Impeachment is once again in the mind of the Noynoy congressmen, this time their target is the Supreme Court (SC), through its justices.

The latest report on this issue is that Rep. Rudy Fariñas is moving to have the impeachment proceedings going against the high court justice who stood accused by Noynoy allies of plagiarism but was cleared by the high court itself.

But there is some kind of hidden agenda in that move to revive the impeachment complaint against the SC justice, given the fact that the SC and the executive have been at odds over the unprecedented budget control of Noynoy over the Judiciary hiring funds, which the high court justices, including the Office of the Ombudsman, the Commission on Elections and the Civil Service Commission are against, as their fiscal autonomy is constitutionally guaranteed.

Deputy Speaker Jesus Crispin Remulla was quoted as saying that there are also now moves to get SC Chief Justice Renato Corona impeached..... MORE

WASHINGTON — As a staff sergeant training to be an Air Force officer, David Hall had a promising career ahead of him until a fellow airman outed him as gay.

Nearly 10 years later, Hall said he hopes to rejoin the military that discharged him when a ban on openly gay and lesbian troops officially expires on Tuesday.

Hall, 37, has already put in phone calls to recruiters and said he will be celebrating on Tuesday that “the country as a whole realized that this was something that needed to go away.”

Years of legal battles and political activism — along with changing social attitudes and open policies among most Nato allies — paved the way for the change, which Congress approved in December..... MORE

NAYPYIDAW — Imposing bronze lions, the symbol of the ruling party, guard the entrance to Myanmar’s fledgling parliament in a sign of its domination by the military and its political allies.

The palatial building in the heart of Naypyidaw, a purpose-built capital constructed just five years ago, is the showpiece of a “roadmap to democracy” promised by the general who ruled for decades.

Inside the vast maze of marble-floored corridors, chandeliers and air-conditioned chambers, a sign proclaims: “People’s expectations, parliament’s implementation.”

Yet a quarter of the seats were reserved for the military even before landmark elections last year, and the junta-backed Union Solidarity and Development Party (USDP) holds about 80 percent of the remainder.

“Here we have no opposition party. All are colleagues. For us there is no opposition,” USDP Secretary General Htay Oo told a rare news conference at the parliament, which opened in January..... MORE

Even as we laud Speaker Sonny Belmonte and the members of the House of Representatives for passing the proposed P1.8 trillion 2012 budget earlier than expected, we cannot help but be saddened by their inability to overcome the executive department’s insistence in impounding parts of that budget. The power of the purse belongs exclusively to Congress. That power includes the sole discretion to firmly and properly indicate how public funds must and should be used. The same cannot be compromised in any manner or form much less outsourced, in its disposition to the executive. To do so is to render Congress inutile and is a throwback to what senior members of this administration have all been railing against during the Arroyo years – the complete domination of the handling of precious public funds by the executive via the much reviled re-enacted budget system. That was called then the total impoundment of public funds. Under P-Noy, the impounding is selective but equally as deadly and belies the administration’s claims of responsive and accountable governance. This practice is far from such good intentioned hype. It is out and out undemocratic and counter productive..... MORE

House threatens impeach moves against SC justices

By Charlie V. Manalo By Charlie V. Manalo 09/21/2011
Unprecedented and controversial moves by President Aquino to take control of the allocated budget hiring funds of some P101 billion from constitutional offices with guaranteed fiscal autonomy were followed by Aquino’s allies in the House of Representatives yesterday, as they too made another unprecedented move by threatening to file impeachment proceedings against high court justices who will vote against the House-passed Malacañang proposed budget that calls for Aquino’s impounding of the Judiciary’s hiring funds.

Apparently aware they have inserted an unconstitutional provision in the proposed 2012 national budget which would effectively allow the Executive Branch to impound the hiring budget of other government agencies including constitutional bodies which would expectedly merit an adverse ruling from the Supreme Court (SC), a senior member of the House of Representatives yesterday threatened members of the high court with impeachment should they rule against the provision for the P23 billion miscellaneous personnel benefits fund (MPBF) in the 2012 General Appropriations Act (GAA).

In a text message, Ilocos Norte Rep. Rodolfo Fariñas, vice chairman of the House justice committee, warned the SC that members of the House may go for impeaching the members of the SC should it declare the MPBF unconstitutional..... MORE

Palace at a loss on Garcia being at NBP not stockade

By Virgilio J. Bugaoisan 09/21/2011

The Palace yesterday cannot cite a law that would justify locking up former AFP Comptroller (ret.) Brig. Gen. Carlos Garcia in a civilian penal facility at the National Bilibid Prison (NBP) despite his being convicted by a military court, and instead resorted to citing a vague explanation about an alleged “exception” to the rule concerning the military justice system.

