Senators yesterday backed a proposal to strictly scrutinize the financial assets and background of members of the Armed Forces of the Philippines who will undergo the Commission on Appointments (CA) after multi-million pesos worth of ill-gotten wealth belonging to military generals and their subordinates were uncovered.
Sen. Franklin Drilon, assistant majority floor leader of the bicameral body, said documents submitted to the CA by former AFP comptrollers Maj. Gen. Carlos Garcia and Lt. Gen. Jacinto Ligot
indicate that they had insufficient income while they were in the military to purchase several properties and own bank accounts with hundreds of millions of pesos in deposits.

The Philippines and Malaysia will be holding joint exercises in the South China Sea next week amid the “tension” brought about by last week’s harassment of a Philippine exploration vessel by two Chinese patrol boats at the disputed Spratly group of islands in Palawan.

There is also an exercise slated between the RP and United States military 11 days after the MalPhi Laut, military officials said.

Navy spokesman Capt. Giovanni Carlo Bacordo, however, maintained that the March 16 to 26 MalPhi Laut, the annual bilateral naval exercise between the two navies, is not a response to the March 2 incident at the Reed Bank on the disputed Spratlys islands.

Rep. Rodolfo Fariñas, vice chairman the House commmittee on justice, may be itching to impeach the eight Supreme Court magistrates on claimed grounds that three high court justices, publicly perceived to favor Malacañang in their dissenting opinions, were not given their copies of the petition of Ombudsman Merceditas Gutierrez for a Temporary Restraining Order (TRO) on the House of Representatives committee on justice to stop the impeachment hearings, sometime in September last year, but that the status quo ante (SQA) was quickly issued by the majority of the justices.

This is the ground on which Fariñas is said to be basing his impeachment complaint against the eight justices.
Election lawyer Romulo Macalintal yesterday said that the SC justices cannot be ousted on the basis of a TRO or an SQA issued on a case pending before it.

“Even if the TRO or SQA is issued without some justices having read the petition or issued on the same day the petition is filed, this is not a ground for impeachment since the act does not constitute betrayal of public trust or any of the grounds for impeachment,” Macalintal said.... MORE

been officially appointed by Aquino as head of the Bureau of Immigration and Deportation (BID) starting Monday, March 14.

Presidential spokesman Edwin Lacierda made the announcement at a news briefing yesterday after David formally accepted the appointment, thus continuing the practice of retired military brass serving in the civilian government. This after David’s eight-month stint in the AFP.

Eight members of the Board of Trustees of the Government Service Insurance System (GSIS) might find themselves in the hot seat after the Commission on Audit (CoA) revealed they have received in excess of P11.018 million each in 2009.

CoA said the compensation “can be considered as excessive spending of the Pension Fund” because under Section 42 of the GSIS Act of 1997 (RA 8291), Board members were only entitled to P2,500 per diem when they attend board meetings and maximum monthly representation and transportation allowances of P10,000.

“The said provision made no mention of any other allowances/benefits to be received by the member of the board. It is explicit that the member of the board is entitled only to per diems and reasonable RATA. (But) the review of Personnel Services account for 2009 upon complete submission of the supporting payrolls on Sept. 16, 2010 showed that … P88.150 million, or an average of P11.018 million each, was expended for the compensation of the other eight members,” CoA said in its report..... New Zealand police had released the name of one of the 11 Filipinos who perished in last month’s devastating 6.3-magnitude quake in Christchurch.

Ivy Jane Cabunilas, 33, was among those buried in the collapsed CTV building when the quake struck on Feb. 21, police said. Cabunilas was the first Filipino fatality identified by New Zealand authorities.

These are constitutionally dangerous times for the nation, what with a president who has absolutely no respect for the separation of powers principle, as enshrined in the Philippine Constitution.

Noynoy Aquino had directly called on his allies in Congress, majority of whom are Liberal Party (LP) members, to impeach the Ombudsman, Merceditas Gutierrez, and they all agreed to do so.

Such a move brings on a dangerous situation that goes beyond Noynoy’s call to his allies in the House of Representatives to impeach a constitutional officer he personally dislikes, and wants thrown out.

