In what is now billed as “the longest underground entrapment in human history” (which they say could make it to the Guinness World Records), 33 miners came out alive and well in a serious mining mishap in Chile recently.

Just like that time in August when a number of tourists’ lives were at stake right here in Manila as our local authorities struggled to deal with the situation right before the world’s judgmental eyes, Chilean authorities took on the challenge and emerged victorious.

The world applauded what online stories cite as a “meticulously planned rescue operation” where six rescuers had all 33 men “safely above ground in 22 hours, 37 minutes” since it began. “One after another, the miners climbed into a missile-like steel capsule barely wider than a man’s shoulders and took a 15-minute journey through 2,000 feet of rock to the surface,” goes an article in msnbc.msn.com.

Waiting at the end of the miners’ ordeal was Chile’s President Sebastian Piñera along with the miners’ families and an eager crowd..... MORE

Truth body’s findings won’t stand in court

By Angie M. Rosales 10/18/2010

The recently activated Philippine Truth Commission (PTC) lacks a legal personality and its creation is against the Constitution, which are reasons that may deny the body’s findings a leg to stand on in the courts, a senator said yesterday even as the fact-finding body began its task of investigating irregularities committed under the previous administration.

Sen. Miriam Defensor-Santiago yesterday expressed reservations whether the findings and recommendations of the body will be able to stand in court.

In a radio interview, Santiago said there’s no constitutional authority allowing the Executive Branch to create bodies like the PTC.

“They created a body that will only prove to be problematic,” she added..... MORE

Disaster center establishment should be prioritized — Angara

10/18/2010
As the northern part of the country is threatened by super typhoon “Juan,” Sen. Edgardo Angara yesterday said the establishment of the Disaster Science Management Center (DSMC) should be a national priority to better prepare the nation for dealing with similar disasters.

According to the Philippine Atmospheric, Geophysical and Astronomical Services Administration (Pagasa), Juan is still strengthening and could bring rains like “Ondoy” and winds like “Basyang.”

“We need the DSMC to help us prepare for the typhoons and similar disasters that will continue to threaten the country. The government needs to be able to understand how to develop an advanced and real-time information disse-mination strategy so people can better prepare to handle such events,” the lawmaker, in a statement, said.

He added that “we need to adopt a pro-active approach in order to properly address this problem. A scientific approach supported by extensive research has already led me to appropriate P100 million from the budget for the establishment of a Philippine Disaster Science Center, roughly P40 million of which is allocated for a proposed Disaster Science Management Center.”.... House to probe HGC over anomalous deals

By Gerry Baldo 10/18/2010

Another government housing agency, the Home Guaranty Corp., is under fire after the House committee on housing and urban development indicated plans yesterday to launch a full-blown investigation into alleged anomalous transactions entered into by the agency that resulted in millions of pesos losses to the government.

According to Rep. Bernadette Herrera of the party-list Bagong Henerasyon, the alleged “transactions entered into by the Home Guaranty Corp. has put the national government in a highly disadvantageous position.”

Citing reports by the Commission on Audit, the lawmaker stressed that the agency, aside from allegations that it has been mismanaged, has figured in several anomalies since 2002, particularly on the sale of its properties.
“The CoA alleged that the losses were due largely to mismanagement by HGC officials — mainly sale of corporate properties way below market prices,” Herrera said..... MORE

Comelec in crisis anew a week prior to polls

10/18/2010
A week before the nationwide barangay and Sangguniang Kabataan elections, the Comelec admitted being confronted with wasted voting forms, delayed procurement of election materials and a shortage of ballot boxes.

Comelec Commissioner Rene Sarmiento said that it is looking into the reason for the huge spoilage in the printing of ballots of the National Printing Office (NPO) headed by recently appointed director Manuel Andaya. Sarmiento said the Comelec will ask Andaya to explain a high five percent wastage in the printing of ballots compared to the average two percent spoilage rate of the NPO in past ballot printing.

The Comelec’s Bids and Awards Committee (BAC) had notified the Comelec en banc of the need to purchase additional 300 reams of ballot paper due to the high NPO spoilage rate.

Sarmiento said that the purchase of the extra ballot papers would cost the Comelec P14.5 million..... MORE

Thousands evacuated, Signal No. 4 up in Cagayan, Isabela

By Mario J. Mallari and Jason Faustino 10/18/2010

Typhoon “Juan” gathered strength as it barrelled through the northern part of Luzon yesterday, as authorities began evacuating thousands of families to safer ground hours before it was to hit land.

The Philippine Atmospheric, Geophysical and Astronomical Services Administration (Pagasa) said Juan has developed into a super typhoon and was expected to slam into the extreme northern Philippines today and then cut westwards toward the South China Sea.

Government forecasters also upgraded to Signal No. 4 its storm warning in the provinces of Cagayan and Isabela.

Juan could uproot trees, blow away houses made of light material, trigger landslides and cause storm surges in coastal areas, authorities said as they began evacuating people from vulnerable communities..... MORE

The bicameral Commission on Appointments (CA) has confirmed the appointment of a career diplomat as the country’s new envoy to Hungary and approved the promotion of 59 officers of the Department of Foreign Affairs while the Aquino administration firms up its list of new ambassadors to be assigned to vacant diplomatic missions abroad.

Monina Estrella Callangan-Rueca was named Ambassador Extraordinary and Plenipotentiary to the Republic of Hungary in the CA’s plenary session held last Oct. 13.

Callangan-Rueda, who replaced Alejandro del Rosario, a political appointee of former President Gloria Arroyo, will also have concurrent jurisdiction over Bosnia and Herzegovinia, and Serbia and Montenegro.
The CA, on the other hand, deferred the confirmation of Consuelo Puyat Reyes who had been nominated as ambassador to Chile; Mercedes A. Tuason as ambassador to the Vatican, and Noe A. Wong as ambassador to Cambodia. They served under Arroyo and have been retained by President Aquino.