President Aquino’s deputy spokesman Abigail Valte could not cite any specific provision of the law or even the rules on military conduct that would allow the incarceration of Garcia at the NBP instead of being sent to the military stockade.

Despite being a lawyer, Valte told reporters yesterday that Garcia was sent to the NBP upon the advice of the lawyers of the Department of National Defense (DND) but could not say if those who issued the recommendation cited any provision of law that allows soldiers convicted in court martial proceeding to be jailed in a civilian jail.

Sen. Panfilo Lacson, who is a former Philippine National Police chief, raised the question on the basis of Garcia being incarcerated in a civilian jail while his conviction was on his court martial case..... MORE

Solon seeks probe of construction of coal-fired power plants

09/21/2011
Anakpawis Rep. Rafael Mariano is seeking a probe into numerous planned and ongoing construction of privately owned and operated coal-fired power plants in the country.

In House Resolution 1612, Mariano said the Aquino government is permitting the profileration of coal-fired plants as part of its long-term national energy plan and policy on Public-Private Partnership (PPP).
Under the Philippine Energy Plan (PEP) 2009 to 2030 crafted by the Department of Energy (DoE), the government has adopted the policy of accelerated exploration and development of coal resources to ensure energy security.

Under the Philippine Energy Contracting Round, the government continues to offer our national coal reserves to big local and foreign companies for explorations and production. It is targeting to increase the local production of coal by 250 percent by 2015 in order to meet the demands of increasing numbers of coal-fired power plants to be installed in Isabela, Zambales, Davao City, Davao del Sur, Sarangani province, Negros Oriental, Negros Occidental, General Santos City and Sultan Kudarat..... RH bill not likely to get House nod, says lawmaker

By Gerry Baldo and Charlie V. Manalo 09/21/2011
The controversial Reproductive Health bill, now pending before the House in plenary, is not likely to get the nod of Congress when it resumes next week.

According to Majority Leader Neptali Gonzales II of Mandaluyong City, Congress has to do some balancing acts during its deliberations where 25 lawmakers have signified their intention to argue for or against the bill. Others he said refuse to participate in the deliberations leaving a few warm bodies in the plenary hall.

“There is a lot of balancing acts here. You can’t just impose the rules. Pakisamahan talaga rito,” Gonzales said yesterday during the weekly Ugnayan sa Batasan media forum.

Gonzales explained that expediting the passage of the bill could be done by limiting the time of the interpellators who could also try to get even by questioning the quorum..... MORE

Palace asked: Hold hikes in LRT-MRT fares, toll rates

By Angie M. Rosales 09/21/2011

Senators, crossing party lines, have formally appealed to Malacañang to put off even in the meantime the planned simultaneous increase in fees of the Light Rail and Metro Rail Transit (LRT-MRT) and toll in the country’s expressways.

The initiative of Senators Manuel Villar Jr., Joker Arroyo and Ralph Recto was immediately given assurance of full support by no less than Senate President Juan Ponce Enrile while seven other colleagues moved to have themselves made co-authors of Resolution No. 602.

In filing the resolution, the original authors pointed out that public hearings conducted by the Senate economic affairs, public services and other appropriate committees on the provisional fare hike showed that “there is no need to increase this year the fares of MRT and LRT.”

“I will support it. The situation in the country is such as that there is too much burden on the public and I think that government must be ready to subsidize public services for the benefit of the poor and that is the same philosophy of the conditional cash transfer (CCT) — to subsidize the people who are not in the position to pay for themselves considering the cost of transportation in the country and the uncontrolled increase in the price of fuel for transportation. I think the government must sacrifice and be ready to subsidize the transportation needs of the people,” Enrile said in an interview with reporters..... MORE

Intensified campaign on smoking ban in Caloocan City nets 1,455 violators

The Caloocan City government has stepped up its campaign against smoking as it ordered the local law enforcement agencies to closely monitor public places that are covered by the law on tobacco regulation and spare no one who continues to defy the ban.

“The city government has committed itself to strictly carry out the law against smoking in all public places and I have ordered the concerned implementing authorities to make sure that it is being followed to the letter,” Mayor Enrico “Recom” Echiverri said.

The city government, according to the mayor, has been holding a series of seminars aimed at making the people aware of the harmful effects of cigarette smoking to one’s health.

Noynoy’s P1.8-trillion budget for 2012 breezed through the House, courtesy of Speaker Sonny Belmonte and the pork-starved allies and foes alike in the chamber, proving anew correct Ivan Pavlov’s theory on conditioning, using his dog.

In Pavlov’s experiment on conditioned reflexes, he noticed that dogs tended to salivate before food was actually delivered to their mouths, a reaction which he called “psychic secretion.”

