No wonder reporters covering the House of Representatives feel hopeless that improvement could be effected on the operations of the Media Relations Services of the Public Relations and Information Bureau of the HoR as based on the allegations raised by some of the MRS staff themselves that their office is being run like hell.

Thanks but no thanks to MRS Director Celine Buencamino whom her staff claims reports for work very late in the afternoon, her office produces press release which are either eons old as most of the media entities have already ran those stories, or releases which contain factual errors. And since she is not around most of the time as her critics allege, then the responsibility to oversee the operations in her office should fall under the watchful eye of her OIC, Lorelei Castillo.

But apparently, Lorelei does not give a damn. In fact, this Celine – Lorelei has not even lifted a finger on the allegations that some of her staff had engaged in money-making ventures using official government time and resources.

According to members of the MRS who had lodged a complaint against the duo, their favored staff has for decades, used the MRS office equipment for personal money-making ventures, even soliciting money, laptops, etc., in exchange for institutional photos or press releases, which are part of their official duties. In short, they are now acting as official PRs of some of the lawmakers!.... MORE

The time and occasion eventually come when such is taken away from you — like it or not. Whereas bare fisted you came into the world, so too will your hands be empty when you leave it behind. This is lasting truth. This is standing reality. This is abiding experience.

It is during the present history of this nation when the principle and application of “Payback Time” becomes more significant, relevant and realistic. The former lords and masters are now under the rule and call of their previous servants and slaves. This is the standard eventuality when those previously wielding public power and might used these to serve themselves, their families and friends — not to promote the good or enhance the welfare of those who unwisely or unwillingly entrusted the exercise of governance to them..... In a bid to force its invited “resource persons” to state that it is former First Gentleman (FFG) Jose Miguel “Mike” Arroyo who is the real owner of four helicopters, two of which were sold as brand new to the Philippine National Police (PNP), senators yesterday moved to cite in contempt, ordered the arrest and indefinite detention of LTA Inc., former bookeeper Rowena del Rosario even before the hearing ended “until she purges herself of the contempt citation,” and presumably, to force her to give the senators the answers they want to substantiate their allegations against the Arroyos.

Charges that FFG owned the helicopters and not leased them were revived by bringing up the old charges of Arroyo being the real “Jose Pidal” with brother Rep. Ignacio “Iggy” Arroyo taking the fall for his brother, with the presentation of former police Chief Supt. Restituto Mosqueda, who claimed that Mike Arroyo is the real owner of the multimillion-peso “Jose Pidal” account.

Mosqueda, who eight years ago, first appeared in the Senate in 2003 as PNP crime laboratory director claiming that Iggy’s signature matched that of bank documents pertaining to the Pidal account, now claims that which they examined was a specimen produced by Iggy at that time..... MORE

Bureau of Customs (BoC) Commissioner Angelito Alvarez will be facing another congressional probe, this time for failing to act on a recommendation submitted to him by his subordinates urging him to run after an oil firm which allegedly defrauded the government of nearly P1.6 billion in tax payments.

In a press briefing, Zambales Rep. Milagros “Mitos” Magsaysay hit Alvarez, who was earlier questioned for the mysterious disappearance of around 2,00 container vans containing highly dutiable goods while en route from the Port of Manila (PoM) and the Manila International Container Port (MICP) to the Port of Batangas and for sacking senior Customs officials who recommended the filing of legal action against Pilipinas Shell Petroleum Corp.(Shell) for misdeclaration of shipment and non-payment of excise and value added taxes.

Magsaysay claimed the government lost P1,578,269,755 from July, 2010 up to the present.

In filing House Resolution 1643, entitled “A Resolution urging the committee on ways and means of the House of Representatives to immediately conduct an inquiry in aid of legislation into the issues that surround the unabated smuggling activities of Shell and the its failure to pay the appropriate taxes and duties amounting to several billions of pesos to the government and to look into the failure of Customs and BIR officials to take action and necessary steps to run after Shell thereby causing prejudice and undue injury to government in not being able to collect this much needed revenue..... Department of Public Works and Highways (DPWH) officer in Region X cited 16 defective portions of the three road projects built by Hanjin Heavy Industries and Construction Company Limited in Lanao del Norte province for the past years.

Khalil Sultan, DPWH Region X officer, discovered the defective roads following the inspection conducted by DPWH, together with the provincial and Oriental Consultant International and Hanjin inspection teams, based on the complaints aired by the residents, local and provincial leaders and commuters.

Hanjin Co. constructed the Metro Iligan Regional Infrastructure Development Project (MIRIDP), about 55 kilometers stretch from Tagoloan to Linamon town, covering the interior towns of the province. The road project also was in preparation for the construction and completion of Metro Iligan Agri-Industrial Center (MIRAIC), an agri-industrial manufacturing plant located in Linamon, to pump prime the economic development of the province and the safe passage of commuters as well.