Also confirmed as Chief of Mission Class I were: Eduardo Pablo Maglaya, Virginia Benavidez, Luis Cruz. Carandang gets P50 million to craft Noynoy’s communications

By Gerry Baldo 10/18/2010

Communications Secretary Ricky Carandang got P50 million the original amount which was allotted to him not the P200 million he intended to get.

Under the P1.645-trillion General Appropriations Act (GAA) 2011 which had been approved on second reading before Saturday dawn, the Presidential Communications Development and Strategic Planning Office (PCDSPO) budget will be limited to P50 million as earlier allotted by the Office of the President.

The amount of funding for Carandang’s office came after Budget Secretary Florencio “Butch” Abad submitted a budget errata document last week to Cavite Rep. Joseph Emilio Abaya, chairman of the House committee on appropriations proposing to increase the group’s budget to P200 million from P50 million.

Based on the approved budget of Carandang’s office, he will be given P18 million for personal services, P30 million for maintenance and other operating expenses (MOOE) and P2 million as capital outlay (CO)..... MORE

It took Noynoy Aquino and his administration to bring back the International Monetary Fund (IMF)’s intrusive presence in the country and no thanks to Finance Secretary Cesar Purisima, who despite being in the Cabinet of Noynoy, remains the governor of the World Bank (WB) Group and the Asian Development Bank and alternate governor for the IMF for the country.

With his conflicting interest, Purisima could also be credited for the facilitation of the $434-million Millennium Challenge Corp. (MCC)’s supposed anti-poverty grant Noynoy recently snagged in his US visit.

Also, with apparent help from Purisima, the WB contributed an additional $59.1 million for the expansion of its Kapitbisig Laban sa Kahirapan-Comprehensive and Integrated Delivery of Social Services (Kalahi-CIDSS) project on top of the $120 million component for Kalahi-CIDSS of the MCC compact grant.
All of this, however, expectedly comes with a price..... MORE

To this day, Noynoy Aquino blames media for sympathizing with former Philippine Atmospheric, Geophysical and Astronomical Services Administration (Pagasa) chief Nilo Prisco, whom he had fired — and without due process — when Prisco failed to predict the right path of a typhoon.

Noynoy at that time said that because of Prisco’s inefficiency, the government was left unprepared for the typhoon.

He blasted Prisco and quickly replaced him with his appointee, and even used Pagasa under his new appointee as an achievement, during his first 100 day speech.

A good guess is that Prisco got a lot of public sympathy mainly because he was fired on the spot, without Noynoy having given him that due process he keeps on claiming is much too important in the course of justice.
And if Prisco’s case always manages to crop up, it is mainly because the general public sees for itself just how selective Noynoy can be when it comes to his “dispensing” due process..... MORE

Botched Afghan rescue would spell trouble for SEALs — experts

WASHINGTON — If a Navy SEAL is confirmed to have accidentally killed a British hostage during a rescue operation in Afghanistan, it will have serious repercussions for the elite US unit, experts said Thursday.

Commanders reviewing surveillance video of the operation to save British aid worker Linda Norgrove spotted a SEAL throwing a grenade into the captors’ building who could now face disciplinary action, two Western officials told AFP.

The alleged incident comes as US and Nato forces stepped up special operations over the past year, claiming some success in rooting out the Taliban and other militants from their strongholds.

Fragmentation grenades — rather than non-lethal stun or smoke grenades — are rarely used in delicate hostage rescue operations and the assault team commander likely had access to detailed intelligence, including Norgrove’s location, experts noted.

“It’s highly unusual,” said Bill Roggio, managing editor of The Long War Journal, a Web site tracking counterterrorism operations.... MORE

The Philippine National Police’s resident horn-blowers are making a big to-do about the order recently released by their chief Raul Bacalzo, Ph. D banning all police officers from playing golf during office hours.

Bacalzo, in a statement released by his office, said this is part of the “moral transformation program” covering all PNP members at all levels of the command throughout the country. He noted, and correctly at that, that several PNP officials who are predominantly from the corps of generals have this bad habit of leaving their posts any ol’ time they pleased to rush over to the Camp Aguinaldo or Villamor Air Base golf course for nine holes, which is why there is so much backlog in their respective work load and they can hardly get anything done anymore.

But if you were to properly digest the spirit of order, you’d see what Bacalzo is raging at and desperately wants to put a stop to are the “cheating ways” of colleagues who think nothing about shortchanging the Filipino people, who are paying their salaries, by sneaking out of the office to play a round of the game of the royal and ancient..... Church and churchmen

VIEWPOINTS
Archbishop Oscar V. Cruz
10/17/2010
There is a fundamental, real and essential distinction between the Catholic Church and the Catholic churchmen. This signal and living reality could be easily overlooked if not actually ignored. Yet, its significance and consequences however may not be over-emphasized — even if only for a clearer and better understanding of the Church and the churchmen. To unconsciously miss or deliberately ignore this profound and relevant truth is not merely pitiful but also disastrous for all those concerned, viz, the people in general, the churchmen in particular, and the Church in a special way. In other words, let the Church and churchmen be not confused with one another — under penalty of confusion and falsity.

The Church is the ecclesial Institution founded by Christ some 2,000 years ago, The Church is but one of a kind, apostolic in origin, universal in scope and holy on account of her Founder the Lord Jesus Himself — the Son of God. Everything that is intrinsic to the Church is holy — like her doctrine, her sacraments, her devotions, her prayers. In short, a Holy Founder established a Holy Church for holy purposes here and now, in view of a holy destiny hereafter and beyond..... MORE

Abandoned by authorities, the addicts live in fear of drug gangs who threaten and sometimes kill them for no apparent reason, including several brutal massacres in drug treatment centers.

‘EO 1 CHALLENGE WON’T BOG DOWN PTC’

Only SC TRO can halt truth body — Malacañang

By Aytch S. de la Cruz 10/17/2010

Unless the Supreme Court (SC) issues a restraining order, the Philippine Truth Commission (PTC) will not concern itself with petitions questioning the legality of the body pending with the tribunal, Malacañang said yesterday.