The reason is simple: It works both ways. Noynoy is himself an impeachable official and calling on his LP allies in the House to impeach the Ombudsman and with these same allies agreeing to do so on Noynoy’s marching orders, also means that he can call on these same allies too, to reject any and all impeachment complaints that would be lodged against him or a close buddy..... With Noynoy’s open marching orders to his Liberal Party mates in the House of Representatives to impeach Merceditas “Merci” Gutierrez, LP senators were quick to claim they had no such marching orders from Noynoy by way of handling Merci’s impeachment in the Senate and stressed that they were not present during that luncheon meeting with the LP allies in Malacañang.

Maybe so, since this order to prosecute Merci was mainly for the House to do — at that stage of the impeachment game.

Noynoy did get what he wanted from his LP allies. The House justice committee, as predicted, voted overwhelmingly to find probable cause in the two impeachment complaints, which must have pleased the Malacañang tenant and his sycophants in the House no end, as his orders were heeded. But the question is, will the LP senators and other allies of Noynoy in the Senate who will act as judges also heed an order from Noynoy to convict Merci — not on the merits of the case, but on partisan lines?.... The “Cityhood Laws” were those passed in the last two Congresses converting 16 municipalities into cities whose constitutionality became the subject of heated challenges before the Supreme Court. The petitioner League of Cities of the Philippines (LCP) which groups the existing cities under its then President Iloilo City Mayor Jerry Trenas and, in their personal capacities, Calbayog City Mayor Mel Senen Sarmiento and Trenas himself petitioned the high court to junk the said laws for being unconstitutional and “violative of the equal protection clause.” In its ruling dated Nov. 18, 2008, the court en banc by a vote of 6-5 granted the petitions and struck down the cityhood laws. The respondent 16 cities filed a motion for reconsideration which the court en banc denied on March 31, 2009 by a 7-5 vote. A month after, on April 28, 2009 the high tribunal by a 6-6 vote issued a resolution denied a second motion for reconsideration on the ground that the same was a prohibited pleading. However, the respondent 16 cities persisted and found solace in the court’s June 2, 2009 resolution which clarified its earlier decision and took cognizance of the second motion for reconsideration. It then handed another decision on Dec. 21, 2009 declaring the cityhood laws constitutional by a vote of 6-4. The petitioners questioned this decision and urged the court to reinstate its earlier rulings which the court through a resolution dated Aug. 24, 2010 voted 7-6 to set aside. Finally, after almost a year of review, the high court on Feb. 15, 2011 affirned the constitutionality of the said cityhood laws by the same 7-6 vote. That is latest ruling on this much discussed and reviewed case and will stay until it is overturned..... MORE

The recent speech given by President Benigno Aquino III to the 196 members of the Philippine Military Academy (PMA) Laon Alab Class of 2011 spoke about resisting corruption.

I must say that this is new coming from a Philippine president. In her last speech before the PMA in 2010, for which she was late for about two hours, former President Gloria Macapagal-Arroyo lauded the young cadets for their “brilliance.” The class, according to the PMA superintendent, was “the product of a reformed curriculum,” which emphasizes technology. President Arroyo upheld the importance of excellent education in the future of our youth.

She also made the audience erupt in applause when she announced that the monthly stipend of P10,000 being received by the cadets would become P19,000..... MORE

It was not too much for President Aquino to ask the first batch of PMAers to graduate from their courses under a P-Noy leadership to stay clean.

Heeding the marching orders of President Aquino to ensure the prosection of Ombudsman Merceditas Gutierrez, the House justice committee voted to find “probable cause” to impeach her, with the justice panel chairman Iloilo Rep. Niel Tupas Jr. defining probable cause as “reasonable grounds to support the well-founded belief that the respondent committed an impeachable offense and should be held for trial.”

The votes predictably went the way of the Aquino majority, with the first complaint getting 39 in favor, nine against and one abstention. The second complaint obtained 39 in favor, six against and one abstention.

Gutierrez refused to appear before what she called a “kangaroo court” but appeared unfazed by the threat made by Aquino, stressing, however, that the Liberal Party congressmen and allies of Aquino should have followed the rule of law and not the rule of men.

