for East Asia and the Pacific Eric John in a meeting held in March 2007 just when the nation was about to hold national elections in May that year for 12 senators, congressmen and other local officials.
The dialog between both revolves around the interest of both China and the United States in the region and how the two super powers can achieve mutual cooperation, which comes out in the cable as more of a discussion on how one can prevent stepping on the foot of the other as they look after their self-interests.
The part of the cable focusing on the Philippines was very limited and near the end of what could have been a substantially long meeting that mainly focused on the United States representative prodding China to take a decisive role on pressuring Burma or Myanmar to open up its political sphere to pro-democracy groups that may have borne fruit in the recent release of that country’s main opposition figure, Aung San Suu Kyi..... It looks more and more like a crooked path being treaded by the new Malacañang tenant and his cronies and political allies, what with the huge P21-billion Conditional Cash Transfer (CCT) not only being kept intact, despite the impossibility of the pro-poor program’s effective implementation, but also with the deliberate removal — by just two congressional allies of Noynoy Aquino — of the protective clause that was inserted earlier by the minority members of Congress.
Goodbye, hopes of good government. Hello again, big time government corruption!
Because the removal of the protective clause covering the P21-billion CCT funds, which called for any savings from that fund to be given for education and health, means that the CCT savings would now go into the pocket of the Chief Executive, to do as he pleases. In other words, the savings will now be added to his already fantabulous pork barrel, which is already in the tens of billions.
From reports, only two members of Congress deliberately removed the protection clause: Sen. Franklin Drilon and Rep. Jose Abaya, both staunch allies aand lapdogs of Noynoy Aquino..... MORE

It’s got to be said that of those screaming reactions for or against the acquittal of Hubert Webb and company, few were as explosive for the “Morong 43,” or, much earlier, the “Tagaytay 5,” and the Magdalos, led by Sen. Antonio Trillanes IV.
This could be because Pinoys generally find soap opera material more attractive, and stories that deal with fighting for the country don’t wow the ratings. There’s also possibly the guilt factor; if as ordinary citizen you take sides on the Morong 43 being NPAs, the Tagaytay 5 terrorists, and Trillanes and men putschists, soon enough you realize you’ve in fact done so little for Inang Bayan, so no thanks, you’d rather render opinion and strong opinions at that, on the latest cause célèbre.
And the Hubert Webb story is soap opera at its finest, a narrative that first caught national attention 15 years ago when the concept of reality TV was still on the planning boards. One can’t say for sure if media have taken sides, but leading broadsheets for instance describe the recently freed as “scions of wealthy families” living in “posh” houses in “enclaves,” if not in “plush condos” and such choice of words do not make them underdogs. In TV-dom, whoever lives in a big house is the kontrabida, the mapang-api, and therefore the manggagahasa, so, there..... MORE