Echoing the views of PTC chief and former SC Chief Justice Hilario Davide Jr., deputy presidential spokesman Abigail Valte said it’s just appropriate for the truth body to finally start working because of the limited time period of only two years it was given to complete its mission.

The PTC was created by virtue of President Aquino’s Executive Order 1 that Malacañang released last July 30 which aims to revisit allegations of corruption and irregularities of the previous administration, citing former President and now Pampanga Rep. Gloria Arroyo as its top respondent along with other past officials who were suspected of having been involved in cases of corruption.

“We all know that there is a pending challenge on the constitutionality of the executive order creating the Philippine Truth Commission. But that, in itself, we should (consider) the statement made by one of our commissioners (in the PTC) and I think former Chief Justice Davide mentioned it also that we cannot let this issue to bog their work down,” Valte said.

Davide and Malacañang are holding on to their belief that because the high court had not yet acted on the motions filed by opponents of EO 1, composed mostly of Arroyo’s allies led by Albay Rep. Edcel Lagman, nothing should stop the PTC from executing its functions..... MORE

Vice President Jejomar Binay has been given another hat to wear in the Aquino administration as Malacañang yesterday confirmed his designation as presidential adviser on the overseas Filipino workers’ (OFWs) concerns.

The information came from the office of Executive Secretary Paquito Ochoa Jr. and was relayed to reporters by Presidential Communications Operations Office chief Herminio Coloma hours after deputy presidential spokesman Abigail Valte announced President Aquino’s latest batch of appointees.

Binay holds the chairmanship of the Housing and Urban Development Coordinating Council in the Aquino Cabinet.

P1.6-T budget clears 2nd reading in House

By Charlie V. Manalo
After a record 10 session days of grueling marathon plenary debates that ended before dawn yesterday, the House of Representatives passed on second reading the government’s proposed P1.645-trillion “reform” budget for next year.
“We lost sleep, but kept our word,” Speaker Feliciano Belmonte Jr. said after the budget was approved at 3 a.m. yesterday.

The top 10 departments receiving the biggest allocations in the proposed budget are: Department of Education (including Educational Facilities Fund), P207.3 billion; Department of Public Works and Highways, P110.6 billion; Department of National Defense (including pension and the AFP Modernization Program), P104.7 billion; Department of the Interior and Local Government (including pension), P88.2 billion; Department of Agriculture, P37.7 billion; Department of Social Welfare and Development, P34.3 billion; Department of Health, P33.3 billion; Department of Transportation and Communications, P32.3 billion; Department of Agrarian Reform, P16.7 billion, and the judiciary, P14.3 billion.

Since its presentation to Congress on Sept. 1, the proposed budget faced tough public scrutiny.
First to protest was the judiciary which decried its appropriation of P14.3 billion or P9 billion lower than what it requested from the DBM..... MORE

Sen. Miriam Defensor Santiago yesterday reiterated her call to terminate the Visiting Forces Agreement (VFA), saying even though President Aquino is considering “refinements” to the controversial treaty, Congress can still unilaterally terminate the VFA.

The lawmaker was reacting to reports that Aquino has informed US Ambassador Harry Thomas Jr. of a plan to “refine” the VFA and “make it better.”

Palace vows not to interfere in court verdict on mutineers

10/17/2010
The Palace will not interfere in a scheduled court decision on the coup d’état charges filed against former Lt. Senior Grade and now Sen. Antonio Trillanes IV and the rest of his fellow Magdalo insurgents to be issued by Makati Regional Trial Court Judge Oscar Pimentel on Oct. 28 even as a noted lawyer said that it would be proper for the court to defer prosecuting cases involving the mutineers in view of President Aquino’s issuance of Proclamation 50 which grants amnesty to them.

Deputy presidential spokesman Abigail Valte said Aquino’s amnesty grant to over 300 rebel soldiers will not stand in the way of the judiciary which she said has the jurisdiction over the mutineers’case.

She added that the Palace is still waiting for the Congress’ and the Senate’s concurrence on Proclamation 50 released by Malacañang last Tuesday.

“That (promulgation) is perfectly within the ambit and the jurisdiction of Judge Oscar Pimentel—we are not interfering on that. But, of course, as everybody knows, we are waiting for the concurrence of Congress. The waiting goes on and the process (toward granting) amnesty (to the rebel soldiers) continues and that will proceed separately from the track that the case is going to take with the regional trial court,” Valte said on radio.

Aquino’s amnesty grant raised eyebrows among his critics who questioned its timing suspecting a political move that encroached on the jurisdiction of the courts..... MORE

Noynoy Aquino appears to have a different and illogical interpretation when it comes down to the separation of powers principle.

For him, whenever he, as the Chief Executive, signs an executive order, this cannot be looked into by a co-equal branch of government, which would be, in the most recent case, the Supreme Court. To Noynoy, for the SC to check into this issue is already interference by a separate and co-equal branch of government — the executive branch.

For Noynoy, with the high court having issued a status quo ante order on both the House of Representatives in the case of stopping the proceeding of the impeachment complaint against Ombudsman Merceditas Gutierrez and the same order for a Noynoy-claimed “midnight appointee” is already a case of the high court meddling into the affairs of the presidency.

He has gone as far as threatening a constitutional crisis on account of a clash between the judiciary and the executive branches of government and even went further by accusing the high court of aiding and abetting corruption, as well as derailing his claimed reform program — and all because the high court issued a stay order..... Frankly, the creation of the truth body is a waste of money — some P80 million of it in the 2010 budget, mainly because it is powerless and it may well be as powerless as the IIRC panel, which worked hard to get at the bottom of the botched hostage rescue, indicting several officials and police officers, only for Noynoy and his legal counsels to overturn the sanctions and absolve his buddy and allies, as the claim was that the panel’s findings were only recommendatory.

In much the same way, Noynoy Aquino also threw out the findings and recommendations of the Feliciano fact finding commission on what the executive must do to stop the coups d’etat and military adventurism, which definitely should ban amnesty for rebel soldiers.

Noynoy issued a grant of amnesty, even claiming this order to be executory with his signing, which is flawed, as such cannot be implemented unless and until Congress concurs in it.

