In the context of sincerity and with the spirit of urgency, this can be readily considered as an ardent prayer said with bowed head and on bended knees even.

It is a fervent supplication based on objective truth and ground reality about a disturbing and distressing national phenomenon. It is a loud plea addressed to someone in the highest governing office in the country, repeatedly professing its unquestionable integrity and loudly declaring its consuming crusade against corruption.

Thus it is that this some kind of a litany is directed to someone supposedly in tenure of all the authority and wherefore empowered to act accordingly — if he wants to. He has in command of the entire Philippine National Police plus the intelligence of the whole National Bureau of Investigation in addition to the extensive authority of the Department of Justice..... Oversha- dowed in Noynoy’s Second Annual Bashing of the Arroyos yesterday were the fashionable political statements some members of the House of Representatives tried to convey as they walked down the aisle of the largest bastion of conservatism in the country.

Militantly yet femininely, Emmie de Jesus of Gabriela donned a baby pink panuwelo creatively crafted by Marikina’s fashion designer par excellence, Ruel Rivera, with lilac nouveau art text spelling out her call to “Scrap eVAT.”

With a minimalist silver gray Italian gazar-cut gown, Emmie’s dress was accented with embroidered fuschia leaves and flowers, complementing the panuwelo with its political call.

According to Emmie, the Rivera-designed gown reflects her duty as a representative of the women sector to bring the voices and demands of poor women to Noy’s Sona..... MORE

ARGHANDAB VALLEY — Lt. Chris Choi receives a mix of stares and scowls as he shakes hands with curious Afghans on their way to prayer in the restive Arghandab district of southern Kandahar.

But he says the mere presence of the turbaned men walking through heavy traffic to the Haji Baba Wali shrine is a sign of progress stemming from the brittle peace in an area that was once a key Taliban supply route.

Nearby, half-dressed children dart in and out of the murky canal waters that help irrigate fertile pomegranate fields.

Such scenes would not have been possible a year ago, when the Arghandab valley resembled a chessboard of American forces vying with the Taliban for control of Afghanistan’s southern heartlands..... MORE

Noy’s Sona a rehash of ‘wang-wang’ speech

By Virgilio J. Bugaoisan 07/26/2011

President Aquino’s State of the Nation Address (Sona) may have done away with human props but he relied on heavy symbolism on the old practice by government officials of using “wang-wang,” the local term for car sirens, in a bid to evoke a vivid picture of the nation’s past, present and future under his administration.

But his speech neither inspired nor excited, as this was a repeat and rehash of his inaugural speech as well as his maiden Sona. Both substance and presidential style were missing.

Like a homily of a non-practicing believer, his Sona was absent of any battlecry to which every Filipino could rally. Neither was there a roadmap that was specific, measureable and time-bound. There was no-forward looking vision of how his administration can lift the nation from low economic growth status to high growth that would impact positively on the poor.

In the process, Aquino got at least 50 by way of applause counts for his speech that lasted for about an hour but it was noticeable that the applause mostly came from the president’s Cabinet members and Sona guests in the gallery, composed of his yellow supporters, and not from the legislators who were at the plenary..... Former President Joseph Estrada, in a chance interview after the State of the Nation Address (Sona) of President Aquino, said given the numerous cases that have been filed and are going to be filed, the current administration should create a special court to try her and her allies.

“There is a need to create a special court,” Estrada stressed.

He also raised the possibility of filing charges against Arroyo for her involvement in the alleged cheating during the 2004 presidential elections.

Sotto urges colleagues to speak out in 2004 polls fraud

By Angie M. Rosales 07/26/2011

Majority Leader Vicente Sotto III yesterday joined those urging colleagues who took part in the canvassing procedures during the 2004 presidential elections where alleged massive rigging of votes took place to speak out on the issue.

“This is a good chance for them to air their side and clear their names. It cannot be avoided that their names will be mentioned whenever we talk about it,” the lawmaker said, referring to the period when Congress, during the 13th Congress, was convened as National Board of Canvassers (NBC) for the presidential and vice presidential elections.

Minority Leader Alan Peter Cayetano likewise backed up the call saying that now is the time to “tell all.”

Sotto recalled that lamentable moves taken by then colleagues aligned with the Arroyo administration in acting on the complaints and other motions the opposition bloc filed before the NBC with regard to alleged tampered election returns..... MORE

More taxes – the real game

DIE HARD III
Herman Tiu Laurel
07/25/2011
While the country gets increasingly distracted by the “Hello Garci” and Lintang Bedol dramas, the many Gloria Arroyo plunder cases that seem to have a number of legal loopholes, as well as today’s worn-out “anti-corruption” State of the Nation Address (Sona), the real game in the system — the financial mafia’s blood-sucking of the people — continues to intensify.

The Supreme Court (SC)’s approval over the weekend of the 12-percent Value Added Tax (VAT) on toll fees by the Bureau of Internal Revenue (BIR), affecting among others, the North and South expressways, is just the latest in a string of backbreaking tax burdens and price hikes. What this SC decision also makes clear is that nothing can stop the toll operators from passing it on to commuters.