The 19-year tale of blunders and consequent injustice marks the track of Philippine society, from the staggering blunder of elite families allowing their children to be swallowed by the drug culture and involvement (without saying that they are guilty) in such a heinous crimes (such as the 1997 Chiong sisters rape-slay in Cebu by scions of powerful families) to the deadly Keystone Kops or rogue cops character, law enforcement agencies and officers, through the hoodlums in robes in the nation’s courts; and to top it all, the supreme blunder of the Supreme Court (SC) in allowing a minority of seven of the en banc to carry the final day of the almost 20-year-old Vizconde saga. According to Law professor Alan Paguia, the Constitution, jurisprudence and decided cases require the majority of eight concurrences of the en banc to decide a case; and consequently the prisoners’ release is illegal.
This is not a discussion of the merits of the Webb case. It is about the cavalier way Philippine society treats law and law enforcement that bring endless blunders and injustice upon our society. Our Global News Network show, aired live and as breaking news as the SC spokesman Midas Marquez’s statements were being replayed on air, Paguia discussed this salient point of the Constitution and the law with our other guest, former senator and whom I call senior statesman Eddie Ilarde: that the concurrence of the majority of no less than eight SC justice sitting en banc, as distinguished from a division of three or five, is required for the en banc decision to be effective. This means that the SC’s seven acquit, four sustain (for the lower court decisions) and four abstain or inhibition is actually sustaining the conviction. Vizconde should take note of this and not blunder on, though the defendants could still petition for reconsideration.
The hasty order from the SC to the prison officials to effect the release of the accused is another disconcerting error that has raised cries of “foul” from the Vizconde family sympathizers. The normal process would bring the order for release to the Department of Justice (DoJ) first and from thence to the prison officials, which would take at least a few days. The injudiciously hurried release ordered by the SC has raised charges of bribery from Vizconde supporters, believing the hastiness was compelled by other than legal considerations. I sought second opinions: four out of five lawyers said that Paguia’s questions “have merit,” two pointed out that the question however would be judged by the SC itself if brought up and would not prosper, and the hasty release was “highly irregular.” The rest of the country, even Vizconde, has accepted the SC decision to be gospel truth, thus we continue to be a “blundering society.”
The blundering media must not be let off the hook. One of the factors that got the “trial by publicity” of the accused all stoked up was the ABS-CBN’s once TV talk show host, the late Sen. Rene Cayetano, who played up the case to build up his own political stock. The Pasay judge in the Vizconde case showed a penchant to ham up to media which media lapped up with gusto, and colleagues of the judge congratulated her upon being assigned the celebrity case the media had built up and which she could bask in the glory of “hanging” the accused and gain her ticket to promotions as other “hanging judges” paved their way to prominence and other careers upon retirement. The media glare brings out many questionable values in human beings. Even today, the media show their propensity for idiocy, swallowing like the rest of society the announcement from the SC as if it were gospel truth and not raising the questions that should be raised.
The foibles of media in the aftermath of the Webb release continue, one columnist lamented “trial by publicity” when he and his newspaper have been the major “crucifier” by publicity as they did to President Joseph Estrada. The DoJ is reopening the Vizconde rape-slay case and the media should be raising the questions, such as: the role of the “drug Indians” and the NBI which allegedly illegally sprung them and which Sen. Freddie Webb was investigating, a second set of suspects who were then discounted, inexplicable lapses in the consideration and care of evidence by the court and the NBI, etc. It remains to be seen if this time the straight path to the facts and truth be taken; but after the Hong Thai-Mendoza hostage-taking and apparent cover-up are any indication, Philippine government and society will continue to blunder along — until revolutionary change imposes a strong moral and ethical culture replaces what we have today.

KHAIRPUR NATHANSHAH — Hajani Chandio broke down in tears when she came home after three months in a refugee camp following the catastrophic floods that ravaged Pakistan earlier this year.
“My house looked like a huge rubbish dump. It was littered with rubbish and the smell was unbearable. I burst into tears, how can we live here? The children begged us to leave,” said the mother of seven.
Chandio’s province of Sindh was one of the areas worst hit when monsoon rains ravaged a fifth of Pakistan in July and August, affecting 21 million people and consuming entire villages in the country’s worst natural disaster.
Large areas are still submerged under flood waters but UN refugee agency the UNHCR says Pakistani families are increasingly swapping life in the camps to go home, however bleak the conditions as winter sets in.
For Chandio, the loss is all the more bitter because local residents suspect their town of Khairpur Nathanshah, 350 kilometers (220 miles) from Karachi, was flooded deliberately by local authorities who breached a canal to avoid even more extensive damage elsewhere..... MORE

CIUDAD JUAREZ — They call it the exodus. Thousands who emigrated to northern Mexico seeking better lives have recently fled its murder capital Ciudad Juarez to escape a bloody drug war.
Diego Ramirez was one of countless young Mexicans who flocked to the frontier area with the United States for jobs in the factories and assembly plants that sprang up after the 1994 North American Free Trade Agreement.
But he and his family were among 2,300 persons from the Gulf coast state of Veracruz who, opting for safety over financial stability, recently boarded charter flights back home to start over again.
“We had to leave our house empty. We had nearly paid for it all, but it was either that or risk getting caught up in a shootout,” said Ramirez, who caught a flight to Veracruz paid for by the state government. With him were his two sons and their 76-year-old grandmother.
Ramirez had scraped together what little money he had and borrowed the rest, to buy his house; now he doesn’t know what will become of it..... MORE