Also, it was the wrong time to issue an amnesty offer, considering that the promulgation of the judge handling the Magdalo coup d’etat charge was just days away, which showed Noynoy’s disrespect for the judiciary..... MORE

SHANGHAI — Piggybacking on the reputation for quality built by the cars and machines made by their compatriots, German consumer goods brands are feverishly wooing Chinese customers as they try to catch up with their French and Italian rivals in a fast-growing market.
Germany has successfully exported its Volkswagen, Audi and BMW cars to China for years, as well as machine tools and chemicals.

Makers of household appliances, furniture and fabrics are now trying to use the cachet of the “Made in Germany” label to tap into well-heeled Chinese consumers’ appetite for products that show off their prosperity.

“The Chinese market for household goods is the largest in the world,” said Markus Kepka, head of kitchenware maker Fissler.

But German manufacturers’ share of that market stands below one percent, way behind their rivals from France and Italy, who lead the way in luxury and lifestyle products.

MANILA – The impeachment of Ombudsman Merceditas Gutierrez plays a crucial role in the prosecution of Mrs. Gloria Macapagal Arroyo and her cohorts. Gutierrez’s perceived loyalty to the Arroyos has prevented and would continue to prevent her from making the right judgment in the plunder cases that have and will be filed against Gloria Macapagal-Arroyo, the Bagong Alyansang Makabayan (Bayan) said in a statement.

Bayan is a respondent in the impeachment complaint filed before the House of Representatives’ Committee on Justice. Two impeachment complaints against Gutierrez have been filed in Congress, one by former Akbayan representative Risa Hontiveros, and another by Bayan secretary general Renato Reyes, Mother Mary John Mananzan, co-chairwoman of Pagbabago! People’s Movement for Change, national president of Confederation for Unity, Recognition and Advancement of Government Employees (Courage) Ferdie Gaite, Atty. Edre U. Olalia, secretary general of National Union Peoples’ Lawyer (NUPL), Kilusang Magbubukid ng Pilipinas (KMP) secretary general Danilo Ramos and League of Filipino Student (LFS) chairman Terry Ridon, respectively.

“Ms. Gutierrez has held the position of the Ombudsman for five years, but until now she has not prosecuted nor was she able to hold accountable erring government officials involved in a number of high-profile cases of graft and corruption. Instead, she has allowed her office to be used as an instrument for covering up the impropriety of the previous administration,” Pagbabago said in an open letter addressed to the House of Representatives, asking the lawmakers to support the impeachment complaint against Gutierrez.

Pagbabago said Gutierrez, an appointee of Arroyo, has been ignoring cases involving Arroyo, her family and other high-ranking government officials such as those named in the impeachment complaint. The cases include the NBN-ZTE deal, the fertilizer fund scam, the Mega Pacific deal, the Hello Garci scandal, and the Euro Generals scandal, all of which have already been found anomalous either by the Senate or by the Supreme Court..... Calling the Aquino government as a “haciendero regime” and the “number one enemy of peasants,” progressive farmers’ organizations from Central and Southern Luzon would converge at the office of the office of the Department of Agrarian Reform before marching to the historic Mendiola bridge on October 21.

MANILA — Farmers and agricultural workers from all over the country are asking for nothing less than genuine agrarian reform when they start observing Peasant Week on Oct. 18, Monday.

“We have proven that for more than a year after it was passed, the Comprehensive Agrarian Reform Program with Extension (CARPER) is also inutile,” Anakpawis Representative Rafael Mariano told Bulatlat. “It is now time to look into the free land distribution scheme, which is the framework of the Genuine Agrarian Reform Bill.”

The Peasant Week is annually observed by progressive farmers’ organizations to renew their vow to fight for a genuine agrarian reform program that will solve the centuries-old land problem in the country.

The theme of this year’s peasants march is “Lakbayan ng mga Magsasaka Laban sa Hacienderong Rehimen ni Aquino” (Long March of Farmers Against the Hacienda Regime of Aquino). At the north leg of the march in Luzon farmers would hold their first vigil in Tarlac on Oct. 18 while the Southern Tagalog Wing 1 and 2 would hold their vigil in Alabang and Batangas, respectively. The different groups are expected to converge at the Department of Agrarian Reform office in Quezon City on Oct. 21 before marching towards Mendiola in Manila..... MORE

“Filipino students could hardly finish up to sixth grade. How much more with K+12?” – Kabataan Party-list.

MANILA — Like most parents, Al Hermogeno, 30, has no other dream but to see his children graduate from college, believing that education would be the only way to uplift the family from poverty. However, his income as a water delivery boy is barely enough for his family to survive, making it impossible to even send his children to a good school.

For every five gallons of water he could deliver to a household, Hermogeno earns only P5.00 ($0.11. He is lucky if his regular customers give him a tip. Late last year, his family was forced to live separately to survive. His wife Maricar, 28, and their youngest Maxene, 5, left for Laguna because they could no longer pay for the room they were renting in Pasay City. The eldest CJ, 7 years old, followed his mother to Laguna after finishing the school year in March 2010.

“I work hard so that my children could finish schooling and hopefully graduate from college, even at a state university,” Hermogeno said in Filipino, adding that it is the only treasure that he could pass on to his children. However, the recent pronouncements of the Department of Education (DepEd) dashed Hermogeno’s dreams for his two children.

The DepEd is proposing to add two more years to the 10 year-basic education in the country, saying that it would address the deteriorating quality of Philippine education. The proposed educational reform, dubbed as K12, will supposedly equip its graduates with the necessary knowledge and skills to land a job.

After Release of Rebel Soldiers, Aquino Should Free ‘Morong 43,’ Political Prisoners

MANILA — After President Benigno S. Aquino III granted amnesty to rebel soldiers, relatives and supporters pressed anew for the release of the Morong 43 and other political prisoners in the Philippines.