Sultan’s recommendation to Hanjin Co. that it should renovate and restore the destroyed portions of the road projects as it is their obligation to do it based on the memorandum of agreement (MoA) entered into between Lanao del Norte provincial government and Hanjin Co. which is to maintain the road projects for at least one year..... Bank lawyer Zenaida Ongkiko-Acorda said parties in the ongoing investigation of behest loans granted by the Development Bank of the Philippines (DBP) during the last administration should squarely answer the charges against them.

In a statement, Acorda said: “It is truly lamentable that the P660 million loans which were extended by DBP’s officers to the company of Mr. Ongpin ended up enriching some private individuals who wished to engage in speculative stock trading.”

“These P660 million loans could have instead been utilized to help farmers, small entrepreneurs, microenterprises, cooperatives and farmers’ associations which could have availed themselves of loans for microfinance, agricultural and livelihood projects and other projects that could have furthered the developmental goals of DBP.”

The City Council of Manila is ready to pass an ordinance aimed at protecting the children from irresponsible parents for not taking care of their kids.

Councilor Rod Lacsamana, (2nd District, Manila), said the ordinance, which he is the author, was passed on third and final reading of the Manila City Council.

Known as the “Anti-child Endangerment Law,” the ordinance sought to punish a person who abandons or exposes a minor child to a perilous situation that endangers his life, health, or well-being.

“This law speaks for itself and sends a stern warning to irresponsible or uncaring parents or guardians of their children. Thus, no child can even be subjected to the hazard of traffic scenes and polluted conditions because if their parents or guardians neglected their roles to take good care of the child they can be held liable,” Lacsamana said..... A ruling by the Court of Appeals (CA) has directed the Regional Trial Court of Makati City to allow the incumbent administration of the Philippine Charity Sweepstakes Office (PCSO) a chance to justify its decision to scuttle the P4.4 billion joint venture agreement that the past administration entered into with an Australian firm.

In a 16-page ruling penned by Associate Justice Rosmari Carandang, the CA’s Ninth Division also declared null and void the temporary restraining order (TRO) that the Makati RTC issued last April 13 in favor of TMA Australia Pty Ltd. which had a deal with the past administration to put up a first thermal coating plant in the country.

Seven summonses, together with the complaint and its annexes were served to petitioners PCSO chaired by Margarita Juico, members of the Board and the general manager through the Office of the Government Corporate Counsel (OGCC), being the principal law office of government-owned and controlled corporations (OGCC).

The CA agreed with the PCSO that while the OGCC is the principal law office of PCSO, it is not authorized to receive summons in PCSO’s behalf, as well as the members of its board and its general manager..... MORE

Of ‘ratings’ and ‘news’ agencies

Ratings agencies are the financial world’s equivalent of today’s global “fashion dictators,” from Gucci, Dior, to Louis Vuitton, who decide what’s in and hot from the ramps of Paris or Milan. In the same way that fashion aficionados look to these luxury brands for the latest trends, presented in glossy sheen by the leading magazines, high-end department stores, boutiques, and celebrity “fashionistas,” ratings agencies are dutifully followed by the investment world’s big and small fund speculators, investors, and banks.

Down a rung or two, so-called “pirates” — both fashion and financial — from Hong Kong, Bangkok, Shenzhen, or Manila always keep a close watch to get their new line of pirated designs or passed down prognoses of financial ratings agencies, which then enable them to partake of the “killing.”

For them to succeed in mesmerizing the masses whose pockets are the goal, the global mass media is indispensable. Day in and day out, this mass media churns out fashion and financial glitter to keep audiences in rapt embrace.

While I have not followed the fashion scene for quite some time, I get the impression that the dearth of new names making an impact both here and abroad may well be one of the signs of the times of declining economic fortunes and increasing misery.

As I have been following more closely the financial ratings agencies, I have helped in aggressively debunking the myth of their validity, reliability, and relevance for real financial and economic evaluation of the global and national economy. In fact, this space is only one of the very few critical of the so-called big three — Moody’s, Standard and Poor’s, and Fitch Ratings — which mainstream business media consider as the gods of their financial Mount Olympus.

In the past decade, we were among the few voices in the wilderness on this matter; but ever since the Global Financial Crash of ‘08, where these ratings agencies still spouted rosy prognoses of Lehman Brothers, Bear Stearns, AIG, and other financial houses the day before the sky fell on them, the world’s view of them have already taken a negative turn.

For sure, Standard and Poor’s credit downgrade of the US a week ago while Obama and the Republican-dominated House were in the thick of their “debt cap” debates has not helped either, especially since Moody’s and Fitch weighed in with their positive ratings just a few days after American political and financial authorities raised their vehement objections.

As I have written before, both China and Europe have since reacted against these ratings agencies. China set up its own called Dagong after declaring the traditional ratings agencies as “unreliable,” whereas Europe threatened to establish its own after the big three downgraded Portugal and Spain’s credit-worthiness at a crucial moment of the EU (European Union)’s recovery economic efforts. As these ratings agencies are now in disarray, all we can say is “Good riddance!”