By using a bell, Pavlov conditioned his dogs to associate its ringing with food and after some time, dogs already salivated upon hearing the bell, thus his classic findings about stimulating reflexes.

Budget Secretary Florencio Abad, on the other hand, similarly used the pork barrel as the stimulant bell for congressmen to pass the 2012 budget without any considerable trouble from them..... MORE

Noynoy flew to the United States Sunday to flaunt his “credentials” as a transparent leader and a “corruption fighter” who shares Washington’s “vision of accountability and good governance” in a New York forum which just launchedthe Open Government Partnership, apart from saying that he would be using his trip to get more foreign investments.

There is doubt that he can succeed at that, despite his propaganda machine daily churning out its mantra of the righteous path, accountability and transparency because most, if not all leaders, know that their speeches lead to nothing, except in trying to make themselves look good before the others.

Then too, most if not all these leaders and their aides, certainly know that despite all the talk about good governance, accountability and transparency, what they really do, especially in the case of Noynoy, is to pay lip service to all these.

The world was witness to the Aug. 23 Manila hostage crisis where Noynoy not only muffed it as a leader, but also really muffed up his claim of making officials involved in that botched hostage rescue accountable. Worse, this non-accountability marked in Noynoy’s administration has become even clearer with his penchant for protecting his KKKs (cronies, classmates and shooting buddies) while running after his political foes and engaging in trial and conviction by publicity, since there is little solid evidence presented against his foes..... As North Atlantic Treaty Organization(Nato) cheer leaders celebrated their apparent victory in Libya, former British Prime Minister Anthony Charles Lynton Blair indicated that he thought it might be a jolly good idea, as a next step, to have a spot of regime change in Syria and Iran.

As Western oil companies fly emissaries into Libya to claim their share of the spoils, it is worth remembering that Britain’s relations with Iran (formerly Persia) have also been dominated by that black substance, and Blair’s political forebears on both sides of the Atlantic have already demonstrated the perils of a foreign-backed coup in that country.

Although nominally independent, following World War II, Iran was under British influence, in particular due to the latter’s participation in the exploitation of its oil, a monopoly having been granted to British engineer William Knox D’Arcy in 1901. Oil was discovered two years later, and in 1905 D’Arcy became part-owner of the new British Oil Co. The British government bought D’Arcy out in 1908, and the Anglo-Persian Oil Co. was founded the following year. In 1923, it appointed Winston Churchill as a lobbyist..... MORE

SINGAPORE — A nearly illegible letter from almost two centuries ago is kept in a dim, cold room in downtown Singapore accessible only to a privileged few via an electronic swipe card.

“The Settlement I had the satisfaction to form in this very centrical and commanding station has had every success ... our Port is already crowded with shipping from all the native Ports in the Archipelago,” he wrote.

No. There is nothing comforting, much less funny about the above additional feature of this Gambling Republic. The news in big and bold letters was in fact just recently carried by a respectable national daily. Yes. This means the following: that the casinos in the country remain much alive and well; that the Philippine casinos are in reality for the patronage not only of foreigners but also in effect intended for the Filipino gamblers; that the same casinos are ably promoting the vice of gambling all over the land.

There is even the allegation made by gambling officials concerned that the casinos are closed to government officials. Those who know better are thus much amused by such promotional gambit of false self-righteousness. It is therefore understandable that they have a big laugh every time they are told of the alleged amusing Philippine Amusement and Gaming Corp. (Pagcor) norm or principle. This is why they shout back to said officials, “Tell it to the Martians!” It is true that some people can be fooled some time — but not all the people, all the time..... MORE

Solgen seeks suspension of DBP execs involved in Ongpin behest loan

By Benjamin B. Pulta 09/20/2011

More than a dozen incumbent officials of the Development Bank of the Philippines (DBP) face preventive suspension for their alleged part in facilitating the grant of a controversial P660 million “behest loan” to businessman Roberto Ongpin’s firm two years ago.

In an 11-page motion for reconsideration before the Office of the Ombudsman, Solicitor General Jose Anselmo Cadiz said the preventive suspension against 14 incumbent DBP offficials would “prevent them from using their position to influence potential witnesses or tamper the records which may be vital in the prosecution of the case” and stressed that the preventive suspension is warranted pending the preliminary investigation of the complaints for graft and violations of the banking laws filed against them, in connection with the questionable loans granted to Ongpin’s Delta Ventures Resources Inc. (DVRI).