By Gerry Baldo 12/17/2010Former Armed Forces of the Philippines (AFP) comptroller retired Maj. Gen. Carlos Garcia, accused of amassing at least P300 million in government funds, yesterday pleaded guilty to lesser cases of graft under a plea bargain agreement before the Sandiganbayan.
He entered guilty pleas to direct bribery and violation of the Anti-Money Laundering Act at the anti-graft court’s Second Division.
“Yes,” Garcia told the Court when asked whether he would plead guilty to the lesser offenses filed against him.
Garcia was accused of amassing P303.27 million in ill-gotten wealth while in active service with the military. His wife and children were also accused for allegedly helping him conceal suspected illegal assets and the US gov’t charged them with smuggling dollars into the country.
The prosecutors did not oppose the guilty pleas to lesser offenses which were deemed submitted for resolution before the Court’s second Division..... MORE

“I cannot under-stand why they (Palace) cannot utilize the Department of Justice (DoJ),” he told reporters during the weekly Kapihan sa Senado news forum, referring to the cases Malacañang wants former President Arroyo to be charged with, under Aquino’s flawed truth commission.
“If the purpose is to investigate the past activities of a previous administration, then why not make use of the DoJ?” Enrile said, stressing the fact that such is the recourse of the administration which is seen to be having misgivings over the Office of the Ombudsman that has jurisdiction over the tasks being given to the PTC...... This was how Senate President Juan Ponce-Enrile defended the additional priority development fund (PDF) of some P200 million for the Vice President.
Enrile yesterday defended Congress and the Palace’s decision to provide P200 million of the PDF, more commonly referred to as “pork barrel” to Binay in the approved 2011 national budget.
The upper chamber chief does not see anything wrong with the move taken by Congress, apportioning the Vice President a PDF which is an allocation in the national budget enjoyed by congressmen and senators, including the President.

Members of the government peace negotiating panel yesterday condemned what it described as a “treacherous attack” carried out by the New People’s Army (NPA) against soldiers a couple of days before a mutually agreed ceasefire between the communist rebels and the military has taken effect.
Peace Process Adviser Secretary Teresita Quintos-Deles said they were “disheartened” upon learning about this incident not only because 10 soldiers were killed in the attack but that an innocent nine-year old child was caught in the crossfire.

Thus was the assessment given yesterday by Senate President Juan Ponce Enrile on the reported deferment of the promulgation of the case pending before Judge Oscar Pimentel of the Makati Regional Trial Court Branch 148.
“If it was an acquittal, I think he would have proclaimed it since that is in line with the amnesty, the thrust of the amnesty. So I assume that, that (guilty verdict) is the content of his decision — guilty verdict against the people who are involved in the case,” he said.

12/17/2010Philippine security forces and communist rebels began a Christmas ceasefire yesterday in the shadow of the guerrillas’ deadliest attack in a year and marred within hours by a fresh skirmish.
Both the government and the rebels declared 18-day ceasefires from midnight ahead of the first formal peace talks in six years seeking to end the decades-old Maoist rebellion that has claimed thousands of lives.
The military will observe an 18-day ceasefire but remains on guard, after the New People’s Army (NPA) killed 10 soldiers two days ago in an attack that also left a boy dead, military spokesman Brig. Gen. Jose Mabanta said.
“You can see the treachery involved. It is far from being an act of good faith,” said Mabanta, referring to the ambush in the central island of Samar on Tuesday.