The 43 health workers were arrested in Morong, Rizal on Feb. 6 while conducting a health-skills training.
Charged with illegal possession of firearms and explosives, the 43 were detained at a military camp for almost three months. Thirty-eight of them have been transferred to a regular detention facility at Camp Bagong Diwa since May. Five have remained under military custody.

“We express our support in granting amnesty for all rebel soldiers, but we are dismayed by the inaction of the president on the plight of almost 400 political prisoners who, like the mutineers, fought the corrupt and repressive Arroyo regime,” said Roneo Clamor, acting secretary-general of human-rights group Karapatan and husband of Dr. Merry Mia-Clamor, one of the Morong 43.

Clamor said Justice Secretary Leila de Lima already submitted her recommendations on the case of the Morong 43 to the president. “But up to now, there is no action from Malacañang,” said Clamor..... MORE

Truth body ignores SC, starts work

By Benjamin B. Pulta and Angie M. Rosales 10/16/2010

A former Supreme Court chief justice, Hilario Davide, went ahead with his “Truth Commission” despite the absence of a ruling by the high court on the legal challenge posed by congressional allies of former President now Rep. Gloria Arroyo.

Davide, having been a high court chief justice, was expected to give the high court the courtesy of not going ahead with the truth body and await its ruling, but he stated at a press conference yesterday the body was pressed for time for the investigations which are said to number at least 23.

But the legal challenge posed by Arroyo’s allies, Flerida Ruth Romero, one of three retired Supreme Court justices in the commission, would make the body unable to begin investigations until the court ruled on the suit.
“Let me say (that) in my view, we cannot undertake any substantive action,” Romero said. “We don’t even have a budget yet.”

Aquino formed the Truth Commission immediately after taking office on June 30 to investigate widespread allegations of high-level corruption during Arroyo’s reign.

Davide, the chairman of the commission, said the body had a mandate to complete its work by the end of 2012, and that it needed to begin investigations quickly..... MORE

Noy’s House allies follow suit, slam high court on stay order

By Gerry Baldo 10/16/2010

Predictably, the allies of President Aquino in the House of Representatives, taking his cue in Supreme Court (SC) bashing, also slammed the high court yesterday in a show of support,

Members of the House echoed Aquino’s criticism of the high court for issuing a status quo ante order on his Executive Order (EO) 2.

House Majority Leader Rep. Neptali “Boyet” Gonzales II said the SC should exercise some caution in issuing a status quo ante order against its co-equal in government even as he cited the earlier status quo ante order issued by the high court mandating the House committee on justice to stop the impeachment proceeding against Ombudsman Merceditas Gutierrez.

“Earlier, they (SC) intervened in the constitutional duty of Congress to hear impeachment cases and now they are trying to prevent the Executive Department from performing its duties. It seems that the Supreme Court is looking for a clash,” Gonzales stressed.

Gonzales said he is hoping that the SC will have some good reasons in issuing its ruling against EO2. which he said rescinded the alleged “midnight appointments.”.... MORE

‘Juan’ now a typhoon, alert up

10/16/2010
Tropical storm “Juan” (international codename “Megi”) has intensified into a typhoon as it heads toward the Philippines, prompting weather authorities to warn the public that the typhoon could bring the same amount of rains typhoon “Ondoy” brought.

As of 2 p.m. (Friday), the typhoon was spotted 1,200 kilometers east of Southern Luzon with maximum sustained winds of 120 kph near the center and gustiness of up to 150 kph. It is moving west-northwest at 20 kph, said Philippine Atmospheric, Geophysical and Astronomical Services Administration (Pagasa ).

Juan is forecast to make landfall in the provinces of Cagayan and Isabela on Monday afternoon, but state forecasters warned against any sea travel and fishing in Northern Luzon as early as Sunday morning.

“Ondoy is a tropical storm category. Ondoy would actually be of a lesser strength. However, if you start looking at the amount of rainfall that Juan is going to bring, satellite imagery shows that the amount of rain it’s bringing is basically similar to what Ondoy had dropped in Metro Manila,” Pagasa chief Graciano Yumul told a press briefing..... 4,000 Pinoys working illegally in Afghanistan

By Michaela P. del Callar 10/16/2010

Despite the government travel ban to Afghanistan, some 4,000 undocumented Filipinos are reportedly working in the Middle East state, Labor and diplomatic sources yesterday said.

These Filipinos, according to sources, are hired by contractors of United States firms operating in Afghanistan and have managed to slip through the country via Dubai, United Arab Emirates.

The salary of these workers, sources said, could fetch up to $10,000, or around P430,000, a month.
Manila has no embassy in Afghanistan, making it difficult for Philippine authorities to monitor the entry and movement of Filipinos there.

“We cannot do anything. They keep on coming because of the high pay and we cannot match the salaries they’re getting there here in the Philippines,” a Labor official said..... MORE

Noy likely not to grant amnesty to ‘Morong 43’

By Aytch S. de la Cruz and Mario J. Mallari 10/16/2010

Here’s to the much-vaunted equal justice to all.
President Aquino III yesterday sounded as he were not inclined to accord the same leniency to the political prisoners who were part of the so-called Morong 43 as he did in the cases of over 300 rebel soldiers whom he granted amnesty three days ago.

Despite Malacanang officials’ claims that the case of the Morong 43 remains under continuous review by Justice Secretary Leila de Lima, Aquino broadly implied during a press conference that the Executive can hardly do anything about it because it is within the jurisdiction of the courts.

“The matter is before the courts. Again, it’s within their jurisdiction… We would want to rectify that situation [of the Morong 43] but that will have to undergo sanction by the courts that have already taken cognizance of the case… The Executive cannot order their release without the courts’ sanction,” Aquino said when asked what he plans to do on the cases of the detained health workers concerned.

Aquino last Tuesday risked anew his dwindling popularity when he signed Proclamation No. 50 that grants amnesty to over 300 military insurgents, most of whom are members of the notorious Magdalo group, including controversial figures such as former Lieutenant Senior Grade and now Senator Antonio Trillanes IV and the fugitive Capt. Nicanor Faeldon..... MORE

A kidnapped female Filipino-Chinese trader was released on Thursday evening just outside Cotabato City after almost a week of captivity by suspected Muslim kidnap group.