“Respondents’ continued stay in office may prejudice the just, fair and independent disposition of the case filed against them. The allegations in the complaint and the documents attached thereto will readily show that the evidence of guilt against them is strong,” Cadiz, who has been designated by President Aquino as lead counsel of DBP in this case, told the Ombudsman..... RP shows progress in protecting women from violence in conflict areas

By Michaela P. del Callar 09/20/2011

The Philippines is one of the only two Asian countries dealing with insurgency that has showed progress in preventing violence against women in conflict areas, the United Nations said yesterday.

Nepal has joined the Philippines in successfully formulating a national action plan for women, peace and security in compliance with UN Security Council Resolution 1325, which addresses not only the undue influence of war on women, but also the integral role women should and do play in conflict management, conflict resolution, and sustainable peace.

Other conflict-affected countries, such as Afghanistan and Sri Lanka, were urged by the UN to push greater role for women in leadership, social development and conflict prevention.

“Countries across our vast and diverse region are at different stages of armed conflicts, some are in the midst of wars, others face post-conflict challenges. Yet at whatever stage in the process, the impact on women and their integral role in peace-building and recovery processes need to be highlighted,” said Ethel Sigimanu, permanent secretary, Ministry of Women, Youth and Children Affairs of Solomon Islands, who chaired the inaugural meeting of the Asia-Pacific Regional Advisory Group on Women, Peace and Security last week in Bangkok..... Purisima’s peso sabotage

DIE HARD III
Herman Tiu Laurel
09/19/2011
Just when the Bangko Sentral ng Pilipinas (BSP) has finally found its bearings, certain quarters are again dead set on pushing it off track. Misgivings aside, I have lately begun to appreciate certain BSP top officials’ burgeoning initiative to get the management of our currency and debt back along the lines of national welfare and interest. The BSP just recently recommended to Malacañang its preference for borrowing locally (instead of internationally) to accelerate the prepayment of debts and to “help temper the appreciation of the peso” vis-à-vis stimulating demand for the dollar.

The country’s Gross International Reserves (GIR) jumped 51 percent from $49.95 billion to $75.6 billion year-on-year, with our foreign debt standing at around $60 billion. The Philippines is thus awash with dollars as well as in loanable funds in the Special Deposit Account (SDA) maintained by the BSP, all waiting to be mobilized in lieu of more foreign borrowings in the rolling over of debts or in the funding of PeNoy’s public-private partnership (PPP) projects in infrastructure and others.

The BSP is picking up the wisdom of the way in which many in the private sector are handling their own dollar debts. While the PeNoy government’s prepayment of foreign loans slipped in the first half of the year, with prepayments of medium and long-term foreign loans summed up to $530.9 million or 3.19 percent lower than the $548.4 million recorded in the same period last year, newspapers report that “All prepayments were made by the private sector.”

We have been reading of different major private corporations prepaying foreign loans. And for anyone seeking to avoid the burden and volatility of interest payments amid the currency crisis, this is the only way to go.

Unfortunately, Cesar Purisima (PeNoy’s Finance secretary and also Gloria Arroyo’s), gave the already scheduled prepayment of debts his “thumbs down.” How are we then to perceive such stonewalling of the proposal that many concerned sectors of our economy, led by the BSP, push for?

OFWs, being the largest contributors to the survival and viability of the Philippine economy, have remitted up to $21 billion annually as of last count. Yet the dollars they send to their families, coursed through the BSP, are yielding fewer and fewer pesos; this, as the US currency is being propped up by Purisima’s policy of accumulating more dollars in our vaults.

The export sector, which has just lost another 10 percent in value in the latest reported data, has also been howling in pain over the massive weakening of exports due to the strengthening peso. The BPOs, including call centers and other service providers, have also lost half of their income due to the peso’s appreciation.
Purisima, in his defense, remarked, “Of course we are amenable to debt prepayments but it is a question of opportunity because bulk of our debts is publicly traded already and if their prices are very high it will not make sense for us to prepay… All of these are long-term and very low cost, so it does not make sense at this point to prepay also.”

In response, this was what our Wednesday radio co-host Liza Gaspar, a young UP finance graduate, had to say: “Purisima seems to be looking at the issue only in financial terms; he seems to forget the more positive and concrete impact of cutting the debt (is) in terms of savings on interest payments and principal that could be redirected toward productive enterprises.”

Gaspar clearly makes more sense than the one-time SGV and Hyatt 10 head. Still, we shouldn’t fault Purisima too much as he recognizes only the foreign financial interests as his bosses.

If PeNoy has any idea on the matter at all, which isn’t likely, the conflict from within his financial team seems to be erupting right under his nose. Well, it’s not like he has taken any interest in it at all, which is tragic, as the matter of finance has become the central component in the governance of nations.