Similarly, we also want to call attention to the western “international” news agencies such as Reuters, Associated Press (both British), and Agence France Presse (French). Like the top fashion houses, these major news wires practically dictate the world’s news trends and, when they choose, even the direction of national news stories.

Many Filipino newspapers, broadcast networks, and news writers take these major news wires’ reports as gospel truth and repeat whatever is fed to them over and over until every Juan, Pedro and Maria believe these to be gospel truth.

Let’s take the latest news from the Associated Press (AP) about Libya where its headline says, “Libyan rebels: Key city, oil terminal seized,” as well as Reuters’ “Libya rebels strategic town (Zawiyah) near Triopli” and Agence France Presse (AFP)’s “Fighting erupts in Tripoli as rebels say regime is doomed,” all of which are not balanced by news such as those coming from Russia Today (RT) on statements by the Libyan government’s official spokesman belying these claims, which are never reported by the three major Western news agencies.

Each morning, after perusing all the major national newspapers on the Internet, I shift to reading Press TV (official news wire of Iran), RT (Russian cable news), Prison Planet (a dissident Web site in the US), GlobalResearch or the Centre for Research on Globalization (an anti-globalist Web site), China Daily, and Asia Times. When I turn on my Destiny Cable, I go immediately to RT and CCTV 9, and only scan CNN, BBC and Al Jazeera briefly. You’d be surprised at the utter Western media bias. For example, it is only from RT that I get this report:

“Independent journalist Lizzie Phelan says the reports are an effort by Natp to create panic. ‘The only gunfire that we are hearing is celebratory gunfire,’ she said. ‘And the only explosions that we are hearing are Nato air strikes or Natp sound bombs, which are clearly designed to create a sense of panic in… Tripoli.’
Phelan said that the Libyan rebels created fake footage of themselves in Zawiyah and Tripoli, and were aided in disseminating the footage by, among other media outlets, Al Jazeera. The Qatar-based satellite television station… has been at the center of the media conspiracy against Libya. The Western mainstream media, she continued, in turn picked up these reports and repeated them, creating a sense of panic among the Libyan people. Later… a number of armed gangs emerged… sleeper cells of rebels… (which) began firing randomly and threatening ordinary people… ‘They then took footage of the empty streets, which created the sense that they were in the process of capturing the city.’”

Al Jazeera, financed by a Western-controlled potentate, the Emir of Qatar, has been at the forefront of the disinformation campaign against Libya, starting with the fake news of Gaddafi’s jets bombing demonstrators back in February — news which CNN and BBC then repeated endlessly. Like fashion czars and financial ratings agencies of the West, these major news wires are mere tools of foreign financial predators. Time for the public to wake up!

There was a time in the past when Aug. 21 was etched in every Filipino’s mind and was marked in the calendar by those in power as a day to prepare for massive protests for a generation under the rule of former strongman Ferdinand Marcos, not only because it marked the assassination of Ninoy Aquino in 1983 but also because of the treacherous bombing of the Liberal Party convention at Plaza Miranda in 1971.

Both tragic pages in the country’s history were blamed on Marcos but to this day, the real perpetrators of these most celebrated crime incidences in the country have yet to be identified with only the pawns believed to have been sent in jail.

Comes the son, Noynoy, and half the world comprising the Chinese population has reasons to mark the day as the victims and relatives of those who were killed during the botched hostage rescue operation wait for their taste of justice, this time from the Philippine government after eight Hong Kong residents died from the hand of a disgruntled policeman who took them hostage on Aug. 23 last year.

For somebody who has supposedly been through the same ordeal in seeking justice for his father who died from the uncannily similar violent means, Noynoy is giving the relatives of the slain Hong Kongers strangely almost the same treatment that his family got from the Marcos government in those dark days of 1983..... Under the Noynoy dispensation, it certainly looks like the accused are being coerced into proving their innocence instead of their accusers proving their allegations, which contradicts the principle of the presumption of innocence.

This has been clearly noted in the Senate hearings, where some senators claim to come up with exposés, make their conclusions of guilt then demand that whoever they allege to have committed the “crime” comes forward to disprove their charges.

There went the Senate, after declaring Mike Arroyo guilty in the sale of the helicopters, pronouncing him to be the owner, and demanding that he appear before the Senate to disprove the allegations of ownership.

When Mike’s brother, Iggy, came forward to claim that it was LTA Inc. that leased the plane, the senators again demanded that he appears before the Senate to disprove the charges, even saying that if he does not, then it is clear that Mike Arroyo is the real owner of the helicopters. Huh? Is that the way for Senate “prosecutors” to prove their case? Duh..... MORE

We join the friends and associates of the respected and multi-awarded writer and editor, Kerima Polotan Tuvera, in prayers on her passing two days ago at the age of 85. Considered one of the best writers the country ever produced, she was the former editor-in-chief of Focus Philippines, a weekly magazine and the afternoon daily, Evening Post. One of her best known novels, Hand of the Enemy, earned plaudits in the international literary world. She will be best remembered not only as a writer par excellence but as a durable task master whose presence and patience helped start the careers of many of our writers today. She was married to another gifted writer, former Presidential Assistant Juan Tuvera by whom she had 10 children. Our condolences to the family.