Aside from the Philippines, Vietnam has also protested to Beijing over its naval activity in the contested waters.

Faculty members of the University of the Philippines College of Law got a slap on the wrist from the Supreme Court over their stand off with the high court over their protest against a ruling by the SC which had been copied from unacknowledged sources.

Speaking to newsmen, Court spokesman Midas Marquez said that “in a vote of 9 to 5 the court admonished (UP College of Law Dean) Marvic Leonen for intemperate language, setting a bad example to law students, but exonerated (lawyer Raul) Vasquez who has apologized to the court, while others (faculty members were) reminded of their duty.”

On the other hand those who voted to find the compliance of UP satisfactory Marquez said were Senior Associate Justice Antonio Carpio and Associate Justices Conchita Carpio- Morales, Antonio Nachura,Martin Villarama and Lourdes Sereno.

At least 13,000 of the estimated 30,000 Filipinos have exited tension-plagued Libya as government teams scour for hundreds more who seemed undecided about leaving and will try to convince them to evacuate as the conflict intensifies.

The latest Philippine government chartered flight left Tunisia yesterday while two more chartered flights are being arranged to bring home Filipinos evacuated in Crete, Greece.

So far, 5,381 have returned to the Philippines since government mass evacuations began in Libya two weeks ago.

The Department of Foreign Affairs (DFA) yesterday said there will be no forced evacuation of Filipinos there amid the escalating conflict but has called on remaining workers there to get out of the troubled North African state and avail themselves of the repatriation being offered by the government. P10.5 billion worth of TCCs go to Shell, Petron not to exporters

Of the almost P11-billion tax credit certificate (TCC) issued by the government last year to exporters as tax refunds, P10.5 billion ended up in the hands of major oil companies, particularly Pilipinas Shell and Petron Philippines, senators were told yesterday.

At a hearing conducted by the congressional oversight committee on the comprehensive tax reform package (COCCCTRP), lawmakers learned that the P10.92 billion TCCs issued by the Bureau of Customs (BoC) last year virtually wiped out the P9 billion excise taxes paid by the oil companies for their imports in 2010.

“This means that aside from enjoying fat profits from their relentless oil price hikes, oil players effectively save millions more on their import taxes through the use of discounted TCCs,” committee chairman Sen. Ralph Recto noted.

The panel is now eyeing of abolishing TCC and replaced it with outright tax refund scheme, limited only to export industry members..... MORE

With a Senate impeachment trial of Merceditas Gutierrez looming, given that the House of Representatives is ensuring that probable cause will be its conclusion, all eyes will now be on how fair or unjust the Senate will be in resolving the case against the Ombudsman.

Although the Senate will hardly admit it, its members earned for itself a black mark when the anti-Erap senator-judges, unable to get the numbers for a conviction, played dirty and threw out all rules and the Constitution during the impeachment trial of the former president, and brought the issue to the streets in a coup by the elite who tried to disguise as a popular and democratic people power revolt.

What is going for Merci today is that her impeachment trial will be headed, not by a shameless Chief Justice who was part of the coup plot to unseat Estrada, but an independent and legal eagle, Senate President Juan Ponce-Enrile. With him sitting as a presiding judge, one can expect fairness in his rulings on whatever motions that come his way..... MORE

Murders and threats on what is promoted as the Southeast Asian nation’s last ecological frontier are emblematic of a struggle across the country, where dozens of environment campaigners have been killed over the past decade.

Father-of-five “Doc” Gerry Ortega became the latest casualty in late January when a hitman shot him in the head while browsing in a second-hand clothes shop along one of the main roads of Palawan’s capital city, Puerto Princesa.

The first National Women’s Day was held in the United States, in 1909. There had been variations of the observance elsewhere such as in Austria, Denmark, Germany and Switzerland in 1911 and in Russia, on 1913, before the United Nations Charter proclaimed gender equality as a fundamental human right in 1945.

