Under intense grilling from the members of Congress during a joint session on the issue of the revocation of Gloria Arroyo’s martial law (ML) decree, Gloria’s aides admitted that indeed there was no actual rebellion at the time Presidential Proclamation (PP) 1959 was declared.

This column has no intention of joining the chorus voicing their opposition to martial law or questioning the merits of its declaration. Rather, we are deeply concerned that the regional imposition of the emergency rule could be a prelude to something about which nobody wants to think. Surely, Presidential Proclamation 1959 was issued to deal, though obviously not the proper remedy, with the premeditated massacre committed by a notorious warlord, who, until after that bloodbath, professed his loyalty to Arroyo.

By all indications, the congressional debate on the declaration of martial law in Maguindanao would be a long-drawn one with Presidential Proclamation (PP) 1959 likely to endure when all things have been said.
The existing military takeover of the province was being attributed to a “looming” rebellion by the armed goons of Ampatuan clan, which is believed responsible for the massacre of 57 civilians last Nov. 23.

There is hardly any doubt that the Congress, filled with Gloria Arroyo’s allies, will uphold her martial law (ML) proclamation for the given 60 days. This was never in question, despite the fact that there are really no constitutional and legal grounds for such a declaration, since the Constitution is clear on a declaration of ML ground on an actual rebellion, which was clearly absent when Gloria imposed martial rule.

Filipinos now look to the high court to rule on this issue,