Perhaps to soften the impact of its decision, the SC ponente resorted to some semantic play. It claimed that while “the seller (of the toll service) remains directly and legally liable for payment of the VAT... the buyer bears the burden since the amount of VAT paid by the former is added to the selling price,” arguing that “Once shifted, the VAT ceases to be a tax and simply becomes part of the cost that the buyer must pay in order to purchase the good, property, or service,” thereby declaring that the “VAT on tollway operations cannot be a tax on tax even if toll is deemed as a ‘user’s tax’… since VAT is assessed against the tollway operator’s gross receipts and not necessarily on the toll fees.”

But is there really a difference if VAT were to be based on the operator’s receipts since all of it will be taken from commuters’ pockets anyway?

The problem with this new, additional expanded VAT (eVAT) in the life of Filipinos is the eVAT law itself — a law that has opened the floodgates to endless regressive taxes. A little history of the tax system in RP would thus be helpful.

Before Edsa I, the country had progressive taxation based on income tax where those who can afford paid more while those who earned less paid less. The VAT law that came with the Cory Aquino regime changed all that. It introduced the VAT system, which is based on taxing consumption, with the end-users shouldering much of the burden. It is regressive since it taxes the poor more than the rich.

A tax on toll fees, for example, would be the same for a brand new Mercedes Benz and a 20-year-old dilapidated Toyota Corolla whenever such vehicles pass through the toll booth.

Early on, when the VAT was made part of the Comprehensive Tax Reform Program (CTRP), it was touted as the last time any new tax would have to be raised. But, as we all know, the VAT was immediately expanded under Fidel Ramos. Of course, it was the IMF-WB that lobbied for all of it; but since it was our Congress that capitulated (as usual), it only exemplified the idiocy of our politicians for crafting such a law.

One such fellow, Nueva Ecija Rep. Renato V. Diaz, is now ironically one of two petitioners at the SC, challenging the Department of Finance (DoF) and the BIR’s imposition of the toll eVAT (the other being former Trade Assistant Secretary Aurora Timbol).

Since the high court in its decision was able to state, “The VAT on franchise grantees has been in the statute books since 1994 when Republic Act 7716 or the Expanded Value Added Tax law was passed. It is only now, however, that the executive has earnestly pursued the VAT imposition against toll way operators,” clearly, Diaz has been ignorant of the full meaning and impact of the law he co-authored all along.

That said, the imposition of the tax is still a political as well as an ideological issue. Even as Gloria Arroyo’s supporters say that she stalled on the VAT on toll ways throughout her nine years in office (as opposed to Aquino III, who only put the brakes because it was challenged before the SC), the truth is, she only withheld its implementation because of political expedience, whereas Aquino III, without a similar sense of the limits of his “political capital,” merely allowed his BIR appointee and Finance Secretary, both IMF assets, to get the better of him.

The case brought before the SC actually saved Aquino III for a while. Now that he has to face the music and decide on whether to impose or not, his campaign promise of “no new taxes” will surely be tested. Still, given his administration’s financial and economic thrust, there isn’t any hope for an ideological shift to progressive taxation, which is our only liberation from the continued tax exploitation and extraction.

But as bad as this recent development already is, the pressure to raise the eVAT from 12 to 15 percent is still on, as reflected in the official pronouncements of the DoF, Neda (National Economic Development Authority), BSP (Bangko Sentral ng Pilipinas), and the BIR.

Consumers and commuters desiring to stop the VAT’s march to more perilous heights, though, do not have the law on their side. As in the VAT on toll ways, they are only limited to making appeals for the Chief Executive’s better sense (if that’s even possible at all).

However, since Malacañang is still in the mode of fending off pressure to hike the eVAT to 15 percent, it is more than likely to give in to the temptation of the green-lighted VAT on toll ways.

As such, Filipino consumers and commuters will never have a permanent respite from increasing regressive taxes unless the country returns to progressive taxation — which will only happen after a genuine popular revolution.

Today’s State of the Nation Address (Sona) of Noy, his second under a lackluster presidency thus far, is not expected to deviate from the usual fare of the repetitive promises of trudging the straight path and no corruption, no poverty lines, all of which irritate the ear, and spiced with the never-ending Gloria bashing.

For the past so many speeches of Noynoy since the first Sona and even from his presidential campaign, he had nothing to offer by way of his speeches to give Filipinos hope that a solution is forthcoming for their economic miseries.

At the campaign trail, Noynoy’s attack on Gloria may sound new, novel and may have sparked some form of hope among a handful and may have swayed decisions at the polls but a year of the exact dish tosses one’s cookies.

A given is that it would be in the local vernacular since his speechwriters believe that Noynoy is more in his fiery element when speaking in the native tongue but the bet is that the spiel which is supposedly intended to persuade members to go along with his administration’s legislative agenda would be an enumeration of his imaginary achievements and likely revelations of newly conceived corruption cases during Gloria’s watch..... State of the Nation Addresses are always portrayed by Malacañang as a most important yearly event, as if such speeches would effect major changes in the life of a country and its people. Yet all these Sonas are merely a list of rosy promises made by political leaders with exaggerated claims of accomplishments by the Palace tenant, none of which will bring about great changes and reforms.