Seventy-three-year-old Conchita Tan was turned over safely by her captors to an emissary of the Tan family to an undisclosed area. No other details were available as of press time.

Earlier, reports said the kidnappers demanded P50 million for the safe release of Tan, wife of Lucio Tan, owner of LCT Hardware operating in Cotabato City.

It was not clear, however, if the release of Tan was a result of ransom payment.

Last Oct. 6, Tan was forcibly taken by heavily-armed kidnapped men who even engaged in a gunbattle against the driver and security escort of the Filipino-Chinese trader. The driver and the bodyguard died while undergoing treatment at a local hospital..... MORE

Leila’s dilemma

EDITORIAL

10/15/2010
Justice Secretary Leila de Lima must have been feeling very left out or isolated in the cliquish administration of Noynoy Aquino to pour her heart out to the media after the Palace’s dilution of the recommendations in the report on the hostage taking crisis that was painstakingly crafted by the Incident Investigation and Review Committee (IIRC) that even the Hong Kong government had surrendered in order to have and exhaustive probe of the incident and do justice to the eight slain residents of the territory.

De Lima, one of two officials who crossed over from the Arroyo administration — the other being Foreign Affairs Secretary Alberto Romulo, both of whom obviously do not have access privilege to Noynoy’s inner circle — is obviously guessing most of the time on the political weather at the Palace.

She intimated in a press briefing that resignation from her post crossed her mind as a result of the apparent whitewash on the accountability of some officials close to the administration in the IIRC recommendations.
The feeling of isolation should have been turned up several notches more after Noynoy issued Proclamation 50 granting amnesty to all soldiers who rebelled against Gloria, including Sen. Antonio Trillanes IV, without De Lima being consulted on the pardon..... MORE

Noynoy Aquino appears to believe that, as he is President of the Republic, he is so powerful that he can even make a co-equal branch of government — the Supreme Court (SC) — bow to his whims as well as surrender to his vindictive nature.

He has also shown — and not just once — that he holds no respect for the co-equal branch of government that moreover has the constitutional mandate to pass judgment and rule on controversial acts, decrees, circulars, as the high court, whether or not people agree with its rulings, is the final arbiter in such questioned acts.

Noynoy went on an attack mode against the high court, after it issued a status quo ante order in a case of the so-called “midnight appointees” one of the many he had fired upon his assumption to office, through his Executive Order (EO) 2, which revoked the appointment of National Commission on Muslim Filipinos commissioner and secretary Bai Omera Dianalan-Lucman.

Reacting to the SC order, which contradicts his EO 2 — at least in the case of petitioner Lucman, Noynoy charged that the high court’s move sets back his administration’s reform efforts..... MORE

SAN JOSE MINE — Thirty-three balloons decked out in Chile’s red-white-and-blue colors floated free into the night sky above this mine late Wednesday at the exact moment the last of the 33 trapped miners was brought to the surface.

The globes, scudding across a crescent moon, symbolized the liberation of the men and the soaring pride Chileans felt in their nation — a shared moment of unsurpassed joy and union.

Eyes and cheeks glistened with tears of emotion as the miners’ relatives in Camp Hope, at the entrance to the San Jose mine, watched the balloons rise.

Then they burst into Chile’s national anthem, singing along with the last miner saved, Luis Urzua, wearing a Chilean flag draped over his shoulders, and an emotional President Sebastian Piñera.

The depth of feeling electrified the thousands of international journalists in the camp, who respectfully stood in silence alongside the families, recording the event, and sharing in it..... MORE

NEW YORK — For almost a day we were glued to our TV set, with bated breaths, watching the rescue of the 33 Chilean miners trapped 2,600 feet below ground level, for 69 days, since the gold and copper mine collapsed Aug. 5. And we were just as emotional as everyone on the site, crying and laughing and applauding whenever a miner stepped out of the metal capsule and on to firm ground.

It was as if we were Chileans — no, not just us in our tiny apartment, but the entire world, seemingly one big country, one big Chile, rooting for a group of men even family had already started to give up as lost, and then were suddenly there, like newly-born.

CNN’s coverage I found excellent. In between rescues, the TV news network gave out bits and pieces of background information in no way hysterical but simply factual — batu-bato sa langit, ang tamaan, well, wala akong magagawa kung magalit kayo, because heck, you’re really hysterical and given to manipulating viewers’ emotions.

Anyway, so through CNN, I found out there had already been complaints against the San Jose Mine; its mother company Empresa Minera San Esteban is known in Chile to have a poor safety record. The mine was shut down in 2007 following an accidental death in its premises, but just like in da Pilipins reopened in 2008, “despite failing to comply with all regulations.”.... MORE

Sweet, bitter and tasteless DIE HARD III Herman Tiu Laurel 10/15/2010

Sweet, bitter and tasteless

DIE HARD III
Herman Tiu Laurel
10/15/2010
Today I prefer to start with the sweet than the bitter because a homecoming to freedom is a joy beyond compare. I have been behind bars before and know of its oppressiveness. Last time I was “in,” I was a fellow detainee of the civilian and military protestors of the Manila Peninsula standoff. I was released after only five days, though I thought I would stay for years.

I left behind young courageous military officers who had started their protests way back in 2003 at Oakwood against the corruption and illegality of the former regime. When the Manila Pen standoff took place in 2007, we were carted off to jail altogether. Three years later, all were released except one, Sen. Antonio Trillanes IV. For those he has inspired with his steadfast principles, the political amnesty signed for him a few days ago can only be the sweetest news in quite a long time.

There is, however, a slightly bitter aftertaste when one considers that this amnesty should not have been needed at all if only all the legalistic crap that stood in the way of immediate freedom for those that stood up to the former regime was never taken seriously.

The bitter aftertaste even becomes a very bitter sense of indignation when one recalls the history of the past 10 years, beginning with the brazen subversion of the nation’s Basic Law by a motley group of conspirators from the Legislature, the Judiciary, the military and police, the Catholic Church, and the evil “civil society,” with foreign elements that deposed a duly-constituted government to install a regime of their own of unprecedented corruption, oppression, and usurpation of power.

