High court rules on Taguig elections dispute
By Benjamin B. Pulta 04/28/2011A ruling by the Supreme Court (SC) has turned down the plea of Taguig Mayor Maria Laarni Cayetano to stop the recount and retrieval of ballots in the city.
In an 11-page resolution, the SC en banc through Associate Justice Antonio Eduardo Nachura ordered the Commission on Elections (Comelec) to proceed with dispatch the election protest filed by retired SC Justice Dante Tiñga in connection with the city’s mayoralty elections.
The high tribunal pointed out that it is the Comelec which should decide the election protest of Tinga against Cayetano since it is the court which has jurisdiction over the case.
“(T)he protest filed by private respondent (Tiñga) and the counter-protest filed by petitioner (Cayetano) remain pending before the Comelec, which should afford petitioner ample opportunity to ventilate her grievances. Thereafter, the Comele should decide these cases with dispatch..... MORE