Since then, the UN campaign for the advancement of women’s rights has moved toward what has been acclaimed as “four clear directions,” specifically, the “promotion of legal measures; mobilization of public opinion and international action; training and research, including the compilation of gender desegregated statistics; and direct assistance to disadvantaged groups.” It has become a “central organizing principle” of all work done in the UN “that no enduring solution to society’s most threatening social, economic and political problems can be found without the full participation, and the full empowerment, of the world’s women.”

Hereabouts, it was the current president’s mother, President Corazon Aquino, who signed Proclamation No. 224 on 1 March 1988, “Declaring the First Week of March of Every Year as Women’s Week and March 8, 1988 and Every Year Thereafter as Women’s Rights and International Peace Day.” And she didn’t stop there..... In the recent dispute concerning what might have happened if Ferdinand Marcos had not been deposed in 1986, President Aquino is reported to have said that the Philippines would have become another Libya. But if Libya is such a basket case, one struggles to understand the presence there of tens of thousand of OFWs. Did all those Filipinos really choose to work in a country where conditions were worse than in their own?

A piece by David Rothscum (“The World Cheers as the CIA Plunges Libya into Chaos”) on Global Reseach provides some clarification. Libya, he says, has the lowest infant mortality rate and the highest life expectancy rate in Africa. As food prices rose, the Libyan government eliminated all food taxes. The proportion of the population described as malnourished is less than five percent.

“Libya,” says Rothscum, has “the highest gross domestic product… at purchasing power parity… of all of Africa,” and “the highest Human Development Index of any country on the continent... In Libya, a lower percentage of people lived below the poverty line than in the Netherlands.”

This outsider could be wrong, but it seems to me that many Filipinos would probably settle for something like that..... MORE

In complete disregard for the separation of powers principle, President Aquino yesterday ordered his Liberal Party (LP) congressmen and allies not to fail in impeaching Ombudsman Merceditas Gutierrez, telling them that the choice on the issue of whether or not to impeach Gutierrez is “very simple” as it is a choice to have the system remaining rotten or to continue treading his claimed “straight path.”
“The choice is very simple: Leave the system rotten or… to continue treading the straight path,” Aquino told his LP allies.

Aquino appears determined to have the defense walls of the Ombudsman collapse as he gathered House of Representatives LP lawmakers yesterday to ensure that the impeachment complaints filed against her progresses to get rid of the “stumbling block” in his government’s drive against corruption.

Mar Roxas, where he delivered a speech, saying that “Everything that will happen in this government shall be reflected on me since I am the chief. Supreme Court (SC) spokesman Midas Marquez yesterday said efforts to impeach magistrates of the high court should not be done whimsically and urged lawmakers to insulate the tribunal from mundane arbitrary partisan politics.

“There appears to be concerted efforts to bring the court down,” the SC spokesman told reporters in an interview.

Marquez cited the threat of a congressman to file an impeachment complaint against the high court justices in the majority who had voted to issue a status quo ante (SQA) on the House justice committee hearings on the impeachment charges against the Ombudsman, which resulted in a delay in impeachment proceedings.

Nine overseas Filipino workers (OFWs) in Jalu, Libya refused to join hundreds of fleeing Filipinos and other nationalities to escape Libya through the border of Egypt.

If I go home, there will be no work and my family may die of hunger. I will stay until the peace situation here would improve. It’s difficult to live in the Philippines, these were the words of Ernesto Jalumandi, an oil piper in Jalu, Libya who opted to stay there as he relayed it with Teodoro Mahabos who arrived in the country yesterday on board of Gulf Air GF 154 flight.

Mahabos, a native of Eastern Samar, was among the 23 OFWs from Libya that arrived yesterday at the Ninoy Aquino International Airport. Mahabos and Jalumandi worked as oil piper at the Addiar Oil Services Co. in Jalu, Libya, about 600 kilometers away from the Egyptian border.