Government chief peace negotiator Marvic Leonen yesterday said no peace deal will be signed in the next round of talks with Muslim rebels in Kuala Lumpur, Malaysia this week.

Even as President Aquino and Moro Islamic Liberation Front (MILF) chairman Al Haj Murad have pledged to accelerate the ongoing negotiations to conclude a final peace agreement during a surprise meeting in Tokyo, Japan last Aug. 4, Leonen said no accord will be hastily approved until provisions are thoroughly reviewed.

“We have learned from the lessons of the past and we will not repeat the same mistakes. I would like to emphasize that there is no ‘done deal,’” Leonen said. “The government panel is not going to Malaysia to sign a peace agreement.”

The Aug. 22 to 24 Malaysian-brokered talks would provide an opportunity for both sides to tackle substantial issues, including a rebel demand for an expanded Muslim autonomous region and larger access to revenues from natural resources in areas guerrillas want minority Muslims to control.....MORE

President Aquino, on the day marking the assassination of his father former Sen. Benigno “Ninoy” Aquino Jr., indicated interest in reopening the 1983 double-slay case of his father and the supposed assassin Ronaldo Galman, claiming that he knows who the culprit is who he said has not been held accountable yet in any court of law .

“I believe I know who it is. How can we (be) able to prove it up to the penultimate level? ‘That’s the issue,” he said.

Aquino also hinted that he is interested in running after several associates of former President Marcos
who may have something to do with Ninoy’s death but was not held accountable because they managed to slip out of the country and escaped prosecution. Aquino hinted that these “key personalities” have since returned to the Philippines and can be subjects of a re-investigation.

Among the Marcos associates who left the country after the Edsa revolution but are now in the country are former First Lady and now Ilocos Norte Rep. Imelda Romualdez-Marcos, daughter Imee who is now the Governor of Ilocos Norte and son Ferdinand Jr. who is now a Senator. Others include the Romualdezes who also occupy various elective posts..... House Speaker Feliciano Belmonte yesterday said that the House of Representatives is going to push through with the proposed amendments to the economic provisions of the Constitution even as an ongoing survey among lawmakers showed that there are currently 68 percent or 153 lawmakers who are in favor of amending the Charter.

Only 29.60 percent or 66 congressmen are against the proposal particularly on the question of timing. Four or 1.79 percent of the respondent-congressmen was undecided.

The lawmakers were responding to the question: “Do you agree it is time to amend only the Constitution’s economic provision?”

Facing possible dismissal for grave misconduct, grave abuse of authority, dereliction of duty, gross violation of Civil Service Commission (CSC) rules and regulations, the standard operating procedures on grievance of the House of Representatives and RA 6713 and harassment are MRS Director Celine Marie Flores Buencamino, MRS officer-in-charge Lorelei Castillo and MRS writer Eduardo Galvez.

The fact that the Anti-Money Laundering Council (AMLC) was looking into the supposed fat account of the Arroyo family’s LTA Inc., was not what had grabbed attention in the interview Ping Lacson gave about the offshoot of the ongoing used police helicopters probe but the possibility that the AMLC laid off the transactions of the Arroyo company.

This is enough reason for the Senate to hold a probe on the AMLC and its officials whose agency supposedly acts independently of the government, being under the Bangko Sentral ng Pilipinas (BSP).

Before the creation of the AMLC, the Philippines was placed by the Organization for Economic Cooperation and Development (OECD), the eminent organization of rich countries, on a money-laundering watch list and even threatened trade sanctions on the country for being a haven for dirty money.

What he says and what he does clearly do not speak of any kind of change and reform, as he keeps on appointing those who are deemed Noynoy and administration-friendly.
Translated, what Noynoy really wants are appointees whom he can rely on to do as he wishes.

In the case of the vacancy in the Ombudsman’s office, he appointed a former Supreme Court (SC) associate justice, Conchita Carpio-Morales, who is known to be anti-Gloria and therefore friendly to him.

What is being glossed over especially by the Yellow media that keep on claiming that Carpio-Morales is independent merely because her opinions in rulings went against the Arroyo administration, is the fact that from the time she was appointed by Gloria to the SC, to the time there was a falling out between the Arroyos and the law firm with which her cousin, SC Justice Antonio Carpio, is identified, most, if not all her decisions, were then favorable to the Arroyo administration..... It seems that the “sins” of Commissioner Angelito Alvarez are piling up. Aside from allegedly masterminding the loss of more than 3,000 containers vans coming from the Port of Manila and MICP, recently, at the hearing of the sub-committee on ways and means, it was found that Alvarez together with a deputy commissioner of customs and another official has accredited several customs bonded warehouses owned by a certain Tina Yu, Baby Reyes and a certain Big Mama that gave fake addresses to the bonded warehouses they claimed they owned. Call this gross negligence, incompetence or connivance with smugglers, Alvarez and company could not have accredited these bonded warehouses if they were doing their jobs right unless they in cahoots with these smugglers causing the release of about 3,000 containers where the government lost billions of pesos in forgone taxes and duties. It was said the goods loaded on the lost containers ended in these make-believe warehouses and can no longer be traced by the investigators because Alvarez and company allowed them to be accredited. NORZAGARAY, Bulacan — An alleged eyewitness in the brutal slaying of a 60-year-old man and an 18-year-old single mother surrendered to police authorities and named the three suspects who murdered the victims at a grassy area in Sitio Caymino, Barangay Bitungol here last Tuesday night.