Lauro Vizconde and his Dante Jimenez-led Volunteer Against Crime and Corruption (VACC) group were again doing that which they usually do — accuse those who went against their position, and again, without any evidence. All they do is to get media play and sympathy from the public, while excoriating whoever they want convicted.
This time around, at a press conference held the other day, both Vizconde and Jimenez accused the Supreme Court (SC) justices who voted to acquit Hubert Webb and his group of having been paid off to free the seven convicts of the Vizconde massacre.
What evidence do they have that the justices were paid off, and by whom? Webb’s father has been out of power and position for so many years and if it was power and influence involved, then the Webbs certainly would have paid off the regional trial court (RTC) judge instead of waiting 15 years to pay off the SC justices who had voted for an acquittal...... Noynoy Aquino justified the Philippine boycott of the Nobel Peace Prize awarding ceremonies as having done this for the “national interest” on account of his bid to save the lives of five Filipino drug mules in China jails, awaiting their execution, along with his desire to smoothen the ties between Chinese and the Philippine governments.
On the issue of the five drug mules, Noynoy said he had asked for clemency from the Chinese government.
That was really dumb, in the sense that the Chinese government does not operate in the same way the Arab countries do by way of extending clemency to prisoners in death row.
The Arab countries allow the rulers to free death row prisoners — either freeing them or commuting their death sentence by way of blood money being given by the victim’s relatives — should they accept the blood money..... MORE

The well-known Holy Angel University (HAU) in Angeles City is facing a P30-million damage claim suit relative to a multiple rape complaint lodged against one of its professors by his alleged victim, a former nursing student.
Based on information we had gathered, the civil case was filed by the victim’s parents against HAU, one of the biggest learning institutions in Central Luzon which is said to be owned by the family of former Commission on Higher Education (Ched) Chairman Emmanuel Angeles who incidentally is a kabalen and very close friend of former President Arroyo, for dilly-dallying on the administrative complaint he earlier brought before school authorities which resulted in the suspect being able to flee to Saudi Arabia.
The suspect, identified as one Arnel Ocampo, is expected to be deported back to the country anytime now after being arrested in Jeddah where he was working in a Saudi-owned firm based on a representations made by the local National Bureau of Investigation to Interpol (the international police organization that facilitates cross-border police cooperation) which subsequently placed him on their “red list” thereby turning him into an international fugitive. What made matters worse for Ocampo was the cancellation of his passport by the Department of Foreign Affairs which made him an undesirable alien in Saudi Arabia..... MORE

There is this well-known song about a famous lady who made people look in awe and caused them to dream many dreams of deep longing and profound admiration. And this eventually took place with a sense of loss and pity. This was that the said happy and hopeful dreams were placed at her own doorstep. And what happened? This: “They just lie there. And they die there!”
Needless to say, this is not only saddening but also distressing. The hope was fading. The dreams were going — until these could be in fact gone in due time. The longings and aspirations should have been picked up from the doorstep and brought to their happy realization or fulfillment.
Above is exactly the picture and story of the present administration which — sad to say — has already wasted so much hopes and destroyed so many dreams of those who precisely gave it the mandate and the power to govern. And this is but a short time after the so called “honeymoon period.” In other words, whereas the previous administration did all possible graft and corrupt practices, the now ruling administration had it very easy taking over — with its loud and repeated proclamations of self-righteousness and integrity..... I just found out that Jack, who wants to be a lawyer a la Perry Mason, occasionally browses over my 50-year-old law textbooks with marginal scribbles. He stunned me when he said, “Gramps, I don’t see how the (Gloria) Arroyo people can claim Executive Order No.1 is an act of vindictiveness and discrimination. The President simply wants to know if they committed serious crimes, so what’s so wrong with that?”
Then he dropped a bomb: “Maybe the Supreme Court is the one being vindictive because the President clipped its budget — well, it is not quite like that, Jack — for austerity reasons.” Hmm, a little ahead of his age, this kid, who manages to keep abreast of current news. Well, I’d like to share the following insights drawn from my conversations with Jack regarding the constitutional guarantee of the equal protection clause (EPC).
Shorn of suspected ill motives shrouded in highfalutin legalese and specious reasoning, the EPC is an uncomplicated common-sense principle that nobody should be discriminated against for such reasons as relate to gender (e.g. homosexuals and lesbians being denied employment opportunities), color (e.g. Ilocanos being segregated at a restaurant section away from fair-skinned Visayans), religion (e.g. public transport facilities banning members of a particular non-Christian church), and physical disability or defect (e.g. denial by public amusement places of entrance for the handicapped)..... The defense lawyers are also looking at filing a serious administrative coomplaint based on plagiarism against the Parañaque Regional Trial Court (RTC) Judge Amelita Tolentino who had convicted Hubert Jeffrey Webb and six others in connection with the Vizconde massacre case.
Flaminiano stressed that Tolentino’s decision, when compared with the memorandum submitted by the prosecution, doubts are also raised over her evaluation of the evidence presented since she merely copied the prosecutor’s opinion.