He said he did not know the full names of the other eight Filipinos that opted to stay in Libay since they have worked on the oil fields..... MORE

Why bother with impeaching the high court justices, when this case will not get anywhere?
But Rep. Rodolfo Fariñas says he will be filing by next week, an impeachment case against all 15 Supreme Court (SC) justices, on several grounds, such as the plagiarism case against Justice del Castillo, the decisions of the justices which Fariñas claimed wrong, as the victims of the high court’s “wrongdoing or excesses” of the justices have been complaining, such as Lauro Vizconde for the court’s acquittal of Hubert Webb, along with the “flip-flopping” decisions of the high court in the cityhood issue, plus the inordinately delay of the high court in resolving cases.

All these charges being leveled by Fariñas against the high court justices are constitutional duties and functions of the high court. It is the SC’s constitutional duty to interpret the laws of the land.

One may well ask Fariñas: Who then is to say whether the decision — any decision of the high court is a “wrongdoing” on account of the fact that the high court ruling acquitted one whom Vizconde wanted the conviction of Webb upheld? Vizconde? Fariñas? The House of Representatives?.... MORE

WASHINGTON — US federal prisons for the past three years have housed special units filled disproportionately with Muslim inmates whose every communication with the outside world is strictly monitored.

Known as “Guantanamo North,” the so-called Communication Management Units (CMU) were secretly opened in 2007 in maximum security prisons in Terre Haute, Indiana and Marion, Illinois and currently have 71 prisoners, the Federal Bureau of Prisons (BoP) told AFP.

The US public radio network, NPR, recently published the names, nationalities and reasons for incarceration of 86 of more than 100 detainees who have passed through them, information never before disclosed by the BoP.

NPR found that a number of detainees were convicted of terrorism offenses but mixed in with them were white supremacists and common criminals..... MORE

Quite apart from the more tempered exchanges after that tragic suicide of former AFP Chief and Defense Secretary Angie Reyes, the Senate inquiry into the plea bargain agreement between retired Gen. Carlos Garcia and the Office of the Ombudsman which spilled over into the use of military funds almost a decade ago brought about a number of lessons. For one, it showed the difficulties confronting the military’s fund managers who have to work out the needs of an Armed Forces at war on several fronts, as it were, within a general budgeting and auditing system geared for civilian work at peace time. The ways and practices of such offices as the Ombudsman and the judiciary as well as the biases and foibles of the office holders were also laid open for the public to see, critique and be perplexed with. Then, there was the legal conundrum accompanying high profile hearings which proved instructive, entertaining and maddening. Imagine having to ferret out the truth amid a babel of conflicting data and assertions from all kinds of parties leading to the sad spectacle of “dirt digging” and finger pointing between and among persons and groups including some who waded into past acts which have yet to find closure. These hearings can be a boon to the kibitzers but a bane to the truth seekers. But there were unexpected blessings which ultimately lingered..... MORE

Ten years ago, a professional civil servant from the Commission on Audit (CoA) named Agustin Chan was in the thick of investigating a P224-million anomaly in a special fund earmarked for the tobacco industry. The trail that led to the northern provinces became his basis for issuing “tracers” or demands for government officials who were directly responsible to answer his queries.

In particular, he wrote the Ilocos Sur provincial accountant on Sept. 4, 2001 for a listing of expenditures charged against the fund for that year, as provided for by Republic Act 7171. But even before that, he already raised the matter in April 2001 to the governor of the province who usually got the biggest allocation, Chavit Singson, to liquidate P124 million in accumulated cash advances or be made liable for “malversation of public funds.”

Six months later, CoA auditor Chan and his driver Alex Recacho were ambushed and killed along the national highway, in Sitio Baoay, Barangay Paing, Bantay, Ilocos Sur. Neither the Yellows, in “civil society” or academe, nor the institutional Catholic Church ever let off a squeak to denounce these twin murders.
Fast forward 10 years: March 3, 2011, Ateneo de Manila. A religious mass cum candle-lighting ceremony was held at the Church of the Gesù with white robed participants and melodramatic chorale evoking a sanctified (or sanctimonious) air to honor “whistle-blower” Heidi Mendoza who testified on the massive corruption in the AFP (Armed Forces of the Philippines).