Senior Supt. Fernando Mendez Jr., Bulacan police director, said that Richard Hernandez, 28, a resident of Barangay Assumption, Area I, Sapang Palay, San Jose del Monte City, expressed fear for his life, prompting him to personally report to the Norzagaray police station last Friday.

Mendez said Hernandez divulged that he witnessed the killing of Reynaldo Follosco, married, employee of the Land Management Bureau and a resident of 465 Antipolo St., Gagalangin, Tondo, Manila and Sharmaine Santos, 18, a resident of No. 2716 Gen. Lucban St., Gagalangin, Tondo.

NTC slammed for loopholes in new rules for broadband connection speed

Cagayan Rep. Jack Enrile has criticized the National Telecommunications Commission (NTC) over the memorandum order it issued setting a minimum speed of broadband connections, saying the order is a mere “lip service” and will not ensure concrete benefits for a big portion of Internet service users.

This, as he called on NTC to push telecom firms to complete the rollout of mobile connectivity throughout the country which will allow Internet connectivity to penetrate a larger portion of the population and a bigger number of schools.

Enrile explained that despite its good intentions of improving broadband connections to allow customers to surf the Internet faster, NTC’s Memorandum Order No. 07-07-2011 was full of loopholes that may be used by Internet Service Providers (ISPs) to skirt the order’s intent.

In particular, he said the NTC order left out customers using pre-paid broadband services that last only for several days to a week. “The NTC order does well in setting a respectable 80% minimum service reliability level for ISPs and requiring ISPs to properly inform their customers about the broadband/Internet connection offered to them. The militant group Bagong Alyansang Makabayan (Bayan) yesterday called on the Commission on Elections (Comelec) and the Commission on Audit (CoA) to investigate the P197 million election fund given to the Armed Forces of the Philippines (AFP) during the 2004 elections.

The call came amid revelations in the Mayuga report on the possible misuse of the election funds. Bayan said based on interviews, the bulk of the funds was not used for AFP units doing election duties, but by the intelligence units of the AFP, Bayan said in a prepared statement.

The funds came from the Comelec when it deputized the AFP for election duties in some areas in the provinces. The funds were supposed to cover expenses of TF HOPE headquarters, operational expenses, missions and reservists.

In his interview with the Mayuga panel, then Lt. Gen. Rodolfo Garcia who headed the Task Force Honest Orderly and Peaceful Elections (HOPE) suggested that the AFP review how the huge election funds were spent and what was spent did not come close to the amount that was released..... MORE

Insensitive is the right word to describe the presidential spokesman’s dismissal of the request from the Hong Kong survivors and relatives of the hostages killed by the gun man during a botched rescue operation, to meet with Noynoy.

Noynoy, through his mouthpiece rejected the request, even stressing that this asked-for meeting would be flavored with politics, since the Hong Kongers would be accompanied by a opposition parliamentarian.

Presidential spokesman Edwin Lacierda declared last Wednesday that Noynoy will not receive them despite their request for an audience, adding that this group of Hong Kongers is being accompanied by a politician seeking an elective post in Hong Kong’s upcoming elections and that the Philippines would not want to be dragged into Hong Kong politics.

Lacierda also intimated that there is no need for Noynoy to meet with the Hong Kong group since the government already has taken steps to address the tragedy in Luneta — both administratively; both in making sure that the tourists are safe; and also in prosecuting those officials as recommended by the second IIRC report..... Can banks be trusted in ensuring the privacy of bank accounts, especially those belonging to private individuals, rather than ensuring the secrecy of accounts of political allies of an incumbent government?

From the looks of it, that trust between a client and the bank is easily breached — and illegally too, as shown by the photocopy of a check and a bank account number written on it for a deposit of some P150 million said to be the account of Cesar Mancao, who had turned state witness for the Dacer-Corbito double murder. The photocopy of the the check was presented by Sen. Ping Lacson the other day.

For Lacson to have gotten hold of a check and photocopied can only mean that the concerned bank — through an employee or bank official — handed the photocy of the check to Lacson, who is not the account owner and therefore would have no business being given a copy of the check, unless of course, the check’s payor handed this to Lacson which would then open that person up to tax charges, if made to explain how the payor could afford to deposit P150 million in another person’s account.

Lacson had asked the executive director of the Anti-Money Laundering Council (AMLC) during a hearing to confirm the authenticity of a P150 million check deposited to the former police senior superintendent who implicated Lacson in the 2000 Dacer-Corbito murder case, even when this was hardly the subject of the hearing..... MANILA – Overseas Filipino workers (OFWs) added up $18 billion to the Philippine economy in 2010, but in the Aquino government’s budget proposal for 2012, only one percent will be allotted for their welfare.

