Comelec’s complaint vs Gloria ‘fatally flawed’
By Angie M. Rosales 11/22/2011The case lodged by the Commission on Elections (Comelec) against former president now Pampanga Rep. Gloria Arroyo suffers from major flaws, the Arroyo counsel and spokesman Ferdinand Topacio said yesterday.
He pointed out that the Nov. 18 resolution of the poll body finding probable cause against Arroyo is “fatally flawed and may be annuled, as he stressed that section 5, rule 3 of the Comelec Rules of Procedure calls for a quorum and votes required.
In Section 5. on Quorum; Votes Required, the proviso says that (a) when sitting en banc, four members of the Commission shall constitute a quorum for the purpose of transacting business. The concurrence of a majority of the members of the Commission shall be necessary for the pronouncement of a decision, resolution, order or ruling..... MORE

"“It seems to have been rushed. The impression (it left) is that, the filing of the case was railroaded,” said Enrile in an interview with reporters, as he cautioned over what could be a possible “erosion of check and balance” principle by the three branches of government.
"Both senators were referring to the filed electoral sabotage by the Department of Justice (DoJ) and the Comelec task force amid the Supreme Court’s issuance of a temporary restraining order (TRO) on the government’s directive that placed Arroyo under a watchlist order."