Since her testimony a few weeks ago, a teleserye-like atmosphere has unfolded, with heart-wrenching cries and spiels (a la ZTE-NBN crybaby Jun Lozada), along with nuns and priests “securing” her, a dramatic backstory of her resigning from a “corrupt government,” peppered with “public clamor” for her to return because “her children asked her to,” and then, an offer of the CoA chairmanship from the President, to which Mendoza was quoted to have said, “I won’t give him a hard time (convincing me).” Wow naman, how cute!


Yet what is the reason for this blatant double standard in civil society’s treatment of one CoA auditor over another? Here, I am not only comparing the Jesuit institution’s treatment of Agustin Chan to their darling today but to many others also killed in the line of duty, such as State Auditor IV Anita Gallito, head of the CoA Unit at the Education Department’s Division Office in Tandag, Surigao del Sur, who was gunned down in front of her home in Tago town.

These killings of Chan and Gallito shocked the audit community; but there never was a quip from “civil society.” Neither has the Ateneo nor its affiliates, such as its School of Government, given due credit to those who first raised and exposed the AFP corruption issue and started it all — the Bagong Katipuneros (a.k.a. Magdalos). Why is it that all the accolades seem reserved only for the Ateneo and civil society’s “darling?”

Weeks before the “Mendoza-as-CoA chairman” drama aired, our “investigator” Oliver already alerted us to the “plot” to appoint Mendoza. At the time, no one had the dimmest idea of that yet, as media were not even aware of the then CoA Chairman Reynaldo Villar’s avowed legal battle to stay on in his post.

Oliver attributed the push for Heidi Mendoza’s elevation to the “usual forces that wish to privatize government functions,” i.e. the same people who pushed for Swiss firm SGS to take over Customs functions and for Vitaliano Nañagas to be appointed as chairman of the Social Security System (SSS) in 2001 to privatize the fund, only to be deposed by SSS employees. He then cited the grapevine’s report of a foreign private company expected to be subcontracted for CoA’s financial audit functions in the event of a Mendoza appointment.

I remained skeptical until I heard American gofer Harvey Keh of the Ateneo School of Government at the Ciudad Fernandina Kapihan, floating Mendoza’s name for the chairmanship of the CoA. Coming from Keh, who represents an institution that has spawned quite a number of apologists for the likes of CodeNGO, this is another sure sign of foreign interests at play.

Make no mistake: Heidi Mendoza is an asset from SGV, a breeding ground of corporate operators such as the Hyatt 10’s Cesar Purisima (who wants to restore SGS to Customs). And just as it was for Cory Aquino since Edsa I, Gloria Arroyo in 2001, and now, Aquino III, Heidi is being made out to be another “gift from God” by the Yellows.

However, 25 years of Cory’s legacy and 200 days of Aquino III have only shown that “gifts from God” do not necessarily deliver heaven on earth. There have been and there are many more heroic public servants whom the Ateneo, the Jesuits, the nuns, and civil society have inequitably and inexplicably never sought to give due respect to, and more whistle-blowers than they have ever reached out to help, such as the late Sammy Ong (who exposed Hello Garci), anti-jueteng witness Sandra Cam, along with Jose Barredo and Dante Madriaga of the fertilizer fund and ZTE-NBN scams, respectively.

Given the record of these Yellows and their patrons in giving the Filipino nation such “gifts from God,” we should henceforth be wary of another one. After all the hype surrounding the conferment of “sainthood” to the Yellows’ icon, the Filipino people are almost certain to open the gates of their hearts again — this time, to another Trojan horse — only to regret it a little too late.

Days after the Taylor Swift concert, many little girls were still in seventh heaven. One of them, whose first live concert it was, bubbled over with little anecdotes and exclamations — what a treat, what a night, what a once in a lifetime experience!

Meanwhile, her parents were muttering about how expensive the tickets were, and how they were made to wait for the actual tickets to get to their hands. They had days of nerve-wracking agony, not knowing if their girls would really be able to watch the much-awaited concert. Rumors abounded — organizers had oversold tickets, and there were no more tickets to be found. I endured six hours of wait for Taylor Swift.

I did it for my two daughters, one is 12 and the other eight. And also for their mom, a closet Swift fan, for not refusing to get tagged along just two weeks back for the China Crisis concert at The Venize Piazza at The Fort.