Bitterness then almost turns to nausea when one sees that not one of the conspirators has been punished as most are even in the perches of power today.

More bitter irony in that Gloria Arroyo, who now sits in the legislature, participates in crafting laws, and disposes national budgets after insulting the whole nation with her lies, from the Impsa scam to the “Hello Garci” cheating, down to the ZTE-NBN scandal; while Aquino III assures her impunity by creating a mock investigative commission and placing at its helm her chief cohort in the 2001 Edsa II abomination.
Irony overflows as Joker Arroyo continues to throw inane arguments to frustrate justice for Trillanes, who is absolutely free of scandal, while he still has not answered charges of misuse of Philippine Charity Sweepstakes Office funds in the 2001 elections, as well as his illegal walkout in the impeachment hearings that denied President Estrada his day in court.

Irony never ends as the Lord of all Lords Chavit Singson, Edsa II rogues Ebdane, Esperon et al. still lord it over, with the list of the vile ruling in style becoming endless.

I look forward to the day soon after the final release of Senator Trillanes to bring about a long deserved meeting between him and the inspiration of the entire anti-Gloria, anti-oligarchy, pro-masa struggle, President Joseph Estrada, who himself served six years and six months of unjust incarceration under the oppressive, illegal regime of Gloria Arroyo and the oligarchy behind her.

Although the two have not met in the past decade, I have always believed that Estrada and Trillanes represent genuine leadership for the nation and the Republic — being individuals (and leaders) of the highest order, and being truly patriotic and never subservient.

Unlike all other politicians on the present political stage, the two have never compromised their most fundamental principles of service to the people and the laws of the Republic in exchange for any quarter from the powerful oligarchs, corrupt tyrants or their prison guards.

Of the events surrounding this amnesty for Trillanes, there is one that seems very tasteless, to say the least. I am referring to the prosecutors of the Department of Justice (DoJ) who said, “We are disappointed… because we had wanted to know what the court will say… We concede that these are political offenses but we have a problem with the timing. If you want to respect the rule of law, we should have waited for the promulgation.”

Such is the farce of our judicial system where the criminals run free while the conscientious objectors, protestors, and dissenters are imprisoned, with the state’s lawyers totally helpless in helping the latter and prosecuting the former. The court trying the Magdalo and Trillanes case has taken too long to absolve the innocent and has proven to be inutile, too, in going after the guilty. Almost everything of vital importance in this society is decided by politics and not the law.

But the tasteless DoJ prosecutors’ comments only echo their secretary’s candid declaration that resignation has indeed crossed her mind after Malacañang tampered with the Incident Investigation and Review Committee’s findings.

Resignation is not something said but done. Her saying it while not doing it is hypocrisy and doubletalk—typical of the posturing of Aquino III’s Cabinet such as Robredo’s being Department of Interior and Local Government secretary but not really; Puno’s not taking jueteng bribes but not apprehending the bribers; and Defense chief Gazmin’s talk of an assassination plot against Aquino but not really offering any proof or follow through.

Meanwhile, my final “tasteless” award, though not related to the Trillanes case, goes to the Pasig River marathon led by “philanthropist” Gina Lopez who raised multi-million sums, not from her own pockets, but from tens of thousands of university students who forked out P100-registration fees and P150-T-shirts, and by compelling government to fund policemen and soldiers to join, while her family raises electricity rates again by another 30 centavos per kilowatt hour this month. This hypocritical kind of elite philanthropy, together with the tastelessness of the current political leadership, is what ought to go into the Guinness Book of World Records!

Drownings, mutilation: Animal cruelty haunts the Balkans

BELGRADE — A video of a Bosnian girl tossing puppies into a fast-flowing river caused international outrage last month; earlier in the year there was the case of a dog found in Serbia with her paws cut off.

There are other incidents — from tails hacked off strays to bears being forced to dance — to illustrate startling cruelty towards animals in the Balkans, where having pets was frowned on in the Communist era.
The Balkans are “victims of a traditional primitivism,” said Velimir Ivanisevic of the Sarajevo-based Animal Protection group SOS, describing an “inappropriate attitude” towards animals in the region.

The footage of the teenage girl casually taking squealing puppies out of a bucket and hurling them one by one into the river was all over the Internet. Authorities tracked her down but it is unclear if she will be charged.
The case of the one-year-old dog discovered terrified under a car in a Belgrade suburb in April with her paws sawn off caused similar outrage.

The stray, later named Mila, became a cause celebre and local media and businesses rallied to raise money for her care. After months of treatment, she has started to walk on her bandaged stumps..... MORE

BISHKEK—Parliamentary elections in Kyrgyzstan that saw the rise of a fiercely nationalist party have raised questions about the fate of a US airbase seen as key to coalition military operations in Afghanistan.

Kyrgyzstan, a geo-strategically important country that is the only one in the world to host both US and Russian military bases, held elections Sunday to create former Soviet Central Asia’s first parliamentary democracy.

The hardline nationalist Ata-Zhurt party that topped the poll had pledged during the campaign to oust the United States Transit Centre at Manas outside the capital Bishkek, a key conduit for troops and fuel to support operations in the war-wracked country.

Akhmatbek Keldybekov, an Ata-Zhurt party leader, told AFP that the party planned on keeping its promise.

Noy slams SC on ‘midnight hires’ status quo

10/15/2010
President Aquino is on a warpath, and his targeted enemy is the Supreme Court (SC) as the high court did not bow to his Executive Order (EO), with the court having issued a status quo ante ruling, effectively having one of the petitioners whom Aquino alleges to be a midnight appointee return to her post.

Aquino yesterday showed no sign of respect to the SC for issuing a status quo ante order against his EO2, which he said was meant to rid the Executive Department of the “midnight appointees” by his predecessor, claiming that returning them to their posts is a recipe for chaos and paralysis in the Executive Branch of government.

He slammed the high court for meddling in his administration’s affairs.