In a detailed breakdown and analysis of the 2012 budget for OFWs and their concerns, Migrante International discovered that of the proposed P1.8 trillion ($41.8 billion) budget, direct services for OFWs from concerned government agencies will amount to no more than P3.14 billion ($73 million). This is equivalent to a measly 0.17 percent of the whole national budget. Budget for OFW welfare and services suffered a decrease of P792 million ($18.8 million) from last year’s P3.8 billion ($88 million) divided between the Department of Foreign Affairs (DFA), Department of Labor and Employment (DOLE), Philippine Overseas Employment Administration (POEA), Department of Justice (DOJ) as lead agency of the Inter-Agency Council Against Trafficking (IACAT), Commission on Filipinos Overseas (CFO) and the Office of the President (OP).

According to Migrante International chairperson Garry Martinez, the cuts were made on the maintenance and other operating expenses (MOOE) of items concerning direct services for welfare and protection of OFWs in the DOLE and POEA budgets.

The group discovered that while there’s a P90.5 million ($2.16 million) increase in the Foreign Affairs department’s MOOE , the amount is intended mainly for payment of debts incurred from the Overseas Workers Welfare Administration (OWWA) for emergency repatriation and other emergencies. Much of the OWWA’s funds were reportedly utilized last year to address the the crisis in Libya and multiple disasters in Japan.

“If we exclude the the P90.5 million ($2.16 million) as debt payments to OWWA, funds for welfare services in the DFA would only amount to P3.05 billion ($ 71.4 million), or P792 million ($18.8 million) less than funds allotted in 2011”, Martinez said.

He also pointed out that in the DFA budget funds for assistance to nationals (ATN) are mysteriously unstated. There is only a P30 million ($714,286) minimum amount for the legal assistance fund (LAF) under the item “implementation of RA 10022, or the amended RA 8042 (Migrants’ Act).”

The LAF is for assistance for OFWs in distress, especially those in jail and death row. The ATN, in the meantime, is earmarked for services such as repatriation and medical assistance.

The Migrants Act , however, mandates that at least P100 million ($2.38 million) should be allotted for the LAF.

No transparency in the 2012 budget 

Martinez also questioned the lack of transparency in the 2012 national budget, a charge that has also been made by other sectors.

“This is highly contrary to the Department of Budget and Management’s (DBM) statement that there will be no lump-sum funds. Because the government did not directly lay down on paper how much will be allotted to the LAF and ATN, OFWs have been given reason to worry that their welfare will once again be neglected and the funds made vulnerable to corruption and misuse,” he said.

Martinez said Migrante International had previously exposed budget cuts in the LAF and ATN budgets for the 2011 DFA. The expose’ forced the DBM to admit its “error” and to promise to submit an “erratum” to Congress..... MORE

MANILA – Progressive transport and labor groups in the country are gearing up for a nationwide day of protest against the oil companies’ overpricing. This Monday, oil companies announced its long-awaited price rollbacks amid the downward trend in prices of oil products in the world market. But its rollbacks were less than the amount estimated by the energy department officials of P2 ($0.047), and far less than the “overpricing of P9” ($0.21)which independent analysts and various peoples’ organizations have previously asked the oil companies to slash.

In the budget hearing in Congress last week, the energy officials led by Energy Secretary Jose Rene Almendras estimated the needed roll back at P2. They told lawmakers they would investigate with the Department of Justice the oil companies who would not roll back their prices by P2.

But last Monday when most oil companies at last announced some price rollbacks, only the French newcomer Total Philippines rolled back their price by more than P2, bringing down their diesel by P2.35 ($0.055) per liter, while the price of their gasoline was lowered by just P1.50 ($0.035)per liter.

Of the Big Three, only Petron slashed by P2.50 ($0.059) the price per liter of their gasoline. Citing other “variables” affecting their prices, the Big Three including Petron lowered the prices of most of their products by less than P2, or just by P1.70 per liter of diesel and kerosene. Shell and Caltex lowered by P1.50 ($0.04) the price per liter of gasoline.

In the past, when the opposite is happening and prices of oil in the world market are rising instead of falling while more pesos are needed to purchase a dollar, an immediate and steep increase in oil prices in the Philippines usually ensues, noted George San Mateo, secretary-general of the transport group Piston.

Investigate oil companies or risk looking like liars and inutile

Bayan Muna Representative Teddy Casiño challenged the energy department to make good their threat against the oil companies. “They (DoE) should file a case against the oil companies at the justice department, or the Department of Energy would look like a liar or inutile,” said Casiño.

“It is clear that the Big Three oil companies do not fear or respect the Department of Energy to implement the meager rollback demanded by the agency,” said Labog. “The problem,” he said, “is that the DOE and the entire government do not have coercive powers over the Big Three.”