There are, of course, great presidential speeches that succeed in their aim of bringing about attitudinal changes in the people, but by and large, the Sonas and other speeches being churned out by Malacañang for presidents are puffed up pieces to make presidents look good with even more promises to the nation that would hardly be delivered during their terms.

Truth is, Noynoy had that rare chance of bringing about an attitudinal change in the people shortly after being proclaimed president. He could have brought this about during his 100 day in office speech, and followed this up during his maiden Sona..... MORE

“Uncharacteristic” was how the international press described Foreign Affairs Secretary Albert del Rosario’s remarks about China’s actions in the disputed West Philippine Sea or South China Sea as the Chinese call it at the recent 18th Asean Regional Forum in Bali. Attended by the top diplomats of the member countries, Del Rosario said China’s claims were “baseless” and a “potential threat” to navigation in international waters. Racheting his rhetoric, Del Rosario proceeded to raise concerns about how the Chinese would treat its neighbors as it “became more powerful.”

Those are indeed fighting words and for a diplomat-businessman of Del Rosario’s standing truly a revelation.
Said the DFA Chief: “If Philippine sovereign rights can be denigrated by this baseless claim (the so-called nine-dash claim inked on Chinese maps), many countries should begin to contemplate the potential threat to freedom of navigation in the South China Sea. China’s hesitation to accept the Philippine suggestion to elevate their dispute to the International tribunal for the Law of the Sea (ItLos) could lead to the conclusion that China may not be able to validate its stated positions in accordance with the UNCLOS.”.... Not only poll operators former Commission on Elections (Comelec) officials Lintang Bedol and Virgilio Garcillano should be asked to reveal all the massive and orchestrated cheatings that happened in the 2004 presidential polls when former President Arroyo stole the presidency from opposition standard bearer Fernando Poe Jr. but also former political allies of the Arroyo administration who are now strong supporters of President Aquino, including Senators Francisco Pangilinan and Franklin Drilon.

His Senate legitimacy under a heavy doubt of cloud following the exposé of disgraced poll official Lintang Bedol, Sen. Juan Miguel Zubiri appears to have waved the white flag after he ordered his revisors to stop reporting before the Senate Electoral Tribunal (SET).

In truth, the impeachment complaint was very defective both in form and in substance. The “evidence” attached to the complaint was composed of news clippings, mainly from the anti-Erap media that wanted him out of office.

The manner by which Estrada was impeached by the House was not only highly irregular, as the Speaker then rejected a plenary vote and instead segued from his prayer to the impeachment of Estrada and sent it immediately to the Senate for trial.

Noynoy appears to be following the worn-out formula of Cory, his mother, in pounding on the alleged sins of a past administration as if everything relies on this for the country to prosper.

In 1986, when Cory Aquino took over the presidency, the formula seemed to be then guaranteed to maintain public sympathy since she, anyway, was swept to power by ousting an overstaying president who was accused of emptying the public coffers and withheld the exercise of civil rights.

As a result, the country went down the drain, all because of her focus on destroying Marcos and everything that he had established, to the point of abolishing the Ministry of Energy which resulted in the country experiencing 12 hour daily blackouts.

Now, more than 20 years after, public perception about the Marcos regime is changing with many, particularly those who had lived through the Marcos’ 14-year martial rule, saying that life then was better, perhaps because his regime built more, while Cory’s destroyed more..... MORE

After Zaldy Ampatuan and his sidekick Lintang Bedol revealed that GMA cheated Fernando Poe Jr. in the 2004 presidential election, suddenly, so many people, including politicians, want to have a free ride on the issue. One politician would want to have the so-called cheating issue investigated by a congressional commission. One businessman is reported to have bankrolled the coming out of Zaldy and Bedol to spill the beans on the cheating just to please his Malacañang patron. But where were they when FPJ mostly needed their help in 2004, specifically during the canvassing of votes at the Presidential Board of Canvassing? Where were they when a number of certificates of canvass needed to be shown and proven as fake and spurious at the said Board of Canvassing? There where only a handful of us who stood tall against the GMA mob who always outvoted us whenever we pinpointed a fake certificate of canvass and request the opening of the election returns for comparison..... Chasing fuel at Malawi’s empty pumps stokes public anger

LILONGWE — Deadly rioting in Malawi erupted largely due to discontent over chronic fuel shortages which have hobbled businesses and infuriated the population but drawn little sympathy from government.

Two days of unrest have left 18 people dead after protesters took to the streets accusing President Bingu wa Mutharika of mismanaging the economy and trampling on democratic rights.

Frustrated drivers queue at the slightest rumor that a tanker will arrive to offload petrol, which will be rationed and sold out within hours.

“Sometimes we are waiting for the whole day. We can stand in the queue until the end of the day,” said Lewis Kalimani, 37. “The last time I was waiting for almost 15 hours. (I’m) really, really tired and it’s very boring.”.... MORE

Reverse mode

VIEWPOINTS
Archbishop Oscar V. Cruz
07/24/2011
In more simple words, the “Reverse Mode” means going backward — not moving forward, not forging ahead for whatever reason. Translated into the sphere of governance, there is an ineffective or stagnant administration — for one or all of the following reasons on the part of the national leadership: One, there is fear in going ahead. Two, there is lack of “political will” to go onwards. Three, there is no competence to move forward.

