Steel firm questions CA ruling on multimillion-$ issurance case
By Benjamin B. Pulta 03/28/2012Lawyers of a local steel corporation have formally sought the inhibition of three Court of Appeals (CA) magistrates hearing its multi-million-dollar case after the justices allegedly exhibited manifest partiality and negligence in hearing the suit.
The Steel Corp. of the Philippines (SCP), through its legal counsel Nonnatus Chua, formally sought the recusal of Justice Fernanda Lampas Peralta, chairman of the former Fourteenth Division of the CA, together with the two other members of the Division, namely, Justices Priscilla Baltazar-Padilla and Agnes Reyes-Carpio, for “manifest partiality, evident bad faith and gross inexcusable negligence” in deciding the case and promulgating the decision dated Feb. 8, 2012.
The decision by Justice Peralta had declared null and void the order dated June 1, 2011 of the Regional Trial Court (RTC) of Balayan, Batangas which had held SCP’s panel of insurers liable to SCP and directed them to pay SCP’s insurance claims in the total amount of $42 million or replace SCP’s damaged equipment.....