Beijing was impressed with Arroyo’s firm leadership, calling her “a good leader,” while American officials appreciated her economic reforms and “extremely successful” US-backed counter-terrorism campaign in Mindanao, WikiLeaks quoted Hu Zhengyue, former director general for Asian Affairs of the Chinese Ministry of Foreign Affairs, as saying.
“Beijing sees Arroyo as a good leader because she has shown that ‘she is in control.’ DAS John agreed Arroyo has stabilized Philippine leadership and enacted strong fiscal and economic policy,” the March 5, 2007 cable, which originated from the US Embassy in Beijing, said, citing a meeting between Hu and US Deputy Assistant Secretary of State Eric John.
But John “stressed that Beijing and Washington must encourage Manila to continue working hard to promote transparency and good governance,” according to WikiLeaks.

By Gerry Baldo 12/16/2010The House minority bared yesterday the removal of a provision in next year’s budget that would prevent the unused portion of the massive P21 billion budget for the conditional cash transfer (CCT) program of the Department of Social Welfare and Development (DSWD) from turning into savings the use of which would be under the discretion of the Office of the President the following year.
Without the provision, savings from the CCT could easily become part of the President’s own “pork barrel,” Zambales Rep. Milagros Magsaysay told reporters.
During a House interpellation before the ratification of the budget, Cavite Rep. Joseph Abaya, House appropriations committee chairman, indicated that Sen.Franklin Drilon, a staunch ally of President Aquino, insisted on removing the provision, saying it is unconstitutional.

Malacañang yesterday acknowledged the Aquino government’s responsibility in resolving the Vizconde killings, with the authorities back to square one after the Supreme Court (SC) acquitted the primary suspect and the six others in the Vizconde massacre case which spanned 15 years.
Following Philippine National Police (PNP) chief Raul Bacalzo’s announcement that the Vizconde massacre case will be reinvestigated, deputy presidential spokeman Abigail Valte said it goes without saying that the national government has to support this move to bring the real perpetrators to justice.
“That is the duty of the government — to close these cases and to make sure that the accused are brought to justice,” Valte told reporters at a press briefing yesterday.
Valte said President Aquino has not as yet given any official directive to the government’s law enforcement agencies on this, after issuing a statement the other day, asking his officials to prepare a briefer on this issue

Eastmincom chief Maj. Gen. Arthur Tabaquero said he is not taking any chances on this as he ordered his troops to validate the information that the group of JI militant Abdulbasset Usman are now conducting training on bomb-making, apparently for a future plot.
Tabaquero said that text messages regarding Usman’s activities circulated through text messages all over Mindanao, particularly in Maguindanao and General Santos City, starting Sunday.

Parañaque Rep. Roilo Golez said that the pro-RH groups suffered a devastating defeat following the decision of the bicameral conference committee to scrap the budget for contraceptives.
“The pro-RH group was defeated in the first encounter on contraceptives and condoms. Why is there so much Palace resistance in seeking a measure from Congress for the body to create a commission that would not only investigate former President Gloria Arroyo but all other previous presidents? That should be the solution to the problem of Noynoy Aquino’s constitutionally flawed Executive Order 1 (EO 1) — as long as the congressional measure adheres to the constitutional parameters as set out by the Supreme Court (SC) in its ruling.
The answer is fairly simple: Vindictive Noynoy wants the focus of investigation on graft charges solely on Gloria and only on the charges he wants investigated that would lead to her being charged in court..... MORE