In other words, Malacañang has become an expert in looking behind and in blaming the past. Reason: It is disabled from remedying the sad present, from building for the near future. So far, it indulges in empty rhetoric as the country is becoming progressively more a Third World Country, as the Filipinos are suffering from more want and misery — notwithstanding all statistics on paper to the contrary. This is the living reality of “reverse mode” adopted by the present government..... MORE

Malacañang sure Sona in Tagalog but not on halting GMA bashing

By Virgilio J. Bugaoisan 07/24/2011

The Palace is definite about President Aquino delivering his second state of the nation address (Sona) tomorrow in the local tongue but is unsure if the President will oblige a bishop’s appeal for him to set aside Arroyo bashing for this historic event.

“I believe it will be in Tagalog. I’ve not seen the entire speech but from what I saw, it’s in Tagalog,” Deputy presidential spokesman Abigail Valte said.

Valte added that English translations of his speech will be made available however to the media and others who may need it shortly after his speech.

And while Valte is certain which language the President would use in his speech, she is unsure if the people would be spared of his Arroyo-bashing tirades which have become a common fare of all his speeches since he assumed office..... MORE

12 ‘Chinese’ held for harassing Noy’s brother-in-law

07/24/2011
Aviation police yesterday detained a dozen airline passengers, said to be Chinese, after an alleged mid-flight scrap with a brother-in-law of President Aquino, officials said.

The suspects, described by police sources as Chinese citizens, flew to Cebu on a domestic flight that also carried Aquino’s elder sister Maria Elena “Ballsy” Cruz and her husband Eldon Cruz, airport manager Nigel Paul Villarete said.

Cebu airport police detained the suspects on the Cebu Pacific flight’s arrival from Manila after the pilot filed a complaint, the manager told reporters.

“We are monitoring the investigation,” Villarete added.

Police sources in Cebu said one of those under investigation grabbed the presidential-in-law’s neck to choke him when the latter asked the group to tone down their voices in mid-flight..... MORE

China’s Spratlys claim ‘baseless,’ spurred by hunger for oil — gov’t

By Michaela P. del Callar 07/24/2011

The government appeared to have stepped up its verbal offensive on China over a territorial dispute after Foreign Affairs Secretary Alberto del Rosario said its aggressive actions in the South China Sea appear motivated by a hunger to exploit the area’s rich oil and gas resources while branding as “baseless” its so-called historical 9-dash claim over the entire Spratly Islands.

Del Rosario, who is in Indonesia attending an Asian security forum, said China’s action is a “threat to freedom of navigation in the South China Sea.”

Speaking on the sidelines of the forum, Del Rosario said China’s behavior in the disputed waters raised concerns about how it would treat its neighbors as it became more powerful.

“I think the wealth of the area in terms of hydrocarbon assets could stimulate an increased interest in the area,” Del Rosario said when asked why China had, according to the Philippines, become more aggressive..... MORE

A total of 178 new human immunodeficiency virus (HIV) cases were diagnosed in the Philippines in June, an increase of 63 percent compared to the 109 reported in the same month last year.

Citing National Epidemiology Center statistics, LPG/MA party-list Rep. Arnel Ty yesterday said the new infections brought to 1,016 the cumulative number of HIV cases reported in the first half of the year.

Ty said the National HIV and AIDS Registry, which began passive surveillance of the disease in 1984, now lists an aggregate of 7,031 cases, including 875 with advanced AIDS (acquired immune deficiency syndrome).

LGU dismantles excess fish cages in Lake Buhi

07/24/2011
BUHI, Camarines Sur — The municipal government here has started dismantling some fish cages located along the delineated areas serving as navigational lanes and buffer zones in Lake Buhi.
The move is to provide more breathing space for fresh water species thriving in the lake, the home to the world’s smallest fish locally called “sinarapan.”
The local government also enforced a massive clean of its water and bed to prevent the re-occurrence of fish kills owing to pollution brought about by unconsumed fish feed sediments and garbage that have been proven vicious to the local fishery industry.
“We have so far dismantled about 13,000 fish cages that occupied as much as 70 percent of the 1,707-hectare body of water to bring back to full life this lake and save from extinction the sinarapan and all its other fishes such as native catfish, tilapia, dalag, irin-irin, burirawan and puyo, among other fishes,” Buhi Mayor Rey Lacoste said over the weekend..... Airport personnel in ‘escort’ racket warned

Airport personnel who “escort” or facilitate the exit out of the country of victims of human trafficking syndicates will soon be sacked and charged, justice officials yesterday said.

Justice Undersecretary and Inter-Agency Council Against Trafficking in Persons (IACAT) head Jose Vicente Salazar warned all airport officials and personnel who are in cahoots with human trafficking syndicates.

“We are very alarmed about reports of airport personnel facilitating the exit of mostly tourist workers who are most prone to exploitation by trafficking syndicates. We will implement a rigorous investigation and monitoring of those implicated in the reports, and definitely we will file cases against them as soon as we find probable cause,” he warned.