Former President Joseph Estrada, who admits to being a novice on international finance, says he resolved such issues during his time by getting members of his financial team face each other off in serious debate while he listened. Then, if a consensus is not achieved, a vote is soon called. But for PeNoy, it seems that, like many other things under his governance, he has allowed Purisima to simply call the shots, even as the Finance secretary already seems to be sabotaging the Philippine peso in the course of propping up the US dollar.

Of course, there is another dimension to the financial and currency issue that is beyond the scope of this column — the restoration of “currency and capital controls” as well as the “nationalization” of the entire banking sector, which the country had in the time of President Carlos Garcia. It is the final solution to the perennial problem of peso volatility that perpetually rocks the economy. That will be the next stage of the debate.

The strike called by jeepney drivers and operators today is expected to be a mere preview of bigger protest movements expected as a result of high prices under the Noynoy presidency. Holding the protestors accountable for their responsibilities and their actions’ supposed effects on commuters is a wrong move that will backfire on Noynoy. It may even encourage more people to join the next scheduled protest rally.

High prices are not the problem of only jeepney drivers but every ordinary man on the street and threats on one group protesting the spiraling cost of basic commodities and services will be taken as Noynoy’s failure to connect with reality.

Representatives of public transport groups met with Noynoy last Friday and evidently Noynoy offered nothing to soothe the feelings of complaining drivers and operators. The immediate response from Noy was a reminder about the responsibilities attached to franchises, implying that these may be revoked for those who will join today’s protest actions..... MORE

Predictably, the House of Representatives passed on second reading the 2012 national budget as is, and the way Malacañang wants it — no cuts with everything remaining as Noynoy says it should be.

Chances are high that the Senate will do the same, or at least, Noynoy allies will again resort to stating that the controversial items are to be resolved in the bicameral committee, which means that the budget will pass as is, because the Noynoy allies will be dominating the bicam and do nothing to resolve the controversial provisions, such as Noynoy’s control over the judiciary funds, as well as hiring funds of the other constitutional offices, despite its unconstitutional flavor.

But what if the majority of the senators, who are non-Liberal Party members, insist on questioning the budget and not moving to pass it?

If such becomes the scenario, the bill gets frozen in the Senate, which means that at a certain time, the old budget becomes operational, which may be just what Noynoy and his Butch Abad really want to happen, next year leading straight into an election year..... MORE

SINGAPORE — Singapore is coming under mounting pressure to ease political restrictions after neighboring Malaysia unveiled steps to abolish tough security laws and ease media and protest regulations.

Human rights and opposition groups say Singapore needs to keep up with the times and abolish the Internal Security Act (ISA), which allows for detention without trial and is seen by critics as an instrument to stifle dissent.

In a surprise move, Malaysian Prime Minister Najib Razak said last week his government would scrap the ISA and ease other laws perceived as curbs on civil liberties, including protest rules and annual newspaper licensing.

But Singapore insists the ISA, which was used against leftists in the past and suspected Islamic extremists in recent years, remains relevant and maintains that media regulations are needed to preserve social cohesion..... MORE

In its last six months in power, the Arroyo administration spent almost P7.5 billion of taxpayers’ money for a “farm-to-market” road project that did not even have a work program, Sen. Franklin Drilon said yesterday.
Drilon added the oversight committee on public expend-itures uncovered these alleged fund releases to the Department of Agriculture (DA) following the submission of various agencies of their respective liquidation reports recently.

“We are deter-mining if the funds went to a ‘farm-to-pocket roads,’ ‘roads to my farm’ project or nothing has happened at all,” Drilon said.

Former Autonomous Region in Muslim Mindanao (ARMM) Gov. Zaldy Ampatuan, currently detained for his alleged involvement in the November 2009 Maguindanao massacre, also had squealed about Arroyo receiving around P200 million in kickbacks from farm-to-market road projects in 2008 and 2009..... MORE

Illegal recruitment firms continue to offer non-existent jobs to Filipinos in strife-torn Afghanistan and Iraq amid an existing government deployment ban in the two countries.

Recruitment firms have expanded their operations in some Philippine provinces and in the United Arab Emirates two weeks after Malacañang announced a partial lifting of the ban, said recruitment consultant Emmanuel Geslani.

Only those Filipinos currently employed in Afghanistan and Iraq will be allowed to work there until their contracts are terminated by their employers.

“The deployment of new workers to both countries is still banned,” Geslani stressed. “The public is hereby warned that recruitment agencies are not offering new jobs in Iraq and Afghanistan and be wary of illegal recruiters offering non-existent jobs in both countries.”... MORE

Far Eastern University averted a major endgame collapse with sheer tenacity off the boards in its last offensive to turn back a hard-fighting Adamson U, 78-74, yesterday and earn the right to face Ateneo de Manila in the Finals of the UAAP men’s basketball tournament at the Smart Araneta Coliseum.