Hubert Webb and his co-accused have been acquitted by the Supreme Court, and they are today free men, yet 15 years of their lives have been robbed from them, and frankly, those to blame for their wrongful conviction by two courts are the hearing Parañaque Regional Trial Court (RTC) judge, Amelita Tolentino, the Justice secretary at that time, Franklin Drilon, if memory serves; the National Bureau of Investigation (NBI) known to plant witnesses and, most of all the media, all of whom had conducted a trial and conviction by publicity of Webb and company.
It was so clear even at that time, that the NBI was making sure that Webb and company would be tried by publicity, as the NBI kept on talking to the media, giving them clues as to the identity of Webb — and just as quickly, the media started their trial and conviction of Webb and company by publicity — this despite the fact that all of them knew that they had no evidence to prove Webb’s guilt.
In fact, the NBI and the RTC even made sure that the semen sample taken from the rape victim would “be lost” because this would prove without doubt, the innocence of Webb and company and prove too that they, along with Jessica Alfaro, the so-called state witness, were out to frame these young men — even when they knew they were innocent..... WASHINGTON — Condemned by the lower house of the US Congress to remain in Guantanamo Bay indefinitely, “War on Terror” detainees are taking their cases to the Supreme Court (SC), hoping it can break them out.
The House of Representatives last week approved a bill that would prevent any detainees held in the US naval base in Cuba from being transferred to the United States for detention or trial.
But eight cases are pending in the highest US court, representing nearly all of the prison’s more than 170 detainees and reflecting their diverse legal predicaments, with final rulings expected in 2011.
US President Barack Obama vowed to shut down the controversial military prison during his 2008 White House run and issued an executive order shortly after assuming office to close it by January 2010.
But Obama has missed his own deadline as the administration has run into knotty legal issues, difficulties in finding countries to accept detainees and congressional opposition to trying them in US courts..... MORE

Two of the worst performing GOCCs are in the news yet again. The Commission on Audit (CoA) has advised that the Philippine National Construction Corp. (PNCC), formerly CDCP, granted unauthorized and excessive allowances to its board of directors, officers and employees and paid out consultancy and other fees to various individuals and entities in violation of existing rules and regulations. The company whose tollways franchise has expired also owes the government P7 billion in concession fees and related liabilities. The state audit office noted that the PNCC also gave P261 million in unauthorized cash advances to its employees which were not covered by any board resolution; paid out P3.3 million in retainer and legal fees and another P1.61 million in consultancy fees and other benefits.
PNCC is the same firm which nearly lost billions of pesos worth of valuable real estate at the reclamation area to a BVI company, Radstock, based on a spurious document of indebtedness issued in the ’80s yet. It is also the same firm which has been accused of surrendering its rights, privileges and even assets to its joint venture partner — Malaysian firm MTD Berhad — in the controversial South Luzon Expressway (Slex) project..... The dialog, as scant as the clothing, is spoken in Xhosa, Zulu and Sotho, in a film that producer Tau Morena, 30, describes as a “voyeuristic experience” designed to portray the “average guy and girl next door, having great sex.”
The movie, Mapona Volume 1 (naked in Sotho) has caused a stir among social conservatives in a country that under apartheid saw porn banned from open public sale, leading to a rampant under-the-counter market.
It has also grabbed people’s attention because unlike most locally produced DVD erotica the men are filmed putting on condoms before sex, and all actors underwent mandatory tests for HIV and other sexually transmitted diseases.
“We want to show using condoms can be fun and practical,” says Morena, who insists that if people “condomise” before sex then their health will benefit.