“The Department of Justice and IACAT will see to it that they will be sacked from their employment, taken to court and jailed for jeopardizing the lives of our countrymen who most oftentimes get abused on foreign shores, either ending up as drug mules or prostitutes,” Salazar said as he emphasized that Malacañang has taken interest in the status of the cases of government officials and employees involved in human trafficking..... Denials come easily in Noynoy Aquino’s Malacañang, but despite Palace denials, it is pretty clear that Noynoy and his Balay boys are into bribing claimed whistle-blowers in yet another bid to pin down Noynoy’s predecessor, Gloria Arroyo — which may translate to Noynoy and his boys not having found as yet solid evidence with which to pin her down.

This means too, that the Palace is into playing dirty politics, which would be no different from the time the then political opposition — and Noynoy and his mother were part of this group — in its bid to oust then sitting President Joseph Estrada.
Having nothing on him, these power-hungry opposition politicians, along with their evil society, concocted graft and plunder charges and bribed so-called whistle-blowers to get Estrada out of office.

Similarly, Noynoy and his boys are into the same practice of bribing sleazy personalities to come forward and testify against Noynoys predecessor on the electoral fraud committed in 2004 and 2007..... MORE

Political prisoners start fasting up to Aquino’s Sona

“It appears that the Arroyo policy of witch-hunting, arrest, criminalization of political offenses and/or the slapping of fabricated criminal charges to silence and put behind bars human rights defenders continues to be implemented under Aquino,” Angelina Ipong, Selda spokeswoman, said.

MANILA – Hundreds of political prisoners in various detention cells nationwide have started fasting today up to President Benigno S. Aquino III’s State of the Nation Address (Sona) on Monday.

Dramatizing their call for general, unconditional and omnibus amnesty, 230 political prisoners in Camp Crame, Camp Bagong Diwa, New Bilibid Prisons, Manila City Jail, Quezon City Jail and other detention cells in Central Luzon, Batangas, Cagayan Valley, Central Visayas, Iloilo, Eastern Visayas, Southern Mindanao, Northern Mindanao, and Caraga, participated in the fasting.

According to Karapatan and Samahan ng Ex-Detainees Laban sa Detensyon at Aresto (Selda), there are 354 political prisoners nationwide. Majority of them were arrested during the previous administration of Gloria Macapagal-Arroyo.

“The redress of injustice to all political prisoners and the return of the freedom deprived from them are both a basic human right and an essential element in the peace process,” political prisoners detained at Camp Crame said in a joint statement.

“One year since the first Sona of Aquino, nothing has been done to serve justice for the illegal arrest, torture and illegal detention of the 354 political prisoners who are still languishing in jails all over the country,” Angelina Ipong, a recently released political prisoner and Selda spokeswoman, said.

Ipong added that under the Aquino administration, 45 political prisoners have been detained. “It appears that the Arroyo policy of witch-hunting, arrest, criminalization of political offenses and/or the slapping of fabricated criminal charges to silence and put behind bars human rights defenders continues to be implemented under Aquino,” Ipong said.

Karapatan called on Aquino to stop the implementation of his version of the counter-insurgency program now named as Oplan Bayanihan. “His version of the program is no different from the previous one; both of these entail the persecution of political dissenters that engender illegal arrests, detention and torture of political prisoners and other human rights violations,” the group said.

In support of the political prisoners, members of Selda, Karapatan, Hustisya, Desaparecidos, Tanggol Bayi held a picket rally in front of Camp Crame’s Gate 2 this morning.

Peace talks

Political prisoners reminded the Aquino administration of its commitment to release detained National Democratic Front of the Philippines (NDFP) peace consultants.

“The government of Benigno S. Aquino III needs to abide by the agreement between the NDFP and the Government of the Republic of the Philippines (GPH) peace panels last February for the release of all political prisoners – most of whom are unjustly and illegally imprisoned, and whose release should be part of the confidence-building measures on the part of the Aquino government, if the peace process is to progress,” they said..... MANILA – Preparations for the second State of the Nation Address (Sona) of President Benigno Aquino III are in full swing.

Bagong Alyansang Makabayan (Bayan) will lead thousands of protesters from different parts of the country to a march toward Batasan road in Quezon City.

Rising unemployment, high prices, poverty, human rights violations and subservience to foreign dictates will be among the issues that the groups will raise for this year’s Sona.

“The reality is that the current government has not shown much difference from Arroyo in terms of economic policies, foreign policies, human rights and governance. The Aquino government may talk big on going after Arroyo, but it has not filed a single case against the former president,” Reyes said in a press conference held July 20.

Sectoral issues

Leaders of various people’s organizations expressed their frustration at Aquino’s governance.
Danilo Ramos, secretary general of Kilusang Magbubukid ng Pilipinas (KMP), said Aquino should distribute Hacienda Luisita to the farmers. “In Aquino’s one year term as President, he has shown no concern for the plight of farmers,” he said.

Workers reiterated their decade-long call for P125 across the board nationwide wage increase. “Instead of giving a meager cost of living allowance, the government should give justifiable wages.” Lito Ustarez, Kilusang Mayo Uno’s executive vice chairman, said.