With the Falcons threatening to complete a splendid rally from 11 points down going into the last two minutes, the Tamaraws protected a 74-72 lead with three offensive rebounds, allowing them to waste the remaining 51.2 seconds and preserve the win fashioned out before a jampacked Cubao arena.

Thus, the less-seeded Tamaraws, who had to prevail over the Falcons twice, return to the Finals against the Blue Eagles on Saturday and will seek their first UAAP title since their Grand Slam run from 2003 to 2005 during the Arwind Santos era..... MORE

BUNAWAN, Agusan del Sur — A monster crocodile which is reputedly the world’s largest is the star attraction at its own nature park which opened in the Philippines this weekend, weeks after the beast’s capture.

People are already paying P20 (46 cents) to enter the compound in the town of Bunawan for a look at the 21-foot (6.4-meter) male saltwater crocodile which is believed to have killed two people.

Bunawan Mayor Edwin Elorde hopes to have another attraction soon: a reportedly even larger crocodile that was sighted by residents of this largely rural town on the southern island of Mindanao.

Noynoy is again off to the United States and the highlight of his visit would be a speech delivered before a forum to launch to Open Government Partnership initiative in the United States. The program involves several countries that would commit transparency in government.

Noynoy would definitely be a square peg in the conference despite his pro-democracy image for one sole reason: His administration has refused to give priority to the long-pending Freedom of Information (FoI) bill in Congress.

The passing of such bills among signatory countries are essentially the bone of the launching of the private initiative. The Philippines remains among the exceptionally few countries that still do not have an open records law that would compel the government to disclose documents. The FoI bill has been languishing in Congress for the past 15 years.

The last time that the bill had a chance of making it into a law was last year when the bill was killed savagely by a lack of quorum in the House of Representatives..... MORE

Ombudsman Conchita Carpio-Morales, a former associate justice of the Supreme Court (SC), in her bid to revive the plunder case against former Maj. Gen. Carlos Garcia while seeking the court’s reversal of the plea bargain agreement entered into between Garcia and Morales’ office, is in essence asking the Sandiganbayan to violate the principle of double jeopardy.

Wrong Sandiganbayan decision or no, the fact remains that Garcia, after agreeing to the plea bargain, was arraigned and convicted on a lesser charge of direct bribery and money laundering, which means that the plunder case no longer applies to him.

To revive the plunder case against Garcia would then have to be a matter of double jeopardy, yet this long held principle is what a former SC justice wants done by the court.

Such a judicial mistake was already committed during the tenure of Noynoy’s mother, Cory Aquino, when, shortly after the 1986 Edsa revolt that catapulted her to the presidency, the already acquitted soldiers who stood accused of having planned and executed the assassination of Ninoy Aquino at the airport, were again tried for the same crime before the same Sandiganbayan, as approved by the high court and in a particularly political partisan atmosphere, then with newly appointed Aquino justices who then convicted the already acquitted soldiers..... CCTs: Expensive, short-sighted and artificial

CCTs: Expensive, short-sighted and artificial

The Aquino administration seeks a bigger budget for a program that is criticized as a poor cornerstone in the drive against poverty.
By SONNY AFRICA
IBON research head
IBON Features/ September 2011
IBON Features— The Aquino administration is currently seeking an 86%-budget increase for its multi-billion peso conditional cash transfer (CCT) program. But while the program admittedly has a feel-good factor, it is a problematic approach to reducing poverty in the country.

The administration itself sets a high standard for the CCT program. Its economic blueprint, the Philippine Development Plan (PDP) 2011-2016, declares: “Direct CCTs to the poor through the Pantawid Pamilyang Pilipino Program shall be the cornerstone of the government’s strategy to fight poverty and attain the MDGs.” Unfortunately this is a poor cornerstone and the program is a weak foundation in the drive against poverty in the country. Five major concerns can be raised.

First, the program is a one-shot affair that peaks in 2013 and is virtually over after 2018. The 320,411 household beneficiaries in the first year of formal implementation in 2008 rises to 4 million in 2014 and then falls just as quickly to some 350,000 in 2018. Households can only be enrolled in the program for up to five years and it is expected that a total of 4.6 million beneficiary families will have been reached over the entire program. Perhaps not coincidentally, the peak of program implementation in 2014 happens right before assessment of the country’s Millennium Development Goal (MDG) performance in 2015..... MORE

Filing of ‘trumped-up charges’ vs activists continue under Aquino

Karapatan stressed that the president is capable of releasing political prisoners as he did when he released rebel soldiers. “All he has to have is the political will to release those who are wrongly imprisoned.” – Marie Hilao-Enriquez, Karapatan.
By RONALYN V. OLEA
Bulatlat.com

MANILA – Seventy-seven activists have been charged with fabricated charges under the new Aquino administration, according to human rights group Karapatan.