Aclenched fist either means defiance or victory. And during the recent months when I followed the persecution of the so-called “Morong 43” through media, I’ve seen many fists up in the air. They would satiate many former activists who love to romanticize their pasts during reunions and small gatherings, they seem to forget that there are others who are still deeply embedded in the struggle they have left long ago in exchange for better fortunes and other various reasons.
These guys are real. And whether they are members of the Communist Party of the Philippines, or the New People’s Army, as the military had claimed, could be proved (or disproved) in legitimate venues and must undergo a daunting legal process if the military would want to establish the Morong 43 as enemies of the state.
But not in the way they were arrested during the waning days of Gloria Arroyo. And if my voice would count, I’ll give a thumb up to President Noynoy for his enlightened decision to free majority of the Morong 43 on Human Rights Day.
It was not an easy political decision to make, a harder one compared to his recent gift of freedom to Sen. Antonio Trillanes and his group. It may even equal in weight with his boycott of the Nobel Peace Prize if only to appease China..... MORE

Mixed reactions met the recent acquittal of Hubert Webb, who appealed his conviction for the rape and murder of Carmela Vizconde, as well as the murders of the latter’s mother and younger sister.
This immense development comes on the heels of President Noynoy Aquino’s order to withraw information on the “Morong 43,” the group of health workers arrested and detained by the military for over 10 months now.
The move was hailed by communist groups and human rights advocates, who at the same time could not help by criticize the length of time it took for Malacanang to do anything about it. The communist insurgents think the action would go a long way into the peace process, which has been going on for decades now. It was, according to the Communist Party of the Philippines (CPP) in its Web site, a “boost of goodwill for the forthcoming resumption of peace negotiations.”
The CPP also said the President’s release order was an “inspiration” for “thousands of other victims of military abuses to defend their rights” and to “seek redress for the grave injustices inflicted on them.”.... MORE

Pulta 12/15/2010Hubert Webb and his co-accused, all convicted by two lower courts 15 years ago, walked free yesterday after the Supreme Court (SC) acquitted them on the basis of Webb’s strong and incontrovertible alibi that he was not in the Philippines when the Vizconde massacre occurred. As the case was a conspiracy, the other accused were set free, save for two who are still at large.
A ruling by the SC voting 7 to 4 cleared Hubert Jeffrey Webb and six others in connection with the 1991 Vizconde massacre.
In a 38-page decision, the high tribunal through Associate Justice Roberto Abad said the testimony of National Bureau of Investigation (NBI) asset Jessica Alfaro four years after the incident raised reasonable doubts about the guilt of the accused in the murder of a mother and her two daughters in a Parañaque City suburb.
“The positive identification of the offender must come from a credible witness. She is credible who can be trusted to tell the truth, usually based on past experiences with her. Her word has,to one who knows her, its weight in gold,” the decision said, addingthe said “the witness’ story of what she personally saw must be believable, not inherently contrived.”.... MORE

Presidential spokesman Edwin Lacierda claimed that the alert warning is baseless because the peace and order situation in the country remains “fine” and there is no reason for the HKSAR to come up with this advisory that might affect the Philippine tourism industry.
“We don’t know where that was coming from. Some of the countries have downgraded their travel advisories,” Lacierda said, referring to the six other nations, namely, the United States, United Kingdom, France, New Zealand, Australia and Canada that issued a string of travel advisories against the country last month.

In a report to the Department of Foreign Affairs (DFA), the embassy said the New Zealand Ministry of Foreign Affairs informed them that Filipino crewmen Carlo Castillo, Nickson Telete and Pilardo Mariano are alive.
“They were among the 20 survivors rescued by another fishing vessel in the area that responded to the Number One Insung’s sinking and assisted in the rescue operations,” the embassy report said.

By Mario J. Mallari 12/15/2010The Armed Forces of the Philippines (AFP) will boost its air capability with the scheduled delivery of five newly refurbished UH1H or Huey helicopters from the United States this week.
Col. Arnold Mancita, assistant chief of air staff of the Air Force, said that five UH1H helicopters are expected to arrive on Sunday.
“These (Hueys) are the primary utility helicopters not only of the Air Force, these also serve the Army and the Navy,” said Mancita.
“Any additional number of helicopters will boost the mobility of our men in the field, and also the transport of supplies during calamities. This is a big boost to the capability of our Armed Forces,” added Mancita.
Mancita said that Hueys are the primary asset used in providing close-air support to operating ground troops during combat. He, however, stressed that same helicopters are used during disaster response and relief operations.