I did not watch Taylor Swift. I was just the designated “lineman,” the one tasked to fall in line in their place, calling them to fill the slot when their turn near the gate is near.
As soon as I broke the line, I also had to endure two more hours of waiting for the concert to end and meet them for dinner.

Malacañang said yesterday it is sending a Spratlys specialist to China in the next few days to take up the near encounter in the disputed islands even as a senator warned that the incident involving Chinese patrol ships and a Philippine exploration vessel will definitely be raised by China during coming negotiations on the fate of three Filipinos facing execution in the mainland for drug offenses.

Sen. Miriam Defensor Santiago said the incident will definitely have a “negative” impact on the discussions.
Santiago also warned against further incensing China.

“(The convicts) would probably have better chances at a favorable decision had (the government) not sent a unit in the Spratlys,” Santiago said.

The Court of Appeals (CA) has ordered the dropping of  criminal charges filed against shareholders of the Philippine International Air Terminals Co. Inc. (Piatco).

The appellate court held that the Manila RTC erred in granting the appeal of complainant, lawyer Jose Bernas, and in ordering the Metropolitan Trial Court (MeTC) to conduct further proceedings on the case against Piatco shareholders for allegedly taking part in a conspiracy or combination in restraint of trade to monopolize services contracts at the Ninoy Aquino International Airport (NAIA) Terminal 3.

In an eight-page ruling  by Associate Justice Josefina Guevara-Salonga, the CA’s Fourth Division reinstated the February 23, 2007 order issued by the MeTC which granted the motion filed by the Department of Justice (DoJ) to withdraw the charges against Piatco’s shareholders.

Another former Armed Forces of the Philippines (AFP) chief of staff, Gen. (ret.) Roy Cimatu, was sought for an Ombudsman probe yesterday for his unexplained properties as President Aquino named new AFP head, Lt. Gen. Eduardo Oban, who Aquino said is expected to continue with reforms to end entrenched corruption in the force.

Sen. Franklin Drilon said it’s unlikely for Cimatu to be unaware of the real properties he and his wife allegedly own in Iloilo and recently exposed in the Senate.

“What he claimed was that he didn’t know, that it was registered under his and his wife’s name. What’s surprising to this is that there is a document where the properties were mortgage in Aug. 2010 for P24 million. Cimatu was a signatory to the loan. He had to affix his signature as well as his wife because they’re the registered owners of the properties,” he said in an interview over at dzBB.

The Department of Foreign Affairs (DFA) has called on all Filipinos trapped in the raging conflict in Libya to avail themselves of the repatriation being offered by the Philippine government as it prepares to wind down its operations within the week.

DFA spokesman Eduardo Malaya said those who wish to be evacuated must immediately inform Philippine consular teams of their location or proceed to pick-up areas.

He added the department will begin arranging land exit for the undetermined number of Filipinos who remain in Libya after the government-chartered ship made its second and final sail to Libya over the weekend, carrying 1,103 Filipinos, including dependents of diplomats and non-essential personnel of the Philippine Embassy.

“We will have a mop-up operation for one week and will look for more Filipinos who wanted to go home to the Philippines,” Malaya said on dzBB radio..... MORE

In the information filed against Duterte, the Ombdusman’s office said that there is “basis for the finding of probable causes against respondents (Duterte, et al. ) for Violation of Section 3(e) of Republic Act 3019 as the following elements were sufficiently established by the evidence: (1) respondents were public officers discharging administrative, judicial or official functions; (2) respondents have acted with manifest partiality, evident bad faith or gross inexcusable negligence, and (3) respondents have caused undue injury to any party, including the government, or gave any private party unwarranted benefits, advantage or preference in the discharge of their functions..... Lawmakers participating in the impeachment case against Ombudsman Merceditas Gutierrez should come clean and tell the panel that they are not going to be biased despite their pending cases before the Office of the Ombudsman.

According to Camiguin Rep. Pedro Romualdo, some of his colleagues in the panel “do not have the face” to admit their possible bias against the Ombudsman.