The groups also criticized Aquino’s band aid solutions to the country’s problems.

Urban poor group Kalipunan ng Damayang Mahihirap (Kadamay) said the Conditional Cash Transfer (CCT) program of the Aquino government is not the solution to poverty. For this year, Aquino has expanded CCT beneficiary families to reach 2.1 million.

“Aquino promised to uplift the poor, but instead what he gave is the Conditional Cash Transfer (CCT) program, a life buoy,” Gloria Arellano, Kadamay secretary general, said.

Arellano said instead of allocating P21 billion ($49 million) for this year’s implementation of CCT, the government should have spent it on social services that could have benefited more Filipinos.

Arellano added that the dole-out program is vulnerable to corruption. “While the perpetuation and the further expansion of CCT remain baseless, we fear that these billions of pesos will go to the corrupt hands of its operators.”

Migrant workers, meanwhile, said what they need is help not loan from the government.

“Migrant workers are the ones who are greatly affected by the global economic crisis, they are the first to be fired from their jobs. But the Philippine government’s response to these migrant workers who will come home with no jobs are just band-aid solutions,” Garry Martinez, chairman of Migrante International said.

“Aquino should prioritize the needs of the majority of the people and not the interest of the big corporations, foreign investors and the imperialist countries like the US,” said Piya Malayao spokesperson of Kalipunan ng mga Katutubong Mamamayan ng Pilipinas (Kamp).

Junk PPP

Dr. Gene Nisperos, vice chairman of Head Alliance for Democracy (Head), said Aquino’s Public-Private Partnership (PPP) programs have affected the country’s public hospitals.

“More and more public hospitals are now being privatized and health services were not given free at all,” Nisperos said, citing the privatization of the National Center for Mental Health and the increase in hospital fees at the Philippine General Hospital..... MORE

Women slam Aquino for deepening poverty and marginalization

“Aquino promised change, but the conditions of women and our families have worsened. Just a little over a year into his presidency, Aquino’s ‘daang matuwid’ (straight path) has proven to be a ‘killer highway’ for many Filipinos,” Gabriela secretary-general Lana Linaban said.

MANILA – In President Benigno S. Aquino III’s first year as president, Filipino women experienced worse poverty and marginalization, the progressive women’s group Gabriela said. Five days before Aquino was scheduled to deliver his second State of the Nation Address (Sona), women trooped to Mendiola near Malacañang Palace to declare the true “state of women and the people.”

Linaban said in the eyes of women, the Aquino government has completely failed to bring down rising prices of food and other commodities. Aquino, she said, also failed to provide the poor with greater access to basic social services such as housing, health and education.

“Under his term there have been ruthless demolitions of poor communities to give way to urban development projects. Wages have remained stagnant; workers have no access to better employment; farmers remain landless; and there have been an increasing number of cases of violence against women. All these have led to a worsening state of poverty and marginalization of Filipino women,” she said.

Women’s situation under Aquino

In an interview with radio program Sali na Bayan!, Jojo Guan, executive director of Center for Women’s Resources said that because of increasing prices of basic commodities, mothers and their families end up eating rice with soy sauce and cooking oil as viand.

“In urban poor communities where mothers have no regular income, mothers can afford to only buy instant noodles and sardines,” Guan said during the radio interview.

She also added that many mothers also complain about the high prices of National Food Authority (NFA) rice. According to the data of Bagong Alyansang Makabayan (Bayan), the price of NFA rice has increased from P25 ($.60) to P27 ($.64) per kilo..... MORE

Worsening conditions for the Filipino worker

Worsening conditions for the Filipino worker

Majority of those employed today in the Philippines are in vulnerable or part-time work, hampering many workers’ desire to demand for a living wage. Even those in full-time work are reportedly under pressure to comply with various flexible work arrangements.

By MARYA SALAMAT
Bulatlat.com

MANILA – Work is more dangerous than war — that is reportedly the conclusion of an International Labor Organization (ILO) study on global health and safety at work. The ILO study revealed that globally, at least one worker dies at work every 15 minutes. In the Philippines, a non-government occupational health and safety institute criticized the lack of concern for health and safety at work as highlighted by the deregulation of labor inspection as contained in a Department of Labor and Employment order.

The recent accidental death of a worker in the Korean-owned Hanjin in Subic, Zambales (which brought to 38 the total number of killed from work-related accidents), and the fatal fall from a Lucio Tan-owned construction site that killed 10 construction workers last January, are just some of the yearly “sacrifices” of workers in unsafe workplaces. According to Noel Colina, executive director of the non-government Institute for Occupational Health and Safety (IOHSAD), government concern and inspection only began after blood had been shed and when accidents had generated intense publicity. Otherwise, the establishments in the Philippines are ordered to perform “self-assessments” on whether they are complying or not with good occupational health and safety practices.

Most deaths and injuries from work-related accidents and lack of safety are most common in agriculture, construction, mining and manufacturing, the industries that are topping the employment targets of the Aquino administration. Even in services, accidents happen such as in Ninoy Aquino International Airport when the ceiling collapsed and injured two workers. Another incident was when nine workers were hit by lightning while working on the runway.