Karapatan said of the 360 political prisoners all over the country, 77 were arrested under the Aquino administration, 247 during the Arroyo administration and 21 before the Arroyo administration. Thirty are women, 11 belong to the elderly and 28 are sick, Karapatan records show.

The group, along with Samahan ng Ex-detainees laban sa Detensyon at Aresto (Selda), joined the fasting staged by hundreds of political prisoners from various detention cells beginning Sept. 13.

“Among the notorious legacies of the Marcos dictatorship was the illegal arrest and detention of political prisoners who fought against the corrupt and repressive regime. Such reality exists to this day, with 360 political prisoners languishing in jails for fabricated and trumped-up charges because of the exercise of their political beliefs that run counter to those of the powers running our government,” Angie Ipong, former political prisoner and Selda secretary general, said.

“President Aquino should look at the mirror of history twice when he likens activist organizations to a dictatorship. His administration is actually carrying on the more vivid legacy of a dictatorship with such rights violations under his term,” Ipong said, referring to Aquino’s remarks against the League of Filipino Students (LFS) in his recent speech.

This is the second time political prisoners and their supporters held a fast to demand for general, unconditional and omnibus amnesty. The first was held in July in time for President Aquino’s second State of the Nation Address (Sona).

Karapatan stressed that the president is capable of releasing political prisoners as he did when he released rebel soldiers. “All he has to have is the political will to release those who are wrongly imprisoned,” Marie Hilao-Enriquez, Karapatan chairwoman, said.

Under Aquino, only six political prisoners have so far been released, including Ipong, and consultants of the National Democratic Front of the Philippines (NDFP) namely Jovencio Balweg, Jaime Soledad, Glicerio Pernia and Maria Luisa Purcray. Multiple common crimes filed against them have been dismissed.

In a message, Sandino Esguerra, a political prisoner who has been detained for more than ten years at Camp Bagong Diwa in Taguig City, said Aquino “has no reason not to heed their demand for freedom.”

Emeterio Antalan, another political prisoner detained at Camp Bagong Diwa, said, “In the name of matuwid na daan (straight path), Aquino must release political prisoners.”

Criminalizing activism

“The political prisoners are falsely accused of crimes they have not committed, contrary to Aquino’s continued mantra that his government is for human rights,” Enriquez said.

Enriquez said such practice intends “to hide the government’s political persecution of those it labels as enemies of the state.”.... MORE

President P-Noy is busy opening “cans of worms” —a full stack of it — of the past administration and it would seem that not even a single case would convict the Arroyos or their cohorts and accomplices in the remaining five years of his watch. Definitely, potholes and distractions to an otherwise smooth transition and progress.

In the meantime, being an intelligent politician that he is, Vice-President Jejomar Binay declared openly and as early as now his intention of transiting from the Coconut Palace to Malacañang Palace in 2016. It is a preemptive and clever move.

Preemptive in a sense that henceforth the Vice-President would have his eyes on the ball being dribbled by the Aquino administration. Being a prospective president, he would make sure that the Aquino cohorts should tread the Daang Matuwid (the path of righteousness) of P-Noy the next 1765 days so as not to be bothered by the grueling task of stepping on and cleaning the trash of corruption of a past administration, as P-Noy is now on the Arroyos. While the present administration may neither claim proven competence nor pursuant admirable accomplishments, and while the national leadership still remains far from achieving its gloriously proclaimed mission and agenda, there is, however, a distinct laurel in its promotional administrative staff. This: The choice of a spokesman who has long since proven herself to be not only intelligent but also calm and practical in answering both easy and difficult questions repeatedly thrown at her direction. Probably unnoticed and unsaid, she is one established asset in the ruling government.

This is why there are those who say — and correctly so — that she has proven herself to be good and effective buffer for the disturbing mystery and dismaying enigma behind the personality and character of her protégé. It is not easy to speak for, defend and promote the highest public official in the land who is saddled with a good number of persisting doubts and questions — particularly so about his ability and industry. In short, it is not easy to speak on behalf of the same national figure with all its known personal liabilities and consequent lackluster executive performance..... MORE

Temperature range: Minority mulls SC appeal

By Charlie V. Manalo 09/18/2011

The House minority and members of the progressive bloc in the lower chamber branded the approval late Friday night of the proposed P1.816-trillion 2012 budget on second reading as rushed “exactly the same way as in the previous administration,” with them raising the possibility of questioning the approved Appropriations Act before the Supreme Court.