The labor group seriously doubts whether the DOE will make good its threat to investigate the Big Three’s profits. MANILA -– To leave or not to leave Syria, that is the question.

Contrary to reports of the Department of Foreign Affairs that overseas Filipino workers in Syria do not want to leave, Migrante Middle East said there are many who are calling on the Philippine government to immediately bring them home.There are 17,000 OFWs in Syria, 15,300 are women.

Migrante coordinator John Leonard Monterona said that in talks with an OFW based in Syria, it was revealed that more OFWs are desperate to come home and avoid the escalating conflict in the said country.

Monterona forwarded to Bulatlat an Mp3 file of his conversation with OFW Judith Pingol, 41, who originally hails from Manila. Pingol works as a domestic worker for a Syrian family based in Homs, northwest part of Syria. She arrived in Syria in 2008 and has already completed her employment contract.
According to reports, Homs is among the places in Syria where there are heavy clashes between anti-government protesters and security forces.

Monterona explained that he got OFW Pingol’s mobile number from another OFW who is currently staying at the Philippine Embassy’s Filipino Workers Resource Center (FWRC) in Damascus. Pingol is reportedly asking for help from the embassy because she wants to leave as soon as possible.

“The peace and order situation in Homs is getting worse as clashes happen on an almost daily basis. We hear reports of increasing number of casualties,” Pingol said. “It’s terrible here. Every day we can hear guns being fired; we hear reports of people getting killed. We don’t leave the house anymore. We stay indoors out of fear for our safety.”

Pingol said there are at least 300 OFWs in Homs.

“Some fellow OFWs have already been taken by their employers to relatives living elsewhere. Many employers themselves have left the country,” she added.

Asked with whom she is staying now, Pingol said, there are only two of them — herself and the elderly woman she is looking after.

Pingol said her family back in the Philippines is aware of the situation in Syria, but she has not said anything about how grave it is.

“I don’t want them to worry,” she said.

When Monterona asked the OFW if the Philippine embassy in Syria is giving any assistance, she answered that embassy officials do call them, advising them to take extra precautions. This moral support, Monterona said, seemed to be the extent of the Philippine authorities’ assistance.

According to Pingol, many OFWs in Syria want to leave. “We want to go home,” she said.

When Monterona asked Pingol how she thought the embassy could arrange to rescue OFWs like herself who are stuck in Syria when there’s increasing conflict, the OFW gave a wistful answer.

“Those at the embassy said they are unable to come here. They said we OFWs could get on a taxi and go to Damascus. Some of us OFWs believe that the embassy should make the effort to come and rescue us,” she said.

Repatriation assistance to all distressed OFWs

According to Monterona, the Philippine embassy currently finds it very difficult to put together an evacuation plan in areas where there is ongoing conflicts such as Homs, Latakia, Banaas and Dara’a.

“But then again, Migrante has been asserting that the Philippine government should form an evacuation plan at the soonest possible time. We first said this when the conflict in Syria first erupted. We called on the Aquino administration and the DFA to get an evacuation plan ready and make sure it is ready for immediate execution. We also said it was not right for the government to sit back and wait for the situation to worsen,” he said.

Monterona nonetheless said Migrante is constantly communicating with the Philippine embassy in Syria and the DFA so they could all coordinate in finding means to evacuate the stranded OFWs..... MORE

MANILA – In the immediate wake of the Senate’s investigation into the controversial art exhibit “Kulo” and one of its featured works “Poleteismo” by embattled artist Mideo Cruz, the Concerned Artists of the Philippines (CAP) issued a statement urging the senators to uphold the Freedom of Expression as enshrined in the 1987 Constitution.

The 1987 Philippine Constitution states in Article 3, Section 4 that: “No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances.”

The group reminded lawmakers of their oath to uphold and defend the Constitution and desist from “bullying” and “pressuring” institutions like the Cultural Center of the Philippines (CCP) to ” succumb to their will.” It also called on the CCP to stand firm on its mandate, promote and protect the artistic freedom of expression and reopen the exhibit.

“We urge the Senate to instead focus its energies, time and budget to address the continuing human rights violations and impunity of violators in the country. There is moreover the matter of extreme poverty due to landlessness by the majority of the Filipinos which also deserves priority,” it said.

Cruz a no-show at the Senate

The Senate conducted it’s hearing on “Kulo” but Cruz did not appear. In an email to Bulatlat.com, Cruz said he was advised against it by well-meaning friends.

Finding Cruz absent, Senate Pro Tempore Jose “Jinggoy” Estrada said Cruz should be subpoenaed, but at the end of the hearing wherein officials of the Catholic Bishops Conference of the Philippines (CBCP) and the CCP attended, chairman of the Committee on Education Senator Edgardo Angara said there was no longer a need to subpoena Cruz.

Angara explained that it was not Cruz who was the subject of inquiry but the CCP as a public institution that allowed Cruz’ work to be put on display in one of its galleries.

Cruz issued a statement explaining his absence from the hearing.