But the high court reminded Aquino that it is vested with the power and the duty to engage in judicial review, which encompasses the issuance of temporary restraining orders and status quo ante orders..... MORE

Appeasing HK, China no interest to me — Noy

By Aytch S. de la Cruz 10/15/2010

Appeasing Hong Kong or China would be a flimsy reason to again revise the recommended Palace actions in the hostage fiasco report, according to President Aquino yesterday even as the Hong Kong and Chinese government protested the watering down by Aquino’s legal advisers of the original recom-mendations contained in the Incident Investigation and Review Committee (IIRC) which it was able to draw up with the help of Chinese authorities.

Aquino said he is standing by the revised Palace version of the IIRC recommend-ations that freed a close buddy and two of his allies of any accountability in the Aug. 23 botched hostage rescue even if it entails risking the country’s diplomatic relations with China and its Special Administrative Region.

Aquino even mockingly said he has no interest in continuously ap-peasing his Chinese counterparts and the
least he can do is simply explain to them why he arrived on the decision to revise the proposed charges on the accountable officials.

He added that the explaining to the Chinese government will be left up to a high-level delegation he previously formed led by Vice President Jejomar Binay and Foreign Affairs Secretary Alberto Romulo..... MORE

The delay in the release of the Special Allotment Release Order (Saro) for the congressmen’s Priority Development Assistance Fund (PDAF), more commonly referred to as pork barrel, is reportedly causing restlessness among the 278 members of the House of Represent-atives with many allegedly planning to stage a coup against Speaker Feli-ciano “Sonny” Belmonte.

This was claimed by a congressman who granted an interview on condition of anonymity.

According to the lawmaker, many of his colleagues are contemplating on replacing Belmonte as Speaker, as he (Belmonte) has been remiss in his duty in asking the Palace and the Department of Budget and Management (DBM) to release their pork barrel to fund projects for their respective districts.

“We have been waiting for such a long time now, the year is about to end and yet the Saro for our PDAF which would fund our projects in our districts has not been released,” said the solon.

“Aggravating the matters is that the barangay elections are only about a week away and our barangay officials are lining up at our district offices everyday following up the projects for their respective localities,” the solon added. “And we can’t even give them assurance that funds for their projects are forthcoming.”.... Alleged jueteng lords no-show in Senate probe

10/15/2010
Suspected jueteng lords and operators as mentioned in the privilege speech of Sen. Miriam Defensor-Santiago and as alleged by retired Lingayen-Dagupan Archbishop Oscar Cruz yesterday snubbed the Senate inquiry into the illegal numbers game despite receiving invitations from the upper chamber.

Following their non-appearance, blue ribbon committee chairman Sen. Teofisto Guingona III decided to hold another hearing next week before wrapping up the proceedings.

“This will be the one last time that you can air your side, one last time, in the spirit of transparency and fair play,” said Guingona, also the overall lead in the probe, at a briefing after the hearing.

Among those invited by blue ribbon and local government committee headed by Sen. Ferdinand “Bongbong” Marcos Jr. to clear their names were Ilocos Sur Gov. Luis “Chavit” Singson, Pampanga Gov. Lilia Pineda and her husband Rodolfo “Bong” Pineda, Paul Dy of Isabela and Charlie “Atong” Ang.

Guingona maintained that proper invitations were sent to the resource persons denying the

Aquino gets back at GMA for quizzing ‘Dinky doleouts’

By Aytch S. de la Cruz 10/15/2010

Former President and now Pampanga Rep. Gloria Arroyo is being told by her successor and former student, President Aquino, to practice “professionalism” after questioning Social Welfare Secretary Corazon “Dinky” Soliman on the proposed P21-billion budget that his government intends to allocate to reinforce the conditional cash transfer (CCT) program.

Both Soliman and the CCT are remnants of Arroyo’s nine-year presidency which apparently prompted Aquino to think that his predecessor was taking it personally against him and Soliman who left
her during one of the critical periods of her administration.

Soliman also served as secretary of the Department of Social Welfare and Development (DSWD) under the Arroyo administration.

The CCT project, meanwhile, originated during the Arroyo presidency. based on a proposal by her DSWD Secretary Esperanza Cabral who patterned it after the successful poverty alleviation programs of other third world countries specifically Brazil..... MORE

CA turns down Ping’s plea

Benjamin B. Pulta 10/15/2010

The Court of Appeals (CA) has put off action on the plea of embattled Sen. Panfilo Lacson who is asking the appellate court to stop a Manila court from enforcing the arrest warrant against him in connection with the kidnapping and murder of publicist Salvador “Bubby” Dacer and his driver, Emmanuel Corbito, a decade ago.

The appellate court decided instead to hear first the comments of the Manila regional trial court (RTC) and the Dacer family on Lacson’s petition which sought a review of the resolution finding the existence of probable cause to prosecute the lawmaker for murder.

The resolution became the basis for the issuance of arrest order against him.

“Action on the prayer for the issuance of the temporary restraining order and/or writ of preliminary injunction is held in abeyance until receipt of the comment or expiration of the period to file comment,” the CA said in a resolution..... MORE

Noy no-show in Senate’s 94th year

By Angie M. Rosales 10/15/2010

Did President Aquino snub the Senate’s 94th anniversary celebration Wednesday night?

The President sent his regrets, through his appointments secretary on his being unavailable for the said yearly event, in which he would have been the guest of honor, due to a prior commitment.

Such commitment was just adjacent to the room in Hotel Sofitel Philippine Plaza, where his former colleagues in the upper chamber, erstwhile senators and former President Joseph Estrada were in attendance for a simple sit-down dinner, it was gathered.

The question arose just when some Senate beat reporters stepped out of the Mindanao function room of the hotel when they were told that Aquino had arrived.

This came as a surprise to them since they knew beforehand that Aquino will not show up. It was former president and now Pampanga Rep. Gloria Arroyo who was expected that night since she committed to grace the intimate gathering, only to inform the protocol officers of the upper chamber her last-minute cancellation of her attendance.....