The budget passing second reading is as good as approved since a third reading will be mere formalities.
Voting viva voce, the House passed on second reading House Bill 5023, otherwise known as the General Appropriations Bill, but in his turno en contra speech, Bayan Muna Rep. Teodoro Casiño denounced the proposed budget, saying it does not address the fundamental problems of chronic poverty and underdevelopment and instead reduces the national budget into an instrument of doleouts and the privatization of basic social services.

An obviously elated Speaker Feliciano Belmonte, nevertheless, described the budget as being “grounded on the realities” of the national and global economy..... MORE

By Gina Peralta-Elorde 09/18/2011
A lawmaker has called on the Department of Foreign Affairs (DFA) to provide more details surrounding the fate of a murdered overseas Filipino worker (OFW) whose remains with missing body parts arrived home early this month.

Sen. Manuel Villar noted that Romilyn Ibañez’s repatriated body was missing a tongue and an eye, a fact that brought even more pain and sadness to her family.

He also pointed out that it took a year for the Philippine Embassy in Saudi Arabia to work for the repatriation of Ibañez’s remains, and the DFA has not been forthcoming with any explanation as to the delay.

“For the family’s peace of mind and in the name of justice, I join the different non-government groups in calling on the Department of Foreign Affairs to reveal the forensic and police reports surrounding Ibañez’s gruesome death,” Villar, in a statement, said..... MORE

Department of Education (DepEd) said that they are now mapping out a more comprehensive child protection policy to protect pupils against bullying, abuse, exploitation and discrimination in school.

Education Secretary Armin Luistro said DepEd has started consultations with teachers and other stakeholders on the policy.

“This is a serious matter that we cannot put off nor delay because it involves the over-all well-being of our learners which when not addressed promptly may negatively affect them for life,” Luistro said.

Luistro also reminded school personnel and the public that corporal punishment and violence in any form is not allowed in public schools, whether by adults or the children’s peers..... MORE

Supreme Court upholds CA ruling on Roxas land exemption from CARP

By Benjamin B. Pulta 09/18/2011

A ruling by the Supreme Court (SC) has upheld the exemption of 27 parcels of land from the government’s agrarian reform program after they were converted into residential areas by the owners.

In its decision, the tribunal’s First Division Associate Justice Mariano Del Castillo denied the petition filed by farmers questioning the decision of the Court of Appeals (CA) in favor of Roxas & Co. Inc.

The farmers had filed the petition for review before the SC challenging a decision dated April 29, 2005 of the Court of Appeals (CA). The CA order had dismissed the petition for certiorari which assailed the Department of Agrarian Reform’s granting Roxas & Co. Inc.’s Application for Exemption from the Comprehensive Agrarian Reform Program’s (CARP) coverage..... MORE

Aquino asked to release woman political prisoners

By Jason Faustino 09/18/2011
Tanggol Bayi, an organization of woman human rights defenders, yesterday called for the immediate release of all political prisoners, especially woman political prisoners, the elderly and sickly ones, as it joined the families and friends of political prisoners in a henna tattoo and facepainting activity at the Quezon Memorial Circle.

Cristina Palabay, convenor of Tanggol Bayi, said there are currently 30 woman political prisoners among the 360 political prisoners who are at present detained in various jail facilities.

“Many of them were charged with fabricated charges of rebellion and criminal offenses in the course of their work and advocacies as woman human rights defenders when they questioned and became vocal and active critics of government policies and programs. It is lamentable that the political persecution, repression, state violence and militarism against woman human rights defenders continue, from the martial law period up to the present administration,” Palabay said..... Lawmaker throws support to transport strike tomorrow vs excessive oil prices 09/18/2011

Lawmaker throws support to transport strike tomorrow vs excessive oil prices

09/18/2011
Anakpawis Party-list Rep. Rafael Mariano yesterday expressed full support to the upcoming transport and people’s protest tomorrow against excessive oil prices. Anakpawis’ member organization Piston-KMU will lead the Tigil Pasada in National Capital Region and major cities nationwide.

“The transport sector, workers, farmers, fisherfolk and consumers affected by high oil prices have all the reasons to protest against high oil prices, the greedy oil companies and the Aquino government’s callousness over the highly sensitive issue of oil price hikes,” Mariano said.

“Political actions such as strikes and protests are necessary to show the people’s opposition to the monopoly operations of the foreign oil cartel. The abusive and burdensome series of oil price hikes is now further fueling the intensifying anger of Filipino people already disillusioned with Aquino’s “Daang Matuwid,” said Mariano who also lambasted the Philippine National Police (PNP) for its “overkill preparations” for the transport strike.

“Creating an inter-agency task force and fielding of 5,000 cops on the day of the people’s protest is ‘overkill’ — an indication that the government is ready to avert legitimate people’s actions but won’t lift a finger against oil companies,” Mariano said..... MORE