He said he did not attend the hearing because it was no longer about his work but an issue of art education and the broader fight for freedom of expression. He said he was abiding by the decision of colleagues not to attend and in the process not feed his “self-serving impulse to defend my work or my person to each query, insult or threat being hurled at me.”

Poleteismo fallacies 

Dean Raul Pangalangan of the UP Law School and Philippine Daily Inquirer columnist said “fallacies” abounded in the furor over “Poleteismo.” Among the six fallacies he noted was the belief that if “Poleteismo” should be displayed in a private gallery and not at the CCP which is a a state instrumentality, making it complicit to an attack on religion.

“A private gallery is completely free to judge art according to its aesthetic biases. But a publicly-funded gallery is bound by a document called the Philippine Constitution, which requires it to respect ‘freedom of speech and of expression’ (Article III, Sec. 4) and ‘foster … a Filipino national culture … in a climate of free artistic and intellectual expression’ (Article XIV, Sec. 14). A former military official who appeared before the Mayuga Board in 2005, yesterday vowed to tell all he knows before any investigating body regarding the alleged massive electoral fraud in 2004, particularly in Mindanao areas, as he expressed full support to the possible reinvestigation of the issue which continuously haunts the military organization.

Retired Col. Jose Gamos noted that the Mayuga Board, headed by then Armed Forces of the Philippines (AFP) Inspector General Vice Admiral Mateo Mayuga, was “restrained and subdued” in conducting its probe during the time of former President, Pampanga Rep. Gloria Arroyo.

“I am ready to face any investigation, even the Senate, and tell what I know,” said Gamos during an interview. “And I would like to encourage others who have knowledge of the election fraud to come out and tell the truth,” he added.

Even as the issue of the ownership of the controversial helicopter and its sale remain unresolved, Sen. Panfilo Lacson again came up with another allegation against the Arroyos which he admitted would still undergo a check.

The Arroyo family’s LTA Inc., was charged by Lacson to be keeping a dollar account that made remittances to banks abroad in the millions and in foreign currencies.

The alleged remittances, some of which are suspected to cover the payments allegedly made by the former First Gentleman in buying five helicopters sometime in 2004, are now being looked into by the Anti-Money Laundering Council (AMLC) as the amounts appear to have exceeded the allowed threshhold or possibly fall under the category of a suspicious transaction.

“They (AMLC) promised to give us a feedback soon,” Lacson said after relaying to the AMLC officials, during Thursday’s budget hearing of the purported $1 million.... MORE

The camp of former police officer Cezar Mancao II has challenged Sen. Panfilo “Ping” Lacson to trace the P150-million check deposited in the account of his former aide and key witness in the Dacer-Corbtio killings and even offered to turn over the proceeds of that account to him if he can trace it.

According to lawyer Ferdinand Topacio, Mancao received a P150-million check but stressed that it was a payment for a business transaction.

He said the amount was deposited in a joint account of Mancao and his former business partner.
Mancao did not receive any money, Topacio added. “It was for one of his partners.”

Saying that no amount of increase in the budgetary appropriations could suffice if the inordinate population growth is not checked, a senior member of the House of Representatives yesterday called on his colleagues to accord the Reproductive Health Bill (RHB) the same priority as that of the the General Appropriations Bill (GAB).

House Minority Leader and Albay Rep. Edcel Lagman, the principal author of the RHB, made this call as he underscored that “no amount of trillion-peso of appropriations will be adequate if the increase in the national budget is eroded by an inordinate population growth because parents, couples and women are not fully afforded the right to responsibly and freely determine the number and spacing of their children.”

The priority enactment of the RHB was recently given presidential imprimatur and has been included as one of the additional priority bills of the Legislative Executive Development Advisory Council (Ledac).

A security aide of retired Army Maj. Gen. Jovito Palparan was charged before the Department of Justice (DoJ) in the abduction of two missing University of the Philippines student-activists five years ago.

Military intelligence officer Staff Sergeant Edgardo Osorio was named in an amended complaint filed by mothers of Sherlyn Cadapan and Karen Empeño as among those who purportedly abducted the two in Bulacan in June 2006.

He was included based on the testimony of eyewitness Wilfredo Ramos, who positively identified Osorio through a photograph presented by the Armed Forces during preliminary investigation of charges of torture and abduction against Palparan and other respondents.

Ramos claimed he saw Osorio during the earlier hearing last July 19 when the latter gave him an “intimidating look.” Osorio’s identity was provided by Armed Forces of the Philippines (AFP) Provost Marshal Gen. Col. Herbert Yambing, who also detailed the soldier’s records in the Army..... MORE

Customs Commissioner Angelito Alvarez should be given the benefit of the doubt as head of the second largest revenue earner of government since reinventing the agency is without doubt a Herculean task.

At least four congressmen shared this belief and came to the defense of the Bureau of Customs (BoC) chief’s leadership, even as some colleagues in the Lower House demanded his ouster, the most persistent being the representative from Zambales, for allegedly failing to stop rampant smuggling activities at the country’s major ports.

The more level-headed congressmen agreed that Alvarez could not be faulted for what was happening at the agency.
