Erice fails to take over Caloocan leadership

Calalo 01/10/2012An attempt from the camp of Caloocan Vice Mayor Edgar “Egay” Erice to take over the leadership in the city failed after a trial court judge yesterday issued a three-day temporary restraining order (TRO) stopping the execution of the preventive suspension order against Mayor Enrico “Recom” Echiverri and three other city officials.
Echiverri, who is also a lawyer, in a statement released to media advised the Department of Interior and Local Government (DILG) to first secure a new order from the Office of the Ombudsman since the old order of preventive suspension dated July 17, 2011 has already been overtaken by events..... "Echiverri cited the “Pelino case GR 179261 April 28, 2008” where the Supreme Court (SC) ruled that “since the Ombudsman case has been submitted for decision, respondent may no longer be placed under preventive suspension, as the necessity no longer exists.”
"Applying the high court decision in this instance, the Ombudsman case against Echiverri has been submitted for decision on Dec. 4, 2011, thus the mayor argued that he may no longer be placed under preventive suspension."