Despite Aquino’s promised change, though, and against the backdrop of many workers dying during his first year, it only continued the self-assessment policy began under Arroyo, noted the non-government IOHSAD.

Worse joblessness and working conditions

The real number of jobless Filipinos is much higher than what is reflected in government statistics. According to Ibon, a non-government economic think-tank, the country’s jobless may reach up to 4.5 million, or nearly double the government’s estimates of 2.9 million, which is based on the “new” definition of unemployment that does not include those who had stopped actively seeking work for various reasons.

The Social Weather Stations’ survey result released last March painted a grimmer picture: it revealed that up to 11.3 million Filipinos are jobless, up from 9.9 million in November 2010. Considering that this huge number of Filipinos has no livelihood to speak of, the poor and hungry are expected to have increased in number. Yet, they seemed to have decreased after the government has revised its poverty threshold. Before, a Filipino is considered poor if he or she earns P52 ($1.21) or less per day. This was reduced to P46 ($1.07) or less per day. The revision has brought down the number of registered poor from 28.5 million to 23.1million..... MORE

MMDA Streetsweepers fight for benefits, higher wages

“We are like slaves! We are not being treated with respect and by ignoring our demands for a CNA the MMDA administration is stripping us of our dignity.” MMDA streetsweepers

MANDALUYONG – Next time you see a street sweeper from the Metropolitan Manila Development Authority (MMDA), spare an indignant thought on his or her behalf: they are among the Aquino government’s most exploited employees.

For the last 10 months, employees of the MMDA led by the Kagalingan ng mga Kawani sa Kalakhang Maynila (KKK-MMDA) have been in active negotiations with the MMDA administration for their collective negotiation agreement (CNA).

The CNA is the equivalent of the collective bargaining agreement (CBA) in the private sector, and is defined by the Civil Service Commission as “the negotiated contract between an accredited employees’ organization representing a negotiating unit and the employer/management concerning terms and conditions of employment and improvements that are not fixed by law.”

Leaders of the KKK, however, have exposed the MMDA administration’s “refusal to honor its word” and sign the CNA draft that both parties finalized last April.

KKK secretary-general Ma. Theresa Gonzalez said that despite the regular meetings and the previously agreed upon schedule for the CNA signing, the MMDA administration led by its chairman Francis Tolentino and assistant general manager Edenison Fainsan have ignored the April deadline.

“The members of KKK, most of us street sweepers and utility staff, have been sincere in our efforts to negotiate with the MMA bosses. What we want is for the MMDA to recognize our rights as employees and give us the economic benefits that we deserve after years of honest service to the MMDA. Fainsan in particular has been acting as a destabilizer, deliberately throwing a monkey wrench in the relations between the KKK and the MMDA administration by saying that the CNA should be reworked and rewritten,” Gonzalez said.

A villainous MMDA official

Gonzalez said Fainsan has been calling for the removal of the most important economic provisions in the CNA draft finalized between the KKK and the MMDA. According to Gonzalez, Fainsan is a “villain” who seeks to undermine the economic welfare of the majority of employees of the MMDA who are among the poorest of the poor.

“He wants to strike out the economic provisions in our CNA. The CNA would be essentially useless if these provisions are removed. We have been working hard to push for these provisions precisely because our members are in dire need of economic assistance. We are poor but hard-working people, but Fainsan would rather we continue suffering our starvation wages and terrible work conditions. He has no right to demand this; and we will fight tooth and nail against any and all of his attempts to mangle our CNA,” she said.... MORE

PPPs in health threaten to make health care costlier – health workers

MANILA – After one year, healthcare in the country has gone from bad to worse — this is the assessment of the Alliance of Health Workers (AHW) on the Aquino government’s impact on health. In a series of protests held by its member unions in different public hospitals in Metro Manila, the group aired the various shocks of Aquino’s touted PPPs (public-private partnerships) on the services of public hospitals and the working condition of health workers and professionals in the country. The group challenged Aquino to stop the privatization “in any form” of public hospitals and to bail out public health by infusing it with a P90-billion ($2.09 billion) budget at least.

During Aquino’s first year, the country’s main public hospital, the Philippine General Hospital (PGH), for example, has, for the first time in its history, resorted to charging fees even from its lowest ranked charity or indigent patients. In a memo issued last month, the PGH administration reportedly directed its hospital staff to charge the previously free diagnostic and laboratory examinations of “class D” patients. These are the patients who, according to the hospital social workers, belong to the lowest earners or the poorest of the poor among the four groups who qualify for “social service.” Class D used to receive full support (or full charity), while the other classes under social service get discounts, much like the socialized tuition fees being implemented in the University of the Philippines, explained Jossel Ebesate, AHW national president.

In the Philippine Orthopedic Center, fees have been drastically increased early this year, with some increasing more than twice its old amount.