He was reacting to the statement of justice committee chairman and Iloilo Rep. Niel Tupas Jr. that the partiality or impartiality of the members of the panel should be judged by the public.

The Department of Foreign Affairs (DFA) has called on the Senate yesterday to implement effective measures to promote human rights by immediately ratifying the Rome Statute, which established an international tribunal that prosecutes war crimes and other crimes against humanity.

President Aquino, who touts himself as a strong advocate of human rights, signed and endorsed the statute of the International Criminal Court (ICC) on Feb. 28 to the Senate, a move which his predecessor, Gloria Macapagal Arroyo, failed to do in her nine-year presidency.

Manila became a signatory to the agreement in Dec. 28, 2000. Since then, 108 countries have already ratified the treaty.

The Philippine military and police have expressed reservations to the statute’s ratification, saying leftist groups may take advantage of the agreement and file frivolous and politically motivated cases against them. The international community led by the United Nations and European Union have scored the Philippines’ dismal human rights record due to continuing incidents of extra-judicial killings of members of militant groups..... Army chief Lt. Gen. Arturo Ortiz has passed his chance to become the only Medal for Valor awardee to head the 120,000-strong Armed Forces of the Philippines after begging off to President Aquino to be considered for the Armed Forces of the Philippines (AFP) top post.

Ortiz was interviewed by Aquino last Jan. 24 as part of the Commander in Chief’s process of selecting the next AFP chief as incumbent AFP Chief of Staff Gen. Ricardo David Jr. is reaching the mandatory retirement age of 56 tomorrow.

Defense Secretary Voltaire Gazmin and David were present during the interview. Initially, Ortiz said he relayed his decision to beg off from being considered for the top AFP post to Gazmin, who himself a former commanding general of the Army during the time of former President Estrada. Ortiz said Gazmin understood his position.

“During my interview with P-Noy (President Aquino) last Jan. 24, I told P-Noy that I felt I could contribute more to the organization if I would be allowed to remain as CGPA (commanding general, Philippine Army) so I could continue what I have started and also undertake other plans and programs for the Army rather than be a short-term CSAFP (chief of staff, AFP),” said Ortiz..... Is China trying to have a feel of the political resolve of Noynoy with its stepped up activity in the disputed Spratlys, including the trailing of Chinese patrol boats of a government oil exploration team clearly within the Philippine boundary off Palawan?

The recent incident happened after a report said new structures have been built by China on islands that are part of the disputed areas.

China has been vigorous in asserting its claim over the areas covering Spratly islands which is believed to be potentially rich in oil.

It appears that the incident was not a chance encounter between Chinese ships and the government exploration vessel, as this episode happened just after the government obtained a reprieve for the execution of three Filipino death convicts..... MORE

Just what charges constitute betrayal of public trust that is enough to convict an impeachable officer?

If the House justice committee chairman and his members say that the charges enumerated in the two complaints are sufficient in form and substance, and that there is no longer any need for any reason to come up with probable cause, since impeachment is a political proceedings where members of the justice committee merely vote for the complaint to send this to the Senate, through the required number in plenary voting, what are they to do, should someone lodge an impeachment complaint against Noynoy Aquino on the same grounds, following the same charges raised by the two leftist party-listers, Akbayan and Bayan Muna? Change the rules again, and simply reject the complaint as not substantial in form and substance? And since it is their ally that will be the subject of an impeachment complaint, will the same justice committee panel say that this is a political proceeding and not a judicial proceeding where the rules of evidence are followed?.... Washington DC is procrastinating on frantic calls from concerned quarters to impose a “no-fly zone” for all types of aircraft in Libya as an option to topple strongman Moammar Gadhafi from power, and more importantly prevent further unnecessary bloodshed. The estimated unconfirmed death toll has been placed at around 2,000, but this is expected to rise further as the fighting goes on unabated.

The White House is said to be hesitant in resorting to such a drastic measure in the North African powder keg as it says it is quite risky for both sides and would surely complicate matters with regard to the world’s other superpowers who are interested in the speedy resolution of the Libyan problem due to the billions of barrels of oil still stored under its desert sands.....
