Military snubs SC habeas order to present health workers in court

A hearing by the Court of Appeals (CA) on a petition questioning the detention of 43 health workers who were arrested by military and police in Rizal province last week due to their alleged links with the local communist group has been deferred by the appellate court.

The Armed Forces of the Philippines (AFP) yesterday failed to present the so-called “Morong 43” before the court as ordered by the Supreme Court in connection with the habeas corpus petition filed by their families.
CA Special First Division Justice Normandie Pizarro scolded 202nd Infantry Brigade commander Col. Aurelio Baladad for not complying with the order.
He explained in open court that the military ignored the essence of writ of habeas corpus which is immediacy and “might send a wrong signal in future cases.”
Pizarro stressed that it is important under the rules that the subject of the petition be presented in court before the respondents could prove the legality of the detention....MORE