Because of the budget cutbacks implemented by the Aquino administration in the budget for maintenance and other operating expenses of public hospitals, the previous shortages in medicines, supplies and other equipment have become worse, reported the AHW. The exacerbated shortage in turn prompted the administrations of public hospitals to increase fees and to charge fees on previously free items in the hospital menu of services..... MORE

SC upholds 12% VAT on toll rates By Benjamin B. Pulta 07/23/2011

SC upholds 12% VAT on toll rates

By Benjamin B. Pulta 07/23/2011

A tax on toll paid by motorists will now proceed after a restraining order handed down by the Supreme Court (SC) last year on the implementation of the 12-percent value-added tax (VAT) on tollway rates was lifted by the tribunal.

The high court turned down for lack of merit a petition filed by former Nueva Ecija Rep. Renato Diaz, who was co-author of the expanded VAT Law, and former Trade Assistant Secretary Aurora Timbol questioning the coverage and imposition of VAT on tollway operations by the Department of Finance through the Bureau of Internal Revenue (BIR).

“To dismiss the petition and resolve the issues later, after the challenged VAT has been imposed, could cause more mischief both to the tax-paying public and the government. A belated declaration of nullity of the BIR action would make any attempt to refund to the motorists what they paid an administrative nightmare with no solution,” the decision read.

The high court held that the BIR is not unlawfully expanding VAT coverage by imposing the tax on tollway operators as Section 108 of the National Internal Revenue Code (NIRC) imposes VAT on “all kinds of services” rendered in the Philippines for a fee, with the term “services” given an all-encompassing meaning by Congress..... GMA: No proof of plunder By Benjamin B. Pulta 07/23/2011

SEEKS DISMISSAL, SAYS OMBUDSMAN ALREADY DISMISSED CASE

GMA: No proof of plunder

By Benjamin B. Pulta 07/23/2011

No plunder. No proof. Forum shopping. No Chavez allegation of her having personally benefitted from the alleged diversion of the funds.

These in a nutshell, comprised former President Gloria Arroyo’s defense as she personally filed her counter-affidavit yesterday morning before the Department of Justice (DoJ) in connection with the P550-million plunder complaint filed against her for the supposed misuse of Overseas Workers Welfare Administration (OWWA) funds.

In a 58-page counter-affidavit, the current Pampanga Representative denied the accusation of former Solicitor-General Francisco Chavez that she had conspired with her Cabinet officials to divert OWWA funds to bankroll her campaign.

In her counter-affidavit, Mrs. Arroyo said the complainant, former Solicitor General Francisco Chavez, was unable to present sufficient proof that she accumulated ill-gotten wealth, the primary element that constitutes plunder.

“At no time does complainant allege with particularity, much less attempt to establish through competent proof, that respondent or any of her co-respondents amassed, accumulated, or acquired the asset, property, business enterprises or material possession, asserted to have been ‘ill-gotten,’” Arroyo’s counter affidavit stated..... By Gina Peralta-Elorde 07/23/2011

The Philippine Drug Enforcement Agency (PDEA) yesterday destroyed some P167 million worth of dangerous drugs and expired medicines in Norzagaray, Bulacan.

PDEA Director General Jose Gutierrez said that the destroyed drugs were a registered treatment, storage and disposal facility for hazardous waste owned by Holcim Philippines, Inc. in Barrio Matictic, Norzagaray.

Gutierrez said the activity was in compliance with the requirements of Republic Act 9165, or the Comprehensive Dangerous Drugs Act of 2002, and the Dangerous Drugs Board Regulation No.1 series of 2002 governing the custody and disposition of seized dangerous drugs, chemicals and laboratory equipment.

“The importance of destroying drug evidence is to assure the public that the dangerous drugs seized by the government are not being “recycled” back into the streets,” Gutierrez said..... MORE

On orders of Mayor Herbert Bautista, the city government has declared July 25 a no-classes day to ensure the safety and security of school children who will be affected by traffic problems and rallies by pro- and anti-government groups during the President’s Sona.

Bautista directed Division of City Schools officer-in-charge Dr. Corazon Rubio to immediately send a memorandum to all private and public elementary and high schools for proper dissemination of information on the suspension of classes.

Aquino dared to distribute Hacienda Luisita, junk SDO By Charlie V. Manalo 07/23/2011

Aquino dared to distribute Hacienda Luisita, junk SDO

By Charlie V. Manalo 07/23/2011

Anakpawis Rep. Rafael Mariano yesterday joined the broad Inter-faith rally of farmers, church people and other sectors in Manila to call for the immediate distribution of Hacienda Luisita and the junking of the Stock Distribution Option (SDO) used by the President’s family, the Cojuangco-Aquinos, to gain further control over the 6,453-hectare disputed sugar estate.

Mariano dared President Aquino to make good his promise to distribute Hacienda Luisita and stop his family’s more than five-decade legacy of land grabbing in Tarlac.

“Luisita’s distribution is long-overdue. Farmers and farm workers have suffered enough. Social justice must be served,” Mariano said.

He added farmers and farm workers will boycott the Supreme Court-mandated referendum in Luisita. “We will not allow a repeat of the 1989 and 2010 referendum where the Cojuangco-Aquinos, in collusion with the Department of Agrarian Reform (DAR), arm-twisted the farmers in choosing between land and shares of stocks. Farmers will continue to fight for their rightful share in the lands,” said Mariano who led the Anakpawis contingent at Liwasang Bonifacio..... MORE
