David and Goliath at Oriental Gardens

The situation at Oriental Gardens, Makati, discussed in this column last Nov. 8 (“Towering Impunity”), is developing into a legal battle, with one of the condominium unit-owners filing a criminal complaint against the directors and officers of Federal Land Inc. (FLI) and associated companies.
Readers may recall that residents had been campaigning against the decision of FLI to build a third condo tower, now called Lilac, alongside the existing two, Lotus and Orchid. Although the Housing and Land Use Regulatory Board (HLURB) would in December 2010 dismiss a complaint aimed at halting construction of the third tower on the grounds that the interests of existing residents would be adversely affected (there is a pending appeal at the Office of the President), it found in November that year that FLI had stepped over the line by pre-selling units at a time when its temporary license to sell had expired, and the board therefore issued a cease and desist order, banning further sales until a permanent license had been secured.....
